PADA menjalankan kuasa yang diberikan oleh perenggan 3(2)(c) dan (e) Akta Pemeliharaan Keselamatan Awam (Sabah)1962
[Akta 843], Menteri membuat peraturan-peraturan yang berikut: Nama dan permulaan kuat kuasa

Seksyen 1

(1)

Peraturan-peraturan ini bolehlah dinamakan Peraturan-Peraturan

Pemeliharaan Keselamatan Awam (Pindaan) 2024.

(2)

Peraturan-Peraturan ini mula berkuat kuasa pada 1 Mac 2024.

Seksyen 2

Peraturan-Peraturan Pemeliharaan Keselamatan Awam 2013 [P.U. (A) 103/2013], yang disebut “Peraturan-Peraturan ibu” dalam Peraturan-Peraturan ini, dipinda dalam tajuk dengan memasukkan selepas perkataan “KESELAMATAN AWAM” perkataan

“(SABAH)”.

Peraturan 1 Peraturan-Peraturan ibu dipinda dengan memasukkan selepas perkataan “Keselamatan Awam” perkataan “(Sabah)”.

dengan kepala “JAWATANKUASA BERSAMA ZON SELAMAT SABAH TIMUR”.

Pindaan peraturan 5

Seksyen 6

Peraturan-Peraturan ibu dipinda dengan menggantikan peraturan 5 dengan peraturan yang berikut:

“Penubuhan Jawatankuasa Bersama Zon Selamat Sabah Timur 5.

(1)

Bagi maksud pemeliharaan keselamatan awam, suatu jawatankuasa yang dinamakan “Jawatankuasa Bersama Zon Selamat Sabah Timur” ditubuhkan.

(2)

Jawatankuasa Bersama Zon Selamat Sabah Timur hendaklah terdiri daripada anggota yang berikut:

(a)

Menteri;

(b)

Ketua Menteri Sabah; dan

(c)

tidak kurang daripada lima orang anggota lain yang akan dilantik oleh Menteri selepas berunding dengan

Ketua Menteri Sabah.

Sabah hendaklah menjadi

Pengerusi Bersama Jawatankuasa Bersama Zon Selamat Sabah Timur.

Menteri dan Ketua Menteri Sabah hendaklah bertanggungjawab bagi—

(a)

penyelarasan dan pelaksanaan fungsi dan aktiviti

Jawatankuasa Bersama Zon Selamat Sabah Timur;

(b)

pentadbiran dan pengurusan hal ehwal Jawatankuasa

Bersama Zon Selamat Sabah Timur; dan

(c)

perintah dan arahan kawalan operasi di Kawasan Timur

Sabah.

PRESERVATION OF PUBLIC SECURITY (SABAH) ACT 1962

PRESERVATION OF PUBLIC SECURITY (AMENDMENT) REGULATIONS 2024

Opening note

Preamble

IN exercise of the powers conferred by paragraphs 3(2)(c) and (e) of the Preservation of Public Security (Sabah) Act 1962 [Act 843], the Minister makes the following regulations: Citation and commencement 1.

(1)

These regulations may be cited as the Preservation of Public Security

(Amendment) Regulations 2024.

(2)

These Regulations come into operation on 1 March 2024.

Amendment of title 2.

The Preservation of Public Security Regulations 2013 [P.U. (A) 103/2013], which are referred to as the “principal Regulations” in these Regulations, are amended in the title by inserting after the words “PUBLIC SECURITY” the word “(SABAH)”.

Amendment of regulation 1 3.

Regulation 1 of principal Regulations is amended by inserting after the words

“Public Security” the word “(Sabah)”.

Amendment of regulation 4 4.

Regulation 4 of the principal Regulations is amended—

(a)

by substituting for the full stop at the end of the definition of “Minister”

a semi colon; and

(b)

by inserting after the definition of “Minister” the following definition:

‘ “operation” means any security operational activity, intelligence, defence and enforcement conducted in the Eastern Area.’.

Amendment of Part II

Seksyen 5

Part II of the principal Regulations is amended by substituting for the heading of “EASTERN SABAH SAFETY ZONE COMMITTEE AND OVERSIGHT COMMITTEE”

the heading of “EASTERN SABAH SAFETY ZONE JOINT COMMITTEE”.

Amendment of regulation 5 6.

The principal Regulations are amended by substituting for regulation 5

the following regulation:

“Establishment of Eastern Sabah Safety Zone Joint Committee 5.

(1)

For the purposes of preservation of the public security, a committee by the name of “Eastern Sabah Safety Zone Joint Committee” is established.

(2)

The Eastern Sabah Safety Zone Joint Committee shall consist of the following members:

(a)

the Minister;

(b)

the Chief Minister of Sabah; and

(c)

not less than five other members to be appointed by the Minister after consultation with the Chief Minister of Sabah.

(3)

The Minister and the Chief Minister of Sabah shall be the Co-Chairmen of the Eastern Sabah Safety Zone Joint Committee.

(4)

The Minister and the Chief Minister of Sabah shall be responsible for—

(a)

the coordination and implementation of functions and activities of the Eastern Sabah Safety Zone Joint Committee;

(b)

the administration and management of affairs of the Eastern Sabah Safety Zone Joint Committee; and

(c)

the command and direction of control of operation in the Eastern Area of Sabah.

(5)

The Eastern Sabah Safety Zone Joint Committee may establish any committee as the Eastern Sabah Safety Zone Joint Committee thinks necessary or expedient to assist the Eastern Sabah Safety Zone Joint Committee.

(6)

The Eastern Sabah Safety Zone Joint Committee and the committee established under subregulation (5) may determine its own procedures.”.

Amendment of regulation 5A

Seksyen 7

Regulation 5A of the principal Regulations is amended—

(a)

in the shoulder note, by substituting for the words “command and control of security and intelligence operations” the words “command and control of operation”; and

(b)

by substituting for the words “command and control of security and intelligence operations”

wherever appearing the words

“command and control of operation”.

Deletion of regulation 6 8.

The principal Regulations are amended by deleting regulation 6.

Deletion of regulation 7 9.

The principal Regulations are amended by deleting regulation 7.

Amendment of regulation 18 10.

Regulation 18 of the principal Regulations is amended by deleting the words

“as directed by the Oversight Committee”.

Deletion of regulation 18A

Seksyen 11

The principal Regulations are amended by deleting regulation 18A.
