‘ “instrumen” termasuk garis panduan, arahan, penentuan, pekeliling atau standard;’.

hendaklah memegang perakuan pendaftaran yang diperlukan sebagai kontraktor berdaftar yang dikeluarkan oleh Lembaga yang dinyatakan oleh Suruhanjaya.”; dan

Kaedah-Kaedah ibu dipinda dengan menggantikan kaedah 4 dengan kaedah yang berikut:

“Permohonan untuk dan pengeluaran permit 4.

(1)

Permohonan untuk suatu permit hendaklah dibuat kepada

Suruhanjaya dalam bentuk dan cara yang ditentukan oleh Suruhanjaya.

Tiap-tiap permohonan di bawah subkaedah (1) hendaklah disertakan dengan fi yang dinyatakan dalam butiran 1 Jadual Kedua.

Pemohon bagi suatu permit hendaklah mengemukakan—

(a)

maklumat yang dikehendaki di bawah subkaedah (4); dan

(b)

apa-apa maklumat atau dokumen lain sebagaimana yang

dikehendaki oleh Suruhanjaya menurut apa-apa instrumen yang dikeluarkan oleh Suruhanjaya.

(4)

Permohonan untuk suatu permit hendaklah mengandungi maklumat yang berikut:

(b)

kategori kerja yang akan dikendalikan atau disediakan oleh pemohon;

perakuan pendaftaran yang diperlukan sebagai kontraktor berdaftar yang dikeluarkan oleh Lembaga, jika diperlukan;

dan

(e)

apa-apa maklumat dan dokumen yang dikemukakan kepada

Lembaga bagi maksud didaftarkan sebagai kontraktor atau kebenaran untuk mengakses apa-apa maklumat dan dokumen secara langsung daripada Lembaga.

Suruhanjaya boleh, selepas menimbangkan permohonan untuk suatu permit di bawah subkaedah (1), meluluskan atau menolak permohonan itu.

Jika permohonan untuk suatu permit diluluskan, permit hendaklah dikeluarkan tertakluk kepada syarat-syarat yang dikenakan oleh Suruhanjaya di bawah kaedah 7.

Jika permohonan untuk suatu permit ditolak, sebab bagi penolakan itu hendaklah diberikan kepada pemohon secara bertulis.”.

Kaedah-Kaedah ibu dipinda dengan memasukkan selepas kaedah 4 kaedah yang berikut:

“Menolak untuk memproses permohonan permit

Seksyen 4A

Jika permohonan untuk suatu permit dikemukakan kepada Suruhanjaya tetapi tidak dibuat menurut Kaedah-Kaedah ini atau mana-mana instrumen lain yang dikeluarkan oleh Suruhanjaya, Suruhanjaya boleh menolak untuk memproses permohonan itu atau menghendaki supaya permohonan itu dipinda atau dilengkapkan dan dikemukakan semula atau supaya suatu permohonan baharu dikemukakan kepada Suruhanjaya.

Suruhanjaya boleh menolak permohonan permit dalam keadaan tertentu

(a)

pemohon sedang disiasat oleh

Suruhanjaya atau pihak berkuasa lain yang berkaitan yang berhubungan dengan—

(i)

apa-apa kegagalan untuk mematuhi mana-mana peruntukan Akta, perundangan subsidiarinya atau apa-apa instrumen lain yang dikeluarkan oleh

Suruhanjaya;

(ii)

apa-apa kegagalan untuk mematuhi mana-mana undang-undang bertulis lain yang berkaitan, perundangan subsidiarinya atau apa-apa instrumen lain yang dikeluarkan di bawah undang-undang bertulis itu atau oleh pihak berkuasa yang berkaitan; atau 6

(iii)

pendedahan apa-apa maklumat atau dokumen yang berhubungan dengan permit kepada pihak lain yang dia mengetahui atau mempunyai sebab untuk mempercayai adalah salah atau mengelirukan;

pemohon tertakluk kepada mana-mana prosiding mahkamah—

yang berhubungan dengan keadaan dalam perenggan (1)(a);

