sama ada olehnya sendiri atau melalui Pendaftar bagi maksud itu, menghantar suatu notis yang menghendaki maklumat kepada orang yang daripadanya maklumat itu dikehendaki dengan cara pos biasa yang dialamatkan kepada orang itu atau dengan menyampaikan notis itu kepada orang itu sendiri atau kepada seseorang anggota isi rumahnya yang dewasa.

Jika mana-mana orang yang daripadanya maklumat itu dikehendaki tidak memberikan maklumat itu kepada Ketua Pendaftar atau Pendaftar dalam masa tujuh hari selepas notis di bawah perenggan (3)(b) disampaikan kepadanya oleh Ketua Pendaftar atau

Pendaftar, maka selain apa-apa penalti yang ditetapkan oleh mana-mana undang-undang bertulis, namanya hendaklah dipotong daripada daftar pemilih induk sekiranya dia berdaftar sebagai pemilih.

Pendaftar dan tiap-tiap orang yang dilantik oleh

Ketua Pendaftar di bawah perenggan (3)(a) yang kepadanya telah diberikan apa-apa maklumat atau yang olehnya maklumat itu dikumpulkan di bawah peraturan ini hendaklah dengan serta-merta memberikan maklumat itu kepada Ketua Pendaftar.”.

tiap-tiap orang yang berkelayakan untuk didaftarkan sebagai seorang pemilih Parlimen di dalam mana-mana

Negeri; dan

tiap-tiap orang yang berkelayakan untuk didaftarkan sebagai seorang pemilih Negeri di dalam Negeri itu, dan yang belum didaftarkan sedemikian di bawah Peraturan-Peraturan ini sebagai pemilih bagi suatu kawasan pendaftaran.

Bagi maksud pendaftaran seseorang pemilih bagi suatu kawasan pendaftaran di bawah subperaturan (1), Pendaftar hendaklah memuaskan hatinya tentang kecukupan maklumat berhubung dengan—

(a)

status kewarganegaraan, nama penuh, nombor kad pengenalan dan alamat kediaman pemilih

dan apa-apa maklumat lain mengenai pemilih, yang diperoleh daripada jabatan yang dipertanggungkan dengan tanggungjawab yang berhubungan dengan hal ehwal pendaftaran warganegara Malaysia; dan

status kehilangan kelayakan pemilih yang boleh diminta oleh

Pendaftar daripada mana-mana agensi

Kerajaan Persekutuan yang berkaitan.”.

Permohonan di bawah subperaturan (1) hendaklah dibuat dalam

Borang A dalam Jadual dan hanya boleh dibuat sekali bagi setiap pemerakuan daftar pemilih tambahan.”.

Pendaftar hendaklah, seberapa segera yang boleh selepas pemerakuan itu, memberikan notis dalam Warta bahawa daftar pemilih tambahan itu, atau suatu salinan daftar itu, terbuka untuk diperiksa mengikut cara sebagaimana yang ditentukan oleh Suruhanjaya Pilihan Raya.

Notis dibawah subperaturan (2) boleh diberikan oleh Pendaftar—

(a)

berkenaan dengan daftar pemilih tambahan bagi lebih daripada satu kawasan pendaftaran; atau

(b)

berkenaan dengan daftar pemilih tambahan bagi satu kawasan pendaftaran atau satu unit pendaftaran.

Daftar pemilih tambahan yang diperakui hendaklah mula berkuat kuasa pada tarikh notis di bawah subperaturan (2) disiarkan dalam

Warta dan, tertakluk kepada apa-apa perubahan dalam daftar pemilih tambahan itu, jika ada, daftar pemilih tambahan itu hendaklah berkuat kuasa

sehingga daftar pemilih tambahan itu digabungkan dengan daftar pemilih induk dan kemudiannya diperakui semula.”.

“Tuntutan yang berhubungan dengan daftar pemilih tambahan

Mana-mana orang yang telah didaftarkan dalam daftar pemilih tambahan bagi mana-mana kawasan pendaftaran yang baginya dia berkelayakan untuk didaftarkan boleh mengemukakan suatu tuntutan kepada

Ketua Pendaftar atau mana-mana Pendaftar—

(a)

jika dia telah memohon bagi pemindahan pendaftarannya ke suatu tempat yang lain tetapi tidak didaftarkan sedemikian;

jika dia telah didaftarkan bagi suatu kawasan pendaftaran yang bukan kawasan pendaftaran yang berkenaan dengannya orang itu sepatutnya didaftarkan;

(c)

jika terdapat kesilapan atau peninggalan tentang butir-butir peribadinya dalam daftar pemilih tambahan itu; atau

(d)

jika dia mempunyai apa-apa sebab lain yang berhubungan dengan pendaftarannya dalam daftar pemilih tambahan untuk mengemukakan suatu tuntutan.

