Peraturan-Peraturan Harta Pusaka Kecil (Pembahagian) 1955 [L.N. 495/1955], yang disebut “Peraturan-Peraturan ibu” dalam Peraturan-Peraturan ini, dipinda dengan menggantikan perkataan “Land Administrator” di mana-mana jua terdapat dengan perkataan “Estate Distribution Officer”.

, the Estate Distribution Officer shall issue a notice of inquiry in Form DDB to the petitioner, applicant or any other person to attend the inquiry and shall cause such notice of inquiry to be served.
Estate Distribution Officer shall not be less than seven days from the date of hearing.
Officer may dismiss the petition or application referred to in subregulation (1).”.

“Notice of hearing for petition.
Opening note
where there is a previous application in respect of the estate of the deceased, the Estate Distribution Officer shall strike out the petition and inform the petitioner; or
where there is no previous application in respect of the estate of the deceased, the Estate Distribution Officer shall issue to the petitioner a notice of hearing for petition in Form D.
The issuance of the notice of hearing for petition by the Estate Distribution Officer shall not be less than seven days from the date of hearing.
Any person who does not comply with the requirement under subregulation (3), the Estate Distribution Officer may issue a notice of directions in Form DD.”.

“Transfer to
High Court or another
Estate
Distribution
Officer.
If the estate of the deceased is a not a small estate, the Estate Distribution Officer shall transfer to the Registrar of the appropriate High Court the petition referred to in subregulation 3(1) in Form I.
Upon receipt of application for transfer, the President of Estate Distribution shall make an order of transfer in Form R and the Estate Distribution Officer of any other State shall deal with the petition.”.

“Service of notice.
Any notice issued under these Regulations to be served on the petitioner, applicant or any person relating to the estate of the deceased may be effected by hand, post or by electronic communications.”.

“Hearing.
The petitioner or any person who is required to attend the hearing under subregulation 4(1) shall attend the hearing on the date and time and at the place specified in the notice of hearing.
Officer may dismiss the petition if the Estate Distribution Officer is satisfied that the notice of hearing for petition has been served on the petitioner or such person.
Summary distribution.
The petitioner or applicant referred to in section 8B of the Act may apply for a summary distribution order to the Estate Distribution Officer in Form DDC.
Upon receipt of the application under subregulation (1), the Estate Distribution Officer may require the petitioner or applicant to furnish additional documents within a period as he thinks fit from the date the application is received.

Where the petitioner or applicant who does not comply with the requirement under subregulation
, the Estate Distribution Officer may dismiss the application for a summary distribution and may proceed with the issuance of a notice of hearing for petition in Form D, or in the case of subsequent application, with the issuance of a notice of hearing in Form S.
Letters of administration pendente lite.
A petitioner or any beneficiary of the estate of the deceased may, at any time pending the issuance of any distribution order, apply in writing or in any manner as determined by the

Officer for a letter of administration pendente lite for the purpose of obtaining information from any party in respect of the estate of the deceased.

The letter of administration pendente lite granted under subregulation (2) shall be valid for the period of three months from the date the letter of administration pendente lite is granted.”.

For the purposes of section 10

Act, the Estate Distribution Officer may appoint a guardian for a minor or a person of unsound mind, or a next friend for a patient, in Form H.

the sale price of the property is equal to the market value of the property or any value as agreed by the beneficiary.”.

Act, the Estate Distribution Officer shall offer the land or part of it to be purchased by the beneficiary who does not consent to the sale of the land or part of it.