(ii)

untuk pelanggaran apa-apa syarat yang dikenakan ke atas permit oleh Suruhanjaya; atau

(iii)

untuk apa-apa kerja yang dinyatakan dalam permit yang dijalankan oleh pemegang permit;

keputusan Suruhanjaya untuk menolak permohonan oleh pemohon bagi suatu permit hendaklah tertakluk kepada mana-mana prosiding mahkamah; atau

“Kuasa untuk menambah, mengubah atau membatalkan syarat 7A. (1)

mengenakan apa-apa syarat tambahan ke atas permit itu;

Sebelum

Suruhanjaya membuat keputusan di bawah subkaedah (1), Suruhanjaya hendaklah memberikan pemegang permit itu—

(a)

suatu notis bertulis mengenai niat Suruhanjaya berserta dengan suatu salinan draf mengenai pengenaan, perubahan atau pembatalan itu; dan

(b)

suatu peluang untuk membuat penghujahan bertulis dalam tempoh yang dinyatakan dalam notis bertulis itu yang tidak kurang daripada empat belas hari dari tarikh notis itu diserahkan kepada pemegang permit.

(3)

Selepas tamat tempoh yang dinyatakan dalam notis itu,

Suruhanjaya hendaklah, selepas menimbangkan apa-apa penghujahan bertulis yang dibuat oleh pemegang permit itu, memutuskan sama ada untuk mengenakan syarat tambahan atau mengubah atau membatalkan mana-mana syarat sedia ada atau tidak mengambil tindakan lanjut, dan memberitahu pemegang permit itu secara bertulis mengenai keputusannya.

Pemegang permit tidak berhak untuk mendapatkan apa-apa bentuk pampasan atau ganti rugi daripada Suruhanjaya atas pengenaan, perubahan atau pembatalan syarat menurut Kaedah-Kaedah ini.”.

pemegang permit mendedahkan apa-apa maklumat atau dokumen yang berhubungan dengan permit kepada mana-mana pihak lain yang dia mengetahui atau mempunyai sebab untuk mempercayai adalah salah atau mengelirukan;

pemegang permit tidak mematuhi undang-undang bertulis lain yang berhubungan dengan alam sekitar;

Mana-mana orang yang menjalankan apa-apa kerja di bawah seksyen 50 Akta dengan menggunakan suatu permit yang telah menjadi tidak sah menurut subkaedah (6), hendaklah disifatkan sebagai menjalankan kerja-kerja tanpa permit.”.

Pemegang permit hendaklah memberitahu

Suruhanjaya secara bertulis, dengan seberapa segera yang mungkin, tentang apa-apa perubahan dalam butir-butir pemegang permit dan pemberitahuan itu hendaklah disertai dengan fi yang dinyatakan dalam butiran 3 Jadual Kedua.

Setelah menerima pemberitahuan dan fi, Suruhanjaya hendaklah meminda butir-butir pemegang permit itu dalam permitnya.”.

Walau apa pun subkaedah (1), Suruhanjaya boleh melanjutkan tempoh sekatan ke suatu tempoh yang ditentukan oleh Suruhanjaya berdasarkan keseriusan kesalahan di bawah perenggan (1)(a) atau kegagalan di bawah perenggan (1)(b), (c), (d) dan (e).

Sebelum

Suruhanjaya membuat keputusan di bawah subkaedah (1), Suruhanjaya hendaklah memberi orang itu—

(a)

suatu notis bertulis mengenai niat Suruhanjaya untuk menyekat orang itu daripada memohon atau diberikan permit di bawah Kaedah-Kaedah ini; dan

Suggest a correction

(b)

suatu peluang untuk membuat penghujahan bertulis dalam tempoh yang dinyatakan dalam notis bertulis itu yang tidak kurang dari empat belas hari dari tarikh notis itu diserahkan kepada orang itu.