Tiap-tiap tuntutan oleh orang yang disebut dalam subperaturan (1)

atau (2), yang kemudian daripada ini disebut “penuntut”, hendaklah dibuat dalam Borang C dalam Jadual dan hendaklah dikemukakan kepada

Ketua Pendaftar atau mana-mana Pendaftar dengan sendiri, melalui pos atau melalui cara elektronik.

Setelah menerima suatu tuntutan di bawah subperaturan (1)

atau (2), Ketua Pendaftar atau Pendaftar boleh, jika dia berpendapat bahawa butir-butir yang diberikan dalam tuntutan itu tidak mencukupi, meminta maklumat lanjut daripada penuntut.

Jika penuntut tidak memberikan maklumat lanjut dalam masa empat belas hari dari tarikh dia menerima permintaan di bawah subperaturan (4), tuntutan itu hendaklah disifatkan telah ditarik balik dan Ketua Pendaftar atau Pendaftar tidak akan mengambil tindakan selanjutnya.

Jika Ketua Pendaftar atau Pendaftar berpendapat bahawa sesuatu tuntutan di bawah peraturan ini boleh dibenarkan, dia hendaklah—

(a)

berkenaan dengan tuntutan di bawah subperaturan (1), memasukkan nama penuntut itu ke dalam daftar pemilih tambahan itu; atau

(b)

berkenaan dengan tuntutan di bawah subperaturan (2), memasukkan nama penuntut itu ke dalam daftar pemilih tambahan yang berkenaan, membuat apa-apa pembetulan dalam daftar pemilih tambahan itu atau mengambil apa-apa tindakan lain yang difikirkan perlu, mengikut mana-mana yang berkenaan.”.

Jika Pendaftar berpendapat bahawa sesuatu bantahan tidak boleh dibenarkan kerana—

perkara itu telah diselesaikan oleh keputusan sesuatu mahkamah;

butir-butir yang diberikan dalam sesuatu bantahan tidak mengehakkan pembantah untuk berjaya, dia boleh menghantar kepada pembantah itu suatu notis yang menyatakan pendapatnya dan alasan bagi pendapatnya itu dan bahawa dia bercadang untuk menolak bantahan itu melainkan jika pembantah itu memberikannya notis dalam masa tujuh hari dari tarikh notis yang mula-mula disebut itu bahawa dia menghendaki bantahan itu didengar dan, jika Pendaftar tidak menerima notis sedemikian dalam masa tersebut, dia boleh menolak bantahan itu.”.

  1. IN exercise of the powers conferred by section 15 of the Elections Act 1958 [Act 19], the Election Commission, with the approval of the Yang di-Pertuan Agong, makes the following regulations: Citation and commencement 1.

(1)

These regulations may be cited as the

Elections

(Registration of Electors) (Amendment) Regulations 2021.

These Regulations come into operation on 15 December 2021.

Amendment of regulation 2 2.

The Elections (Registration of Electors) Regulations 2002 [P.U. (A) 293/2002], which are referred to as the “principal Regulations” in these Regulations, are amended in regulation 2, in the definition of “absent voter”, by substituting for the words

“twenty-one years” the words “eighteen years”.

Amendment of regulation 6 3.

Subregulation 6(2) of the principal Regulations is amended—

(a)

by substituting for the words “Voluntary Reserve Force” the words

“Voluntary Police Force”; and

by substituting for the words “postal voters” wherever appearing the words “advance voters”.

Amendment of regulation 10 4.

Regulation 10 of the principal Regulations is amended—

either by himself or through the Registrar in that behalf, send a notice requiring information to the person from whom the information is required by ordinary letter addressed to such person or by delivering such notice to him personally or to an adult member of his household.

(4)

If any person from whom such information is required fails to give such information to the Chief Registrar or Registrar within seven days after service upon him by the Chief Registrar or Registrar of a notice under paragraph (3)(b), he shall, in addition to any penalty prescribed by any written law, have his name deleted from the principal electoral roll if he is registered as an elector.

The Registrar and every person appointed by the Chief Registrar under paragraph (3)(a) to whom any information has been furnished or by whom such information has been collected under this regulation shall forthwith furnish such information to the Chief Registrar.”.

Substitution of regulation 12 5.