SMALL ESTATES (DISTRIBUTION) (AMENDMENT) REGULATIONS 2024
IN exercise of the powers conferred by section 30 of the Small Estates (Distribution)
Act 1955 [Act 98], the Minister makes the following regulations:
Citation and commencement 1.
(1)
These regulations may be cited as the Small Estates (Distribution)
(Amendment) Regulations 2024.
(2)
These Regulations come into operation on 15 July 2024.
General amendment 2.
The Small Estates (Distribution) Regulations 1955 [L.N. 495 of 1955], which are referred to as the “principal Regulations” in these Regulations, are amended by substituting for the words “Land Administrator” wherever appearing the words “Estate Distribution Officer”.
Amendment of regulation 1A
3.
Regulation 1A of the principal Regulations is amended by inserting before the definition of “Principal Registry” the following definition:
‘ “person” includes an individual, a creditor, a purchaser, the Corporation, the Majlis, a guardian or next friend;’.
Substitution of regulation 2 4.
The principal Regulations are amended by substituting for regulation 2
the following regulation:

(1)
All forms required to be lodged or filed with the Estate Distribution Officer under these Regulations shall be lodged or filed at the
Estate
Distribution
Office unless the Estate Distribution Officer determines otherwise.
The forms to be used for the purposes of these Regulations shall be as specified in the First Schedule.”.
Substitution of regulation 3 5.
The principal Regulations are amended by substituting for regulation 3
the following regulation:
“Petition and search by
Principal
Registry.
3.
A petition for distribution of small estate shall be lodged by a petitioner in Form A to the Estate Distribution Officer.
Upon receipt of the petition under subregulation (1), the Estate Distribution Officer shall complete Part I of Form B and notify the Principal Registry in any manner required by the Principal Registry.
Upon receipt of the notification under subregulation (2), the Registrar shall cause search to be made for any previous application in respect of the estate of the deceased person referred to in the petition.
The Registrar shall certify within a period of one month the finding of the search in Form C to the Estate Distribution Officer, in default of which the Estate Distribution Officer may proceed with the issuance of a notice of hearing in Form D or a notice of inquiry in Form DDB, as the case may be.”.

New regulation 3C

The principal Regulations are amended by inserting after regulation 3B the following regulation:
“Inquiry.
3C.
Upon receipt of a petition under regulation 3, an application under regulation 3A or a subsequent application under regulation 12, the Estate Distribution Officer may conduct an inquiry to verify any information or document relating to such petition, application or subsequent application.
(2)
For the purposes of subregulation
, the Estate Distribution Officer shall issue a notice of inquiry in Form DDB to the petitioner, applicant or any other person to attend the inquiry and shall cause such notice of inquiry to be served.
The issuance of the notice of inquiry by the
Estate Distribution Officer shall not be less than seven days from the date of hearing.
(4)
In the course of inquiry, the Estate Distribution Officer may require the petitioner, applicant or any other person to furnish any information or document as may be necessary.
If the information or document required under subregulation (3) has not been furnished, the Estate Distribution
Officer may dismiss the petition or application referred to in subregulation (1).”.
Substitution of regulation 4 7.
The principal Regulations are amended by substituting for regulation 4
the following regulation:

“Notice of hearing for petition.
4. (1)
Pursuant to the search by the Registrar under subregulation 3(4)—
(a)
where there is a previous application in respect of the estate of the deceased, the Estate Distribution Officer shall strike out the petition and inform the petitioner; or
(b)
where there is no previous application in respect of the estate of the deceased, the Estate Distribution Officer shall issue to the petitioner a notice of hearing for petition in Form D.
(2)
The issuance of the notice of hearing for petition by the Estate Distribution Officer shall not be less than seven days from the date of hearing.
Upon receipt of the notice of hearing for petition under paragraph (1)(b), the petitioner shall serve a copy of such notice of hearing for petition on all persons who are named and addressed in the petition as required under section 9 of the Act by hand, post or by electronic communications.
The Estate Distribution Officer may require any person to appear before him to give evidence or to produce any document in his possession in relation to the petition.