(4)

Selepas tamat tempoh yang dinyatakan dalam notis itu,

Suruhanjaya hendaklah, selepas menimbangkan apa-apa penghujahan bertulis yang dibuat oleh orang itu, memutuskan sama ada untuk menyekat orang itu daripada memohon atau diberikan suatu permit di bawah Kaedah-Kaedah ini, dan memaklumkan kepada orang itu secara bertulis mengenai keputusannya.

Pemegang permit tidak berhak kepada apa-apa bentuk pampasan atau ganti rugi daripada Suruhanjaya jika orang itu disekat daripada memohon atau diberikan permit di bawah Kaedah-Kaedah ini.

Sekatan daripada memohon atau diberikan permit di bawah

Kaedah-Kaedah ini hendaklah berkuat kuasa pada—

(a)

suatu tarikh yang dinyatakan oleh Suruhanjaya dalam notis bertulis yang diberikan di bawah subkaedah (4); atau

(b)

jika tiada tarikh yang dinyatakan dalam notis bertulis yang diberikan di bawah subkaedah (4), apabila habis tempoh empat belas hari dari tarikh notis itu disampaikan kepada orang itu.

Seksyen 16

Kaedah-Kaedah ini bagi suatu tempoh tidak melebihi sepuluh tahun jika orang itu—

  1. IN exercise of the powers conferred by paragraph 180(g) of the Water Services Industry Act 2006 [Act 655], the Commission makes the following rules: Citation and commencement 1.

(1)

These rules may be cited as the Water Services Industry (Permit)

(Amendment) Rules 2021.

These Rules come into operation on 13 October 2021.

Amendment of rule 2 2.

The Water Services Industry (Permit) Rules 2007 [P.U. (A) 438/2007], which are referred to as the “principal Rules” in these Rules, are amended in rule 2

by inserting before the interpretation of “Lembaga” the following interpretation:

‘ “instrument” includes a guideline, direction, determination, circular or standard;’.

Amendment of rule 3 3.

Rule 3 of the principal Rules is amended—

(a)

in subrule (1), by inserting after paragraph (a) the following paragraph:

“(aa) a business registered in Malaysia as a sole proprietor or partnership;”;

by substituting for subrule (2) the following subrule:

“(2)

Any person or class of persons who apply for an IPA Type C permit under paragraphs 5(1)(c), (ca), (cb) and (cc) shall hold

the requisite certificate of registration as a registered contractor issued by the Lembaga as may be specified by the Commission.”; and

(c)

by inserting after subrule (2) the following subrule:

“(3)

Notwithstanding subrules (1) and (2), the Commission may impose further conditions relating to the eligibility of person or class of persons applying for a permit, as it thinks fit, pursuant to any instrument issued by the Commission.”.

Substitution of rule 4 4.

The principal Rules are amended by substituting for rule 4 the following rule:

“Application for and issuance of a permit 4.

(1)

An application for a permit shall be made to the Commission in the form and manner as determined by the Commission.

(2)

Every application under subrule (1) shall be accompanied by the fee as specified in item 1 of the Second Schedule.

(3)

An applicant for a permit shall submit—

(a)

the information required under subrule (4); and

(b)

any other information or document as required by the Commission pursuant to any other instrument issued by the Commission.

(4)

An application for a permit shall contain the following information:

the category of work which will be operated or provided by the applicant;

the requisite certificate of registration as a registered contractor issued by the Lembaga, if required; and

(e)

any information and document submitted to the Lembaga for the purposes of being registered as a contractor or consent to access to any information and document directly from the Lembaga.

(5)

The Commission may, after considering the application for a permit under subrule (1), approve or refuse the application.

If an application for a permit is approved, the permit shall be issued subject to the conditions imposed by the Commission under rule 7.

If an application for a permit is refused, the reasons for the refusal shall be given to the applicant in writing.”.