The principal Regulations are amended by substituting for regulation 12

the following regulation:

every person who is qualified to be registered as a Parliamentary elector in any State; and

every person who is qualified to be registered as a State elector in such State, and who is not already so registered under these Regulations as an elector for a registration area.

For the purpose of registration of an elector for a registration area under subregulation (1), the Registrar shall satisfy himself as to the sufficiency of the information in relation to—

(a)

the elector’s citizenship status, full name, identity card number and residential address and any other information on the elector, obtained from the department charged with the responsibility relating to the registration of Malaysian citizen affairs; and

(b)

the elector’s disqualification status which may be requested by the Registrar from any relevant agency of the

Federal Government.”.

New regulation 12A

The principal Regulations are amended by inserting after regulation 12

the following regulation:

“Application for transfer of registration 12A. (1)

Any person who has been registered as an elector and desires to transfer his registration to a different locality in which he is qualified to be registered, shall apply to any Registrar of any registration area or any

Assistant Registrar of any registration unit.

(2)

The application under subregulation (1) shall be made in Form A in the Schedule and may only be made once for each certification of the supplementary electoral roll.”.

Amendment of regulation 13 7.

Regulation 13 of the principal Regulations is amended—

(a)

in subregulation (1), by substituting for the words “once every three months” the words “once a month”;

“(5) On the completion of the revision of the supplementary electoral roll of any registration area, the Registrar shall certify the supplementary electoral roll in accordance with regulation 13A.”; and

The principal Regulations are amended by inserting after regulation 13

the following regulation:

“Certification of supplementary electoral roll 13A. (1)

The Registrar for each registration area shall, as soon as possible after the end of each month, certify the supplementary electoral roll of the registration area in Form B in the Schedule.

(2)

The Registrar shall, as soon as possible after the certification, give notice in the Gazette that the supplementary electoral roll, or a copy of the roll, is open for inspection in the manner as determined by the

Election Commission.

Notice under subregulation (2) may be given by the Registrar—

(a)

in respect of the supplementary electoral roll of more than one registration area; or

(b)

in respect of the supplementary electoral roll of one registration area or one registration unit.

(4)

The certified supplementary electoral roll shall have effect on the date of the publication in the Gazette of the notice under subregulation (2)

and, subject to such alterations in the supplementary electoral roll, if any, the supplementary electoral roll shall continue to have effect until the supplementary electoral roll is merged with the principal electoral roll and then re-certified.”.

Substitution of regulation 14 9.

The principal Regulations are amended by substituting for regulation 14

the following regulation:

“Claims relating to supplementary electoral roll

(2)

Any person who has been registered in the supplementary electoral roll for any registration area for which he is qualified to be registered may submit a claim to the Chief Registrar or any Registrar—

(a)

if he has applied for a transfer of registration to a different locality but was not so registered;

if he was registered for a registration area which is not a registration area in respect of which he should have been registered;

Suggest a correction

(c)

if there is an error or omission with regard to his personal details in the supplementary electoral roll; or

Suggest a correction

(d)

if he has any other reason relating to his registration in the supplementary electoral roll for submitting a claim.

(3)

Every claim by the person referred to in subregulation (1) or (2), hereinafter referred to as the “claimant”, shall be made in Form C in the Schedule and shall be submitted to the Chief Registrar or any Registrar personally, by post or by electronic means.

(4)

Upon receipt of a claim under subregulation (1) or (2), the Chief Registrar or Registrar may, if he is of the opinion that the particulars given in the claims are insufficient, request for further information from the claimant.

Where the claimant fails to furnish further information within fourteen days from the date he receives such request under subregulation (4), the claim shall be deemed to have been withdrawn and the Chief Registrar or

Registrar shall take no further action.

(6)

If the Chief Registrar or Registrar is of the opinion that a claim under this regulation may be allowed, he shall—

(a)

in respect of a claim under subregulation (1), enter the claimant’s name in the supplementary electoral roll; or

(b)

in respect of a claim under subregulation (2), enter the claimant’s name in the appropriate supplementary roll, make any correction in the supplementary electoral roll or take any other actions as he deems necessary, as the case may be.”.

Amendment of regulation 15 10.

Regulation 15 of the principal Regulations is amended—

(a)

the matter has been concluded by the decision of a court; or

the particulars given in an objection do not entitle the objector to succeed, he may send to the objector a notice stating his opinion and the grounds for his opinion and that he intends to disallow the objection unless the objector gives him notice within seven days from the date of the first-mentioned notice that he requires the objection to be heard and, if the Registrar receives no such notice within the said time, he may disallow the objection.”.

Regulation 17 of the principal Regulations is amended—