The principal Regulations are amended by substituting for regulation 5
the following regulation:
“Transfer to
High Court or another
Estate
Distribution
Officer.
5. (1) If the estate of the deceased is a not a small estate, the Estate Distribution Officer shall transfer to the Registrar of the appropriate High Court the petition referred to in subregulation 3(1) in Form I.
If the estate is a small estate and it would be more expedient for the petition to be heard by the Estate Distribution Officer of any other State pursuant to subsection 4(2) of the Act, the Estate Distribution Officer shall submit to the President of Estate Distribution an application for transfer of the petition in Form Q.
(3)
Upon receipt of application for transfer, the President of Estate Distribution shall make an order of transfer in Form R and the Estate Distribution Officer of any other State shall deal with the petition.”.
Substitution of regulation 6 9.
The principal Regulations are amended by substituting for regulation 6
the following regulation:
“Service of notice.

Any notice issued under these Regulations to be served on the petitioner, applicant or any person relating to the estate of the deceased may be effected by hand, post or by electronic communications.”.

The principal Regulations are amended by inserting after regulation 6
the following regulations:

“Hearing.
6A.
(1)
The petitioner or any person who is required to attend the hearing under subregulation 4(1) shall attend the hearing on the date and time and at the place specified in the notice of hearing.
Where the petitioner or such person does not attend the hearing without any reasonable cause, the Estate Distribution
Officer may dismiss the petition if the Estate Distribution Officer is satisfied that the notice of hearing for petition has been served on the petitioner or such person.
Summary distribution.
6B. (1)
The petitioner or applicant referred to in section 8B of the Act may apply for a summary distribution order to the Estate Distribution Officer in Form DDC.
(2)
Upon receipt of the application under subregulation (1), the Estate Distribution Officer may require the petitioner or applicant to furnish additional documents within a period as he thinks fit from the date the application is received.
The Estate Distribution Officer shall, after considering the application and the additional documents—
(a)
issue to the petitioner or applicant a distribution order in Form E;
(b)
grant to the petitioner or applicant a letter of administration in Form F; or
(c)
issue to the applicant a subsequent application order in Form T.

(4)
Where the petitioner or applicant who does not comply with the requirement under subregulation
, the Estate Distribution Officer may dismiss the application for a summary distribution and may proceed with the issuance of a notice of hearing for petition in Form D, or in the case of subsequent application, with the issuance of a notice of hearing in Form S.
Letters of administration pendente lite.
6C.
(1)
A petitioner or any beneficiary of the estate of the deceased may, at any time pending the issuance of any distribution order, apply in writing or in any manner as determined by the
Estate
Distribution
Officer for a letter of administration pendente lite for the purpose of obtaining information from any party in respect of the estate of the deceased.
(2)
Upon receipt of the application under subregulation
, the
Estate
Distribution
Officer shall, if he thinks fit, grant a letter of administration pendente lite in Form FA.
(3)
The letter of administration pendente lite granted under subregulation (2) shall be valid for the period of three months from the date the letter of administration pendente lite is granted.”.
Amendment of regulation 7 11.
Regulation 7 of the principal Regulations is amended—
(a)
by substituting for subregulation (1) the following subregulation:

“(1) At the conclusion of the summary distribution or hearing, the Estate Distribution Officer may perform all or any of the following:
make a distribution order in Form E;
grant a letter of administration in Form F.”; and
(b)
by deleting subregulation (2).
Substitution of regulation 8 12.
The principal Regulations are amended by substituting for regulation 8
the following regulation:
“Appointment of guardian or next of friend and entry of caveat.
8. (1) For the purposes of section 10 of the Act, the Estate Distribution Officer may appoint a guardian for a minor or a person of unsound mind, or a next friend for a patient, in Form H.
For the purposes of paragraph 13(2)(b) of the Act, an order for the entry of a caveat to protect the interest of the beneficiary who is a minor or a person of unsound mind shall be in Form HH.” .
Deletion of regulations 9 and 10 13.
The principal Regulations are amended by deleting regulations 9 and 10.
Amendment of regulation 11 14.
Regulation 11 of the principal Regulations is amended—
(a)
in subregulation (2), by deleting the words “forthwith posted at the office of the
Land
Administrator issuing the notice.
Copies of the notice shall if practicable”; and