The principal Rules are amended by inserting after rule 4 the following rules:

“Refusal to process permit applications 4A. If an application for a permit is submitted to the Commission but is not made in accordance to these Rules or any other instrument issued by the

Commission, the Commission may refuse to process the application or require that the application be amended or completed and resubmitted or that a fresh application be submitted to the Commission.

The Commission may refuse permit applications in certain circumstances 4B. (1)

Without prejudice to the generality of subrule 4(5), the Commission may refuse an application for a permit if—

(a)

the applicant is being investigated by the Commission or other relevant authorities in relation to—

any failure to comply with any of the provisions of the Act, its subsidiary legislation or any other instrument issued by the Commission;

(ii)

any failure to comply with any other relevant written laws, its subsidiary legislation or any other instrument issued under the written laws or by the relevant authorities; or

(iii)

disclosure of any information or document relating to a permit to the other parties that he knows or has reason to believe is false or misleading;

(b)

the applicant is subject to any court proceedings—

(i)

in relation to the circumstances in paragraph (1)(a);

(ii)

for breach of any condition imposed on a permit by the Commission; or

(iii)

for any works specified in the permit that was carried out by the permit holder;

(c)

the decision of the Commission for refusing the application by the applicant for a permit shall subject to any court proceedings; or

(d)

the applicant has been convicted of an offence under the Act or its subsidiary legislation.

(2)

If an application for a permit is refused for reasons in paragraph (1)(a), (b), (c) or (d), the applicant shall not be eligible to apply for any permit unless the Commission is satisfied that—

(a)

the investigations under paragraph (1)(a) has concluded and there are no court proceedings;

the court proceedings under paragraphs (1)(b) and (c)

are final and conclusive; or

(c)

the court proceedings involving the applicant under paragraph (1)(d) are final and conclusive, and the applicant has served the sentence for the conviction.”.

Amendment of rule 5 6.

Rule 5 of the principal Rules is amended—

by substituting for paragraph (a) the following paragraph:

“(a)

an IPA Type A1 permit to carry out any construction, connection, modification or repair of—

section of service water pipe after the meter point and internal plumbing;

(ii)

individual internal sewerage piping or common internal sewerage piping which connect to an inspection chamber or septic tank; or

by inserting after paragraph (a) the following paragraph:

“(aa) an IPA Type A2 permit to carry out any construction, connection, modification or repair of water supply system as specified under IPA Type A1 permit and communication pipe;”;

“(b)

an IPA Type B permit to carry out any construction, modification, connection or repair to an individual internal sewerage piping or a common internal sewerage piping from an inspection chamber to a sewer;”;

Rule 7 of the principal Rules is amended—

the permit holder shall comply with other written laws relating to environment;”; and

(ii)

in paragraph (j), by substituting for the words “under the Act”

the words “by the Commission or issued under other written laws or by the relevant authorities”; and

by inserting after subrule (1) the following subrule:

“(2)

A permit holder who fails to comply any provision under subrule (1), commits an offence and shall, on conviction, be liable to a fine not exceeding three hundred thousand ringgit or to imprisonment for a term not exceeding three years or to both.”.

The principal Rules are amended by inserting after rule 7 the following rule:

“Power to add, vary or revoke conditions 7A. (1)

The Commission may, during the validity period of a permit—

(a)

impose any additional condition on the permit; or

vary or revoke any condition imposed on the permit.

(2)

Before the Commission makes a decision under subrule (1), the Commission shall give the permit holder—

(a)

a written notice of the intention of the Commission together with a draft copy of the imposition, variation or revocation;

and

(b)

an opportunity to make written submissions within a period specified in the written notice which shall not be less than fourteen days from the date on which the notice is served on the permit holder.

(3)

After the expiry of the period specified in the notice, the Commission shall, after considering any written submission made by the permit holder, decide whether to impose the additional condition or vary or revoke any existing condition or take no further action, and notify the permit holder in writing of its decision.

