Seksyen 1

Peraturan-peraturan ini bolehlah dinamakan Peraturan-Peraturan Kebajikan

Haiwan (Notis Penambahbaikan) 2020.

Seksyen 2

Tafsiran

Dalam Peraturan-Peraturan ini, “notis penambahbaikan” ertinya suatu notis penambahbaikan yang disampaikan kepada pemunya atau pemegang lesen di bawah seksyen 25 Akta.

Seksyen 3

Notis penambahbaikan

(1)

Jika seseorang pegawai kebajikan haiwan itu berpendapat bahawa pemunya atau pemegang lesen itu tidak mematuhi seksyen 24 Akta, pegawai kebajikan haiwan itu boleh menyampaikan kepada pemunya atau pemegang lesen itu suatu notis penambahbaikan sebagaimana yang dinyatakan dalam Borang 1 Jadual.

(2)

Permohonan bagi melanjutkan tempoh pematuhan yang disebut dalam subseksyen 25(4) Akta boleh dibuat oleh pemunya atau pemegang lesen sebagaimana yang dinyatakan dalam Borang 2 Jadual.

(3)

Bagi melanjutkan tempoh pematuhan yang disebut di bawah subperaturan (2), pegawai kebajikan haiwan boleh menyampaikan suatu notis sebagaimana yang dinyatakan dalam Borang 2 Jadual.

Kaedah penyampaian

Seksyen 4

(1)

Seorang pegawai kebajikan haiwan boleh menyampaikan notis penambahbaikan di bawah peraturan 3 kepada pemunya atau pemegang lesen dengan cara yang berikut:

(a)

menyampaikan notis penambahbaikan secara kediri kepada pemunya atau pemegang lesen;

(b)

melalui pos berdaftar Akuan Terima yang dialamatkan ke alamat pemunya atau pemegang lesen yang terakhir diketahui; atau

(c)

dengan menampalkan suatu notis penambahbaikan di mana-mana bahagian yang mudah dilihat di premis pemunya atau pemegang lesen.

(2)

Jika suatu notis penambahbaikan telah disampaikan dengan cara yang disebut dalam subperaturan (1), notis penambahbaikan itu hendaklah disifatkan telah disampaikan kepada pemunya atau pemegang lesen selepas tujuh hari dari tarikh notis itu disampaikan.

IN exercise of the powers conferred by paragraph 62(2)(n)

of the

Animal Welfare Act 2015 [Act 772], the Minister, after consulting the Board, makes the following regulations:

Citation 1.

These regulations may be cited as the Animal Welfare (Improvement Notice)

Regulations 2020.

Interpretation 2.

In these Regulations, “improvement notice” means an improvement notice served to the owner or the licensee under section 25 of the Act.

Improvement notice 3.

(1)

Where an animal welfare officer is of the opinion that an owner or a licensee fails to comply with section 24 of the Act, the animal welfare officer may serve on the owner or the licensee an improvement notice as specified in Form 1

of the Schedule.

(2)

The application to extend the compliance period referred to in subsection 25(4) of the Act may be made by an owner or a licensee as specified in

Form 2 of the Schedule.

(3)

To extend the compliance period referred to under subregulation (2), the animal welfare officer may serve a notice as specified in Form 2 of the Schedule.

Methods of service 4.

(1)

An animal welfare officer may serve the improvement notice under regulation 3 to the owner or licensee in a manner as follows:

(a)

by delivering the improvement notice personally to the owner or licensee;

(b)

by prepaid A.R. registered post addressed to the last known address of the owner or licensee; or

(c)

by affixing the improvement notice at any conspicuous part of the premise of the owner or licensee.

(2)

Where an improvement notice has been served in the manner referred to in subregulation (1), the improvement notice shall be deemed to have been served to the owner or licensee after seven days from the date the notice is served.