by substituting for subregulation (7) the following subregulation:
“(7)
Upon the determination of the collateral dispute pursuant to subregulation 4, the Estate Distribution Officer shall proceed to issue an order for distribution in Form E or grant a letter of administration in Form F or a subsequent application order in Form T.”.
Substitution of regulation 12 15.
The principal Regulations are amended by substituting for regulation 12
the following regulation:
“Subsequent application.
12.
An application made in accordance with section 17
of the Act subsequent to the determination of the suit shall be in
Form
P and upon receipt of such application, the Estate Distribution Officer shall issue a notice of hearing for subsequent application in Form S.
(2)
The issuance of the notice of hearing for subsequent application by the
Estate
Distribution
Officer shall not be less than seven days from the date of hearing.
Where the applicant does not attend the hearing without any reasonable cause, the Estate Distribution Officer may dismiss the application if the Estate Distribution Officer is satisfied that the notice of hearing for an application has been served on the applicant.
At the conclusion of the summary distribution or hearing under this regulation, the Estate Distribution Officer may—
(a)
make a subsequent application order in Form T; or
(b)
grant a letter of administration in Form F.”.

“Sale of property.
16A.
(1)
Upon receipt of subsequent application by an administrator under regulation 12, the Estate Distribution Officer may order for the sale of property as provided for in the application.
(2)
Prior to the issuance of the order under subregulation (1), the Estate Distribution Officer shall take into consideration that—
(a)
any potential buyer to the property has been ascertained; and
(b)
the sale price of the property is equal to the market value of the property or any value as agreed by the beneficiary.”.
Deletion of regulation 16AA

The principal Regulations are amended by deleting regulation 16AA.

20.
The principal Regulations are amended by substituting for regulation 16B the following regulation:
“Sale of property by tender among the beneficiaries.
16B. (1) In the exercise of his duties under paragraph 15(4)(d)
of the Act, the Estate Distribution Officer may order the land or any part of it to be sold by tender among the beneficiaries.
(2)
Prior to the issuance of the order under subregulation (1), the Estate Distribution Officer shall—
(a)
specify the distributive proportions due to the respective beneficiaries or the amount due to the creditor, the payment of estate duty, if any, out of the estate of the deceased, and the payment in respect of funeral expenses at the date on which the order is made; and
(b)
fix a reserve price for the purposes of the sale of property by tender, being a price equal to the market value of the property or undivided distributive shares in question as estimated by the Estate Distribution Officer at the date of the tender.
In specifying or fixing any amount for the purposes of sale of property by tender among the beneficiaries, the Estate Distribution Officer shall have regard to any other liabilities which will have to be paid out of the proceeds of sale of property by tender among the beneficiaries.”.

“Sale of land by majority consent.
16BA. (1)
Subject to subsection 15(4A)
of the
Act, the Estate Distribution Officer shall offer the land or part of it to be purchased by the beneficiary who does not consent to the sale of the land or part of it.
If the beneficiary referred to in subregulation (1)
refuse to purchase the land or part of it, the Estate Distribution Officer may open to tender such land or part of it to other beneficiaries or any other potential buyers.”.

Regulation 18 of the principal Regulations is amended—

Deletion of Third Schedule 26.

Saving 27.
(1)
Any petition, application, investigation, hearing and proceedings in relation to the distribution of a small estate pending before the date of coming into operation of these Regulations shall be dealt with in accordance with the principal
Regulations as amended by these Regulations.
Any order, letter of administration, decision, determination, direction, certification, appointment, reference, action and notice in relation to the distribution of a small estate made, done or issued by the
Land
Administrator under the principal Regulations before the date of coming into operation of these
Regulations, shall be deemed to be made, done or issued by the Estate Distribution Officer and continue to be in force.
Any appeal to any order, decision or act made or done under regulation 10
of the principal Regulations before the date of coming into operation of these Regulations shall, after the date of coming into operation of these Regulations, be continued as if regulation 10 of the principal Regulations has not been amended by these
Regulations.