(4)

The permit holder shall not be entitled to obtain any form of compensation or damages from the Commission for the imposition, variation or revocation of the conditions in accordance with these Rules.”.

Deletion of rule 8 10.

The principal Rules are amended by deleting rule 8.

Amendment of rule 10 11.

Rule 10 of the principal Rules is amended—

(a)

by substituting for the shoulder note the following shoulder note:

“Revocation, suspension or cessation of permits”;

The Commission may by written notice revoke any permit issued under these Rules or suspend the permit for a period

the permit holder fails to comply with any of the provisions of the Act, its subsidiary legislation or any other instrument issued by the Commission;

the permit holder had improperly, illegally or misrepresented any fact or particulars to obtain the permit;

the permit holder has been convicted of an offence under the Act or its subsidiary legislation;

(e)

the permit holder fails to comply with any other relevant written laws, its subsidiary legislation or any other instrument issued under the laws or by the relevant authorities;

the permit holder discloses any information or document relating to a permit to the other parties that he knows or has reason to believe is false or misleading;

(g)

the permit holder fails to comply with other written laws relating to environment; or

Suggest a correction

(h)

there has been any act or default on the part of the permit holder or there has been a change of circumstances such that the permit holder would no longer be entitled to be granted a permit under the Act or these Rules.”;

in paragraph (2)(b), by substituting for the words “thirty days” the words

Notwithstanding any other provision of this

Rules, a permit issued under these Rules shall cease to be valid in the following circumstances:

a receiver or manager, provisional liquidator or like official has been appointed over the whole or substantial part of the permit holder’s assets and such appointment is not revoked or annulled within a period of sixty days from the date of such appointment; or

(e)

the permit holder ceases to carry on its business.

(7)

Any person who carries out any work under section 50

of the Act using a permit that has ceased to be valid pursuant to subrule (6), shall be deemed to be carrying out the works without a permit.”.

The principal Rules are amended by deleting rule 11.

The principal Rules are amended by inserting after rule 11 the following rule:

“Change in particulars of permit holder 11A. (1)

A permit holder shall notify the Commission in writing, as soon as possible, of any change in the particulars of the permit holder and the notification shall be accompanied by the fee as specified in item 3

of the Second Schedule.

(2)

Upon receipt of the notification and the fee, the Commission shall amend the particulars of the permit holder in his permit.”.

Amendment of rule 13 14.

Subrule 13(1) of the principal Rules is amended by substituting for the words

“as prescribed” the words “as specified”.

New rules 15 and 16 15.

The principal Rules are amended by inserting after rule 14 the following rules:

(2)

Notwithstanding subrule (1), the Commission may extend the period of restriction to such period as may be determined by the Commission based on severity of the offence under paragraph (1)(a) or failure under paragraphs (1)(b), (c), (d) and (e).

(3)

Before the Commission makes a decision under subrule (1), the Commission shall give the person—

(a)

a written notice of the intention of the Commission to restrict the person from applying for or being granted a permit under these Rules; and

(b)

an opportunity to make written submissions within a period specified in the written notice which shall not be less than fourteen days from the date on which the notice is served on the person.

(4)

After the expiry of the period specified in the notice, the Commission shall, after considering any written submission made by the person, decide whether to restrict the person from applying for or being granted with a permit under these Rules, and notify the person in writing of its decision.

(5)

The permit holder shall not be entitled to any form of compensation or damages from the Commission if the person is restricted from applying for or being granted with a permit under these Rules.

(6)

The restriction from applying for or being granted with a permit under these Rules shall take effect on—

(a)

a date specified by the Commission in the written notice given under subrule (4); or

(b)

if no date is specified in the written notice given under subrule (4), on the expiry of fourteen days from the date on which the notice is served on the person.

The Commission shall have the power and discretion to publish a list of names of persons whose permits have been revoked or suspended pursuant to rule 10 and restricted by the Commission pursuant to rule 15 by such means and manner as determined by the Commission.”.
