JOHOR PORT AUTHORITY (PASIR GUDANG PORT) (SCALE OF CHARGES)
(AMENDMENT) BY-LAWS 2021
IN exercise of the powers conferred by sections 16,
17A and 29
of the Port Authorities Act 1963 [Act 488], the Johor Port Authority, with the approval of the Minister, makes the following by-laws:
Citation and commencement 1.
(1)
These by-laws may be cited as the Johor Port Authority (Pasir Gudang
Port) (Scale of Charges) (Amendment) By-Laws 2021.
(2)
These By-Laws come into operation on 9 September 2021.
Amendment of by-law 3 2.
The Johor Port Authority (Pasir Gudang Port) (Scale of Charges) 2011
[P.U. (A) 175/2011], which are referred to as the “principal By-laws” in these By-laws, are amended in by-law 3—
(a)
by inserting after subparagraph (i) the following subparagraph:
“(ia)
Authority Approved Anchorage dues;”;
(b)
in subparagraph (q)—
(i)
by deleting the word “additional”; and
(ii)
by deleting the word “and” at the end of subparagraph;
(c)
in subparagraph (r), by substituting for the full stop at the end of subparagraph the words “; and”; and

by inserting after subparagraph (r) the following subparagraph:
“(s)
handling charge for transhipment of OOG containers, damaged containers or non-ISO standard containers.”.
Amendment of by-law 4 3.
By-law 4 of the principal By-laws is amended—

in subparagraph (2)(b), by deleting the word “and” at the end of the subparagraph;
(b)
in subparagraph (2)(c), by substituting for the full stop at the end of the subparagraph the words “; and”; and
(c)
by inserting after subparagraph (2)(c) the following subparagraph:
“(d)
port dues.”.
Amendment of by-law 8 4.
Paragraph 8(1) of the principal By-laws is amended—
(a)
by substituting for subparagraph 8(1)(b) the following subparagraph:
“(b)
berthing, unberthing or shifting a vessel at Authority
Approved Anchorage or any other areas within the Port except Authority’s wharf;”;
(b)
in subparagraph (c), by deleting the word “or” at the end of the subparagraph; and
(c)
by inserting after subparagraph (c) the following subparagraphs:
“(ca) assisting or shifting a vessel for laying-up purpose;

assisting or shifting or berthing, or unberthing or towage or escorting oil rig, dead vessel, vessel which draft exceeds 12
metre, vessel with irregular shape or others at the
Authority’s wharf or at the private jetties or in the Port or for laying-up purpose;

assisting or shifting or berthing, or unberthing or towage or escorting all vessels involve in salvage activities; or”.
Amendment of by-law 11 5.
By-law 11 of the principal By-laws is amended—
(a)
in subparagraph (1)(a), by inserting after the word “passengers” the words
“at the Authority Approved Anchorage or any other areas within the Port except Authority’s wharf”;
(b)
in subparagraph (1)(b), by substituting for the words “a berth” the words
“, a berth or any other areas within the Port except Authority’s wharf”; and
(c)
by deleting paragraphs (4) and (5).
New by-law 12A
6.
The principal
By-laws are amended by inserting after by-law 12
the following by-law:
“Authority Approved Anchorage dues 12A.
A port user shall pay the anchorage dues to the Authority for a vessel anchoring at the Authority Approved Anchorage at the rate as specified in Part 11A of the First Schedule.”.

Amendment of by-law 17 7.
By-law 17 of the principal By-laws is amended—
(a)
in subparagraph (a), by inserting after the word “vehicles” the words
“(including driver)”;
(b)
in subparagraph (b), by inserting after the word “cargo” the words
“(including driver and terminal tractor)”; and
(c)
in subparagraph (c), by inserting after the word “containers” the words
“(including driver and terminal tractor)”.
Amendment of by-law 19 8.
By-law 19 of the principal By-laws is amended—
(a)
in paragraph (2)—
(i)
by deleting the word “FCL” wherever appearing;
(ii)
by deleting the words “LCL” wherever appearing;
(iii)
in subsubparagraphs 2(c)(i) and (2)(d)(ii) by deleting the words
“, lighter or barge” respectively; and
(iv)
by deleting subparagraphs (2)(e), (f), (g) and (h); and
(b)
by inserting after paragraph (3) the following paragraph:
“(4)
The handling charge under paragraph (1) shall include lashing services.”.

