Bagi maksud peraturan ini, “orang yang kompeten” ertinya seseorang yang pada pendapat pemegang lesen mempunyai kelayakan, latihan, pengalaman, pengetahuan, kemahiran atau keupayaan yang sesuai untuk melaksanakan tugas yang baginya dia dilantik.

Pembuangan efluen

Pemegang lesen, kecuali pemegang lesen penjelajahan, hendaklah mematuhi kaedah pembuangan efluen sebagaimana yang dinyatakan―

dalam skim pengendalian melombong yang disebut dalam seksyen 10 Akta; atau

(b)

dalam skim pemprosesan mineral atau pelan pengurusan penyimpanan yang disebut Peraturan-Peraturan Pembangunan

Pemegang lesen penjelajahan hendaklah, sebelum memulakan suatu ujian pemprosesan, memperoleh kebenaran bertulis daripada Pengarah berhubung dengan kaedah pembuangan efluen.

Mana-mana pemegang lesen penjelajahan yang melanggar subperaturan (2) melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi satu ratus ribu ringgit atau dipenjarakan selama tempoh tidak melebihi lima tahun atau kedua-duanya.

MINERAL DEVELOPMENT ACT 1994

MINERAL DEVELOPMENT (EFFLUENT) REGULATIONS 2016

IN exercise of the powers conferred by paragraph 63(2)(c)

of the Mineral Development Act 1994 [Act 525], the Minister makes the following regulations:

Citation and commencement 1.

(1)

These regulations may be cited as the Mineral Development (Effluent)

Regulations 2016.

(2)

These Regulations come into operation on 1 January 2017.

Interpretation 2.

(1)

In these Regulations—

“effluent” means any liquid waste produced by any exploration, mining or processing of mineral activities;

"licence holder" means a holder of—

(a)

a prospecting licence;

(b)

an exploration licence;

(c)

a proprietary mining licence;

(d)

a mining lease; or

(e)

a licence in relation to storing of mineral activity or a mineral processing licence under the Mineral Development (Licensing)

Regulations 2016 [P.U. (A) 337/2016];

Any reference to—

(a)

a licence holder includes a reference to a manager appointed under the Act or a premises manager appointed under the Mineral

Development (Licensing) Regulations 2016; and

(b)

mineral includes a reference to mineral ores.

Non-application 3.

These Regulations shall not apply to mining activities or mineral exploration activities carried out offshore.

Parameter limits in effluent 4.

(1)

No person shall discharge any effluent containing parameters specified in column (2) of the Schedule where the effluent contain parameters exceeding the limits specified in column (3).

(2)

Notwithstanding subregulation (1), a licence holder shall apply to the

Director General to discharge any effluent containing parameter exceeding the limit specified in column (3) provided that the parameter of the effluent shall not exceed the limit specified in column (4).

(3)

The Director General may approve or reject the application referred to in subregulation (2).

(4)

Subject to subregulations (1) and (2), where the effluent discharged contains two or more parameters specified in items 25 to 28 of the Schedule, the total concentration of the parameters shall not exceed—

(a)

where the limit in column (3) of the Schedule is applicable,

0.5 milligramme per litre; or

(b)

where the limit in column (4) of the Schedule is applicable―

(i)

3.0 milligrammes per litre; or

(ii)

if in soluble forms, 1.0 milligramme per litre.

(5)

Where the effluent discharged contains phenol and free chlorine, the concentration of phenol and free chlorine, where the limit in column (4) of the Schedule is applicable, shall not exceed 0.2 milligramme per litre and 1.0 milligramme per litre respectively.

(6)

Any person who contravenes subregulations (1), (2), (4) or (5) commits an offence and shall, on conviction, be liable to a fine not exceeding one hundred thousand ringgit or to imprisonment for a term not exceeding five years or to both.

Sampling and analysis of effluent 5.

(1)

The sampling and analysis of effluent shall be made in accordance with the methods specified in the 20th Edition or later edition of the “Standard Methods for the Examination of Water and Wastewater” published jointly by the American Public

Health Association, the American Water Works Association and the Water Environment

Federation of the United States of America.

(2)

A licence holder shall appoint a competent person to carry out the sampling and analysis of effluent.

(3)

The competent person shall carry out the sampling and analysis of effluent in accordance with the method referred to in subregulation (1).

(4)

Any person who contravenes subregulation (2) or (3) commits an offence and shall, on conviction, be liable to a fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding three years or to both.

(5)

For the purposes of this regulation, “competent person” means a person who in the opinion of a licence holder has appropriate qualification, training, experience, knowledge, skills or capability to perform the duties for which he is appointed.

Discharge of effluent 6.

(1)

A licence holder, except a holder of an exploration licence, shall comply with the method of effluent discharged as specified―

(a)

in the operational mining scheme referred to in section 10 of the

Act; or

(b)

in the mineral processing scheme or storage management plan referred to in the

Mineral

Development

(Licensing)

Regulations 2016.

(2)

A holder of an exploration licence shall, prior to the commencement of a trial processing, obtain a written approval from the Director in relation to the method of effluent discharged.

(3)

Any holder of an exploration licence who contravenes subregulation (2)

commits an offence and shall, on conviction, be liable to a fine not exceeding one hundred thousand ringgit or to imprisonment for a term not exceeding five years or to both.

(4)

For the purposes of this regulation, “trial processing” means treatment of a representative portion of the deposit mass solely for the purpose of determining the projected viability for developing the deposit.

Responsibility of licence holder 7.

(1)

For the purposes of ensuring the effluent disposed comply with the provisions of these Regulations, a licence holder shall—

(a)

take samples of effluent and analyse the concentration of the parameters of the effluent within the period determined by the

Director;

(b)

treat the effluent to ensure parameters in the discharged effluent do not exceed the limits referred to in regulation 4;

(c)

keep and maintain a record of the sampling and analysis of the parameters in the discharged effluent as determined by the

Director; and

(d)

provide relevant training on monitoring of effluent parameters including sampling and analysis to appropriate personnel.

(2)

Any licence holder who contravenes subregulation (1) commits an offence and shall, on conviction, be liable to a fine not exceeding one hundred thousand ringgit or to imprisonment for a term not exceeding five years or to both.

Penalty for continuing offences 8.

Any person who commits an offence under these Regulations shall, in the case of a continuing offence, be liable, in addition to any fine provided under these Regulations, to a further fine of two thousand ringgit for each day or part of a day during which the offence continues after conviction.
