No motor vehicle including an electric motor vehicle shall be constructed without a prior vehicle type approval from the Director General consisting of built specifications, design and suitability of the motor vehicle to be used safely on and off the road.

The construction process of the motor vehicle shall be in accordance with the specifications in the Third Schedule and other conditions which may be determined by the Director General.

Notwithstanding subrule (1), in the case of any commercial vehicle, or any other types or categories or classes of motor vehicle as may be determined by the Director General, the motor vehicle shall be constructed in accordance to an approved technical plan of the motor vehicle.

The technical plan as referred to in subrule (3) shall consist of—

(a)

isometric view, front view, left and right view, top view and cross section view of the motor vehicle with appropriate scale of drawing in relation to the actual dimension of the motor vehicle;

information of laden weight, unladen weight, consultant company, owner of the technical plan and the title of technical plan; and

(c)

endorsement by professional engineer and the vehicle manufacturer.

The Director General may, subject to any condition which may be determined, grant the approval of the technical plan and issue a certificate of approval on

the technical plan upon payment of a prescribed fee in the

Fourth Schedule.”.

a bus with the overall length of which exceeds 13.5 metres but does not exceed 15 metres;

In determining the overall height of the motor vehicles, the motor vehicles shall be in the following conditions:

(a)

the tyres of the vehicle are properly inflated for the use to which it is being installed on the vehicle;

the motor vehicle is at its unladen weight; and

(c)

the surface of the ground under the vehicle is reasonable flat.

Every motor vehicle as determined by the Director General shall be fitted with an instrument or apparatus capable of giving audible and sufficient warning of any reverse movement.

Every motor vehicle, except trailer and semi-trailer, shall be fitted with a horn.

The sound emitted by any horn shall be continuous and uniform and not strident.

The horn fitted to the motor vehicle manufactured on or after 1 January 2015 shall conform to the specification of United Nations Regulation No. 28

No motor vehicle shall be fitted with siren or any device produce multiple-tone horn except for—

(a)

motor vehicles used solely by the

Road Transport Department;

Royal Malaysia Customs Department for the purpose of only executing its investigation and enforcement functions and powers conferred by any written law under its purview and responsibility;

Notwithstanding subrule (5), the Director

General may approved in writing the use of siren or any device produce multiple-tone horn for a motor vehicle formed primarily for the purpose of fire rescue, transport of sick or injured people and having special equipment for such purpose, and executing investigation and enforcement functions conferred by any written law.”.

No motor vehicle shall be fitted with special warning lamp or similar device except for motor vehicles specified in the Sixth Schedule.

The rear overhang of a rigid motor vehicle shall not exceed 50 per cent of the wheelbase as specified in the Eighth Schedule.

Notwithstanding subrule (1), the Minister may, upon recommendation by the Director General,

authorize the use of a motor vehicle with the rear overhang of which exceeds 50 per cent of the wheelbase but does not exceed 70 per cent.

The rear overhang of a bus shall not exceed 2/3 of the wheelbase.

For the purposes of this rule,

“wheelbase” means—

(a)

in the case of a rigid motor vehicle including bus, the distance between the centre lines of the first axle and the last single axle or centre line of rear tandem axle; or

in the case of an articulated motor vehicle, it shall be the distance between the centre lines of the foremost axle of motor vehicle and the centre lines of the rearmost axle of motor vehicle.”.

Any installation of electrical equipment or its component in a motor vehicle shall be—

designed so as to be suitable for the purpose intended for its use, without posing hazards, risks to safety and health of person;

maintained in good and working order and safety precautions shall be observed at all times to prevent the risk of electric shock or the outbreak of fire.”.

(a)

the space in which the appliances are installed is ventilated to ensure safe and effective operation;

the installation of the appliances does not cause any hazard to the vehicle or to the contents of the vehicle;

the motor vehicle shall carry at least one portable dry powder fire extinguisher that complies with Malaysia Standard

1539:

All goods carried on a motorcycle shall be carried inside a container, carrier or pannier and should be placed such that the weight is evenly distributed and prevented from shifting as far as possible.

