PADA menjalankan kuasa yang diberikan oleh seksyen 274 Akta Perkhidmatan Kewangan Islam 2013 [Akta 759], Menteri, atas syor Bank, membuat perintah yang berikut: Nama dan permulaan kuat kuasa

Perintah ini bolehlah dinamakan Perintah Perkhidmatan Kewangan

Islam (Pengecualian) (Pindaan) 2021.

Perintah ini disifatkan telah mula berkuat kuasa pada 1 Oktober 2020.

Seksyen 2

Perintah Perkhidmatan Kewangan Islam (Pengecualian) 2020 [P.U. (A) 4/2020]

dipinda dalam subperenggan 2(b) dengan menggantikan perkataan “bagi tempoh satu tahun bermula dari tarikh pemindahan di bawah subseksyen 114(4) Akta” dengan perkataan “sehingga 30 September 2021, atau sehingga Ambra Versicherung AG selesai membuat pemerolehan kontrak takaful semula setakat yang aktiviti pemerolehan itu melibatkan rundingan dan penyelesaian kontrak takaful semula itu dengan pengendali takaful yang terlibat dalam pemindahan perniagaan itu, mengikut mana-mana yang lebih awal”.

ISLAMIC FINANCIAL SERVICES (EXEMPTION) (AMENDMENT) ORDER 2021

Opening note

Preamble

IN exercise of the powers conferred by section 274 of the Islamic Financial Services Act 2013 [Act 759], the Minister, on the recommendation of the Bank, makes the following order: Citation and commencement 1.

(1)

This order may be cited as the Islamic Financial Services (Exemption)

(Amendment) Order 2021.

(2)

This Order is deemed to have come into operation on 1 October 2020.

Amendment of subparagraph 2(b)

Seksyen 2

The Islamic Financial Services (Exemption) Order 2020 [P.U. (A) 4/2020]

is amended in subparagraph 2(b) by substituting for the words “for a period of one year from the transfer date under subsection 114(4) of the Act” the words

“until 30 September 2021, or until Ambra Versicherung AG has completed the acquisition of retakaful contracts in so far as the acquisition activity involves the negotiation and settlement of such retakaful contracts with takaful operators that engaged in such transfer of business, whichever is the earlier”.