Amendment of by-law 20 9.
By-law 20 of the principal By-laws is amended—
(a)
in a shoulder note, by substituting for the words “Additional handling” the word “Handling”;
(b)
in subparagraphs (1)(a) and (b), by deleting the words “or vessel’s crane”
respectively;
(c)
in subparagraphs (1)(c) and (d), by inserting after the words “using the”
the words “Port’s crane or” respectively; and
(d)
in subparagraph (1)(e), by inserting after the word “cover” the words “or gear boxes”.
New by-law 21A
10.
The principal
By-laws are amended by inserting after by-law 21
the following by-law:
“Handling charge for transhipment of OOG containers, damaged containers or non-ISO standard containers 21A.
(1)
A port user shall pay to the Authority the handling charge for handling the transhipment of OOG containers, damaged containers or non-ISO standard containers using the Port’s crane at the rate as specified in Part 32 of the
First Schedule.
(2)
The handling charge for the transhipment of OOG containers, damaged containers or non-ISO standard containers shall include—
(a)
the discharging of containers from the first vessel using the
Port’s crane and stacking in the container yard; and

(b)
the off-loading of containers from the container yard and loading onto the second vessel using the Port’s crane.”.
Amendment of by-law 22 11.
By-law 22 of the principal By-laws is amended by substituting for subparagraphs (a) to (f) the following subparagraphs:
“(a)
removal services charge;
(b)
storage charge for bulk and break bulk cargo;
(c)
wharf services charge on privately operated wharf;
(d)
handling charge for dry bulk cargo, break bulk cargo and liquid bulk cargo; and
(e)
handling charge for import or export of OOG containers, damaged containers or non-ISO standard containers.”.
Deletion of by-laws 23 and 24 12.
The principal By-laws are amended by deleting by-laws 23 and 24.
Substitution of by-law 28 13.
The principal By-laws are amended by substituting for by-law 28
the following by-law:
“Handling charge for dry bulk cargo, break bulk cargo and liquid bulk cargo 28.
(1)
A port user shall pay the handling charge to the Authority for the use of bulk cargo handling equipment in handling—
(a)
dry bulk cargo and break bulk cargo at the rate as specified in Part 14 of the Second Schedule; and

(b)
liquid bulk cargo at the rate as specified in Part 14 of the
Second Schedule.
(2)
The handling charge under paragraph (1) shall include any of the following wharf services, as the case may be:
(a)
the receiving or delivery of any cargo directly on the wharf;
(b)
the transfer of any cargo from the wharf to a warehouse or an open yard for storing and delivery to a consignee; or
(c)
the receiving of any cargo from the shipper into the warehouse or open yard for storing and transferring such cargo to the wharf for loading onto the vessel.”.
New by-law 28A
14.
The principal
By-laws are amended by inserting after by-law 28
the following by-law:
“Handling charge for import or export of OOG containers, damaged containers or non-ISO standard containers 28A.
A port user shall pay to the Authority the handling charge for import or export of OOG containers, damaged containers or non-ISO standard containers using the Port’s crane at the rate as specified in Part 16 of the Second Schedule.”.
Amendment of by-law 29 15.
By-law 29 of the principal By-laws is amended—
(a)
in subparagraph (a), by substituting the word “scale” with the word
“weighing”; and
(b)
by deleting subparagraphs (b), (e), (f) and (j).

The principal By-laws are amended by substituting for by-law 30
the following by-law:
“Weighbridge and weighing charge 30.
A port user shall pay to the Authority the weighbridge and weighing charge for the use of a weighbridge at the rate as specified in Part 1 of the Third
Schedule.”.
Deletion of by-law 31 17.
The principal By-laws are amended by deleting by-law 31.
Amendment of by-law 32 18.
By-law 32 of the principal By-laws is amended—
(a)
in subparagraph (1)(c) and paragraph (10), by substituting for the words
“item 3” the words “item 4” respectively;
(b)
in paragraph (11), by substituting for the words “if permitted” the words
“upon permission, the port user shall pay the storage charge to the
Authority at the rate specified in item 3 Part 4 of the Third Schedule,”; and
(c)
by deleting paragraph (12).
Deletion of by-laws 34, 35 and 39 19.
The principal By-laws are amended by deleting by-laws 34, 35 and 39.
Amendment of by-law 41 20.
Paragraph 41(1) of the principal By-laws is amended by substituting for the words
“thirty-six hours” wherever appearing the words “twenty-four hours”.