Any motorcycle fitted with container, carrier or pannier shall comply with the following requirements:

(a)

every container, carrier or pannier shall be securely fitted or mounted onto a motorcycle without sharp protrusions and fitted or mounted in

such manner that it does not cause imbalance or adversely affect the control of the vehicle on the road;

every container, carrier or pannier shall be positioned symmetrically along the longitudinal axis of the motorcycle as near to the centre of the motorcycle as possible;

its rear overhang does not exceed 40 per cent of the length between the front and rear wheel centres;

any installation of a container, carrier or pannier on the seat of the rider shall not exceed a height of 650

milimetres measured from the level of the seat of the rider and the size shall not exceed 650 milimetres in height, 600 milimetres in width and 650 milimetres in length; and

any installation of a container, carrier or pannier on either side of a motorcycle shall not exceed the height of the seat of the rider and the extreme outer portion of the motorcycle.”.

  1. IN exercise of the powers conferred by section 66 of the Road Transport Act 1987 [Act 333], the Minister makes the following rules: Citation 1. These rules may be cited as the Motor Vehicles (Construction and Use) (Amendment) Rules 2024. Amendment of rule 2 2. The Motor Vehicles (Construction and Use) Rules 1959 [L.N. 170/1959], which are referred to as the “principal Rules” in these Rules are amended in rule 2—

(a)

by inserting before the definition of “articulated vehicle” the following definitions:

‘ “ABS” means antilock brake system which senses wheel slip and automatically modulates the pressure producing the braking forces at the wheels to limit the degree of wheel slip;

“articulated bus” means a bus which is so constructed—

with two or more rigid sections connected by an articulated joint relative to one another;

‘ “mobile machinery” means a motor vehicle which are designed as self-contained machines, with pneumatic tyre of any axle configuration is propelled by its own engine or electric motor, rather than propelled by other motor vehicle, it was designed and constructed not for carrying passengers or goods;’;

‘ “overall height” means the vertical distance between the supporting surface and a horizontal plane touching the topmost part of a motor vehicle, but not including the aerials and the current collection devices in their elevated position;’;

‘ “rigid motor vehicle” means a motor vehicle which is constructed for the purpose of carrying the payload on its own axles with the load compartment and not an articulated motor vehicle;’; and

‘ “special warning lamp” means a lamp, fitted on a motor vehicle, capable of emitting a blue, red or amber flashing light to alert surrounding vehicles and pedestrians, and not a direction indicator, stop lamp, pass lamp or reflector;’.

Amendment of rule 8 3.

The principal Rules are amended in rule 8 by substituting for the words “Director

General” the word “Minister”.

(1)

No motor vehicle including an electric motor vehicle shall be constructed without a prior vehicle type approval from the Director General consisting of built specifications, design and suitability of the motor vehicle to be used safely on and off the road.

The construction process of the motor vehicle shall be in accordance with the specifications in the Third Schedule and other conditions which may be determined by the Director General.

Notwithstanding subrule (1), in the case of any commercial vehicle, or any other types or categories or classes of motor vehicle case as may be determined by the Director General, the motor vehicle shall be constructed in accordance to an approved technical plan of the motor vehicle.

The technical plan as referred to in subrule (3) shall consist of—

(a)

isometric view, front view, left and right view, top view and cross section view of the motor vehicle with appropriate scale of drawing in relation to the actual dimension of the motor vehicle;

information of laden weight, unladen weight, consultant company, owner of the technical plan and the title of technical plan; and

(c)

endorsement by professional engineer and the vehicle manufacturer.

The Director General may, subject to any condition which may be determined, grant the approval of

the technical plan and issue a certificate of approval on the technical plan upon payment of a prescribed fee in the

Fourth Schedule.”.

Amendment of rule 9B

the following paragraph:

Every motorcycle, powered by an internal combustion engine with capacity equal or greater than 150 cc or powered by an electric motor having net power output of greater than 13 kW, shall be fitted with an ABS.

shall be limited to the motorcycle which its vehicle type approval has been obtained from the Director General on or after 1 January 2025.

Every motor vehicle as determined by the Director General shall be fitted with an instrument or apparatus capable of giving audible and sufficient warning of any reverse movement.

The sound emitted by any horn shall be continuous and uniform and not strident.

No motor vehicle shall be fitted with special warning lamp or similar device except for motor vehicles specified in the Sixth Schedule.
