- PADA menjalankan kuasa yang diberikan oleh seksyen 59 Akta Racun Makhluk Perosak 1974 [Akta 149], Menteri membuat perintah yang berikut: Nama dan permulaan kuat kuasa
Seksyen 2
Tertakluk pada perenggan 3, Menteri mengecualikan Sumisaujana TCM
Chemicals Sdn. Bhd. (Nombor Pendaftaran Syarikat: 201001023293 (907064-U))
berhubung dengan racun makhluk perosak yang mengandungi dimethyl disulfide (DMDS)
sebagai perawis aktifnya daripada—
(a)
kehendak untuk mendaftarkan racun makhluk perosak itu di bawah seksyen 7 Akta;
(b)
larangan di bawah perenggan 13(1)(b) Akta bagi maksud pengimportan racun makhluk perosak itu; dan
(c)
kehendak untuk mendapatkan lesen menjual atau menyimpan untuk jualan racun makhluk perosak itu di bawah seksyen 17 Akta.

Syarat pengecualian
Seksyen 3
(1)
Pengecualian di bawah perenggan 2 adalah tertakluk pada syarat yang berikut:
(a)
Sumisaujana
TCM
Chemicals
Sdn.
Bhd.
hendaklah mengimport racun makhluk perosak itu hanya kepada
Pengerang Refining Company Sdn. Bhd. (Nombor Pendaftaran
Syarikat: 201301028727 (1058557-T));
(b)
Pengerang Refining Company Sdn. Bhd. hendaklah menggunakan racun makhluk perosak itu hanya bagi maksud operasi minyak dan gas;
(c)
Sumisaujana TCM Chemicals Sdn. Bhd. hendaklah mengemukakan maklumat bagi maksud pendaftaran kepada Lembaga sebagaimana yang dikehendaki di bawah Kaedah-Kaedah Racun Makhluk
Perosak (Pendaftaran) 2005 [P.U. (A) 302/2005] dalam tempoh pengecualian;
(d)
Sumisaujana TCM Chemicals Sdn. Bhd. hendaklah mengemukakan satu salinan pesanan pembelian racun makhluk perosak itu kepada
Lembaga setiap kali sebelum pengimportan racun makluk perosak itu dijalankan; dan
(e)
Sumisaujana TCM Chemicals Sdn. Bhd. hendaklah mengemukakan suatu laporan yang disediakan oleh Pengerang Refining Company
Sdn. Bhd. kepada Lembaga pada setiap bulan berkenaan dengan—
(i)
pengimportan racun makhluk perosak itu oleh Sumisaujana
TCM Chemicals Sdn. Bhd.; dan
(ii)
penggunaan racun makhluk perosak itu oleh Pengerang
Refining Company Sdn. Bhd.

Menteri boleh membatalkan pengecualian di bawah perenggan 2 jika mana-mana syarat di bawah subperenggan (1) tidak dipatuhi.

PESTICIDES (EXEMPTION) (NO. 3) ORDER 2023

Preamble
- IN exercise of the powers conferred by section 59 of the Pesticides Act 1974 [Act 149], the Minister makes the following order: Citation and commencement 1.

Order has effect for the period from 2
June 2023
to 31 December 2023.
Exemption 2.
Subject to paragraph 3, the
Minister exempts
Sumisaujana
TCM
Chemicals Sdn. Bhd. (Company Registration Number: 201001023293 (907064-U))
in relation to a pesticide containing dimethyl disulfide (DMDS) as its active ingredient from—
(b)
the prohibition under paragraph 13(1)(b) of the Act for the purpose of importation of the pesticide; and
(c)
the requirement to obtain a license to sell or store for sale the pesticide under section 17 of the Act.
Conditions of exemption 3.
(1)
The exemption under paragraph 2 is subject to the following conditions:
(a)
Sumisaujana TCM Chemicals Sdn. Bhd. shall import the pesticide only to

Refining
Company
Sdn.
Bhd.
(Company Registration Number: 201301028727 (1058557-T));

(b)
Pengerang Refining Company Sdn. Bhd. shall use the pesticide only for the purposes of oil and gas operation;
(c)
Sumisaujana TCM Chemicals Sdn. Bhd. shall submit information for the purposes of registration to the Board as required under the Pesticides (Registration) Rules 2005 [P.U. (A) 302/2005]
within the period of exemption;
(d)
Sumisaujana TCM Chemicals Sdn. Bhd. shall submit one copy of purchase order of the pesticide to the Board each time before the importation of the pesticide is carried out; and
(e)
Sumisaujana TCM Chemicals Sdn. Bhd. shall submit a report prepared by Pengerang Refining Company Sdn. Bhd. to the Board each month in respect of—
(i)
the importation of the pesticide by Sumisaujana TCM
Chemicals Sdn. Bhd.; and
(2)
The Minister may revoke the exemption under paragraph 2 if any condition under subparagraph (1) is not complied with.
