Preamble

PADA menjalankan kuasa yang diberikan oleh seksyen 20 Akta Pelindung 2006 [Akta 657] dan peraturan 10 Peraturan-Peraturan Pelindung 2007 [P.U. (A) 386/07], Kerajaan telah membuat penentuan awal negatif dalam hal penyiasatan mengenai pengimportan produk-produk yang disiasat (“produk-produk tersebut”) ke dalam Malaysia. Perihalan lengkap keluaran yang disiasat dan pengelasan tarif

Seksyen 1

Produk-produk tersebut adalah seperti yang berikut:

(a)

produk gelungan rata daripada besi atau keluli bukan aloi yang digelung panas, tidak disalut, disadur atau dilapis, dalam gelungan;

(b)

produk gelungan rata daripada besi atau keluli bukan aloi yang digelung panas, tidak disalut, disadur atau dilapis, dalam gelungan, dengan corak sebagai ganti; dan

(c)

produk gelungan rata daripada besi atau keluli bukan aloi yang digelung panas, tidak disalut, disadur atau dilapis, dalam gelungan, dijeruk.

Seksyen 3

Perihalan produk serupa atau bersaing secara langsung ialah serupa dengan perihalan yang dinyatakan dalam perenggan 1 dan 2 yang dikeluarkan oleh industri dalam negeri.

Seksyen 4

Sebab bagi penentuan awal negatif

Berdasarkan penyiasatan, Pihak Berkuasa Penyiasat mendapati terdapat kenaikan secara mutlak import produk-produk tersebut semasa tempoh penentuan kemudaratan iaitu dari 1 Januari 2010 sehingga 30 September 2010. Walau bagaimanapun, setelah meneliti kesan ke atas syer pasaran, jualan, produksi, produktiviti, penggunaan kapasiti dan untung dan rugi, Pihak Berkuasa Penyiasat telah membuat kesimpulan bahawa kenaikan import tidak menyebabkan dan mengancam untuk menyebabkan kemudaratan yang serius kepada industri dalam negeri yang mengeluarkan keluaran serupa atau keluaran yang bersaing secara langsung.

Berdasarkan sebab-sebab yang dinyatakan di perenggan 4 Notis ini, Kerajaan dengan ini menamatkan penyiasatan bermula dari tarikh penyiaran Notis ini.

NOTICE OF NEGATIVE PRELIMINARY DETERMINATION WITH REGARD TO THE

INVESTIGATION ON HOT ROLLED COILS IMPORTED INTO MALAYSIA

Opening note

Preamble

IN exercise of the powers conferred by section 20 of the Safeguards Act [Act 657] and regulation 10 of the Safeguards Regulations 2007 [P.U. (A) 386/07], the Government has made a negative preliminary determination with regard to the investigation concerning the importation of the following products (“the products”) into Malaysia. A complete description of the products under investigation and tariff classification 1. The products are as follows:

(a)

flat-rolled products of iron or non-alloy steel, hot rolled, not clad, plated or coated, in coils;

(b)

flat-rolled products of iron or non-alloy steel, hot rolled, not clad, plated or coated, in coils, with patterns in relief; and

(c)

flat-rolled products of iron or non-alloy steel, hot rolled, not clad, plated or coated, in coils, pickled.

A complete description of like products or directly competitive products 3.

The description of like products or directly competitive products is the same as in the description stated in paragraphs 1 and 2 which are produced by the domestic industry.

Reasons for negative preliminary determination 4.

Based on the investigation, the Investigating Authority found that there was an increase in imports of the products in absolute terms during the period of injury determination i.e. from 1 January 2010 to 30 September 2010. However, having examined the effects on market share, sales, production, productivity, capacity utilisation and profit and loss, the Investigating Authority has reached a conclusion that the increased imports have not caused and are not threatening to cause serious injury to the domestic industry that produces like or directly competitive products.

The investigation 5.

Based on the reasons mentioned in paragraph 4 of this Notice, the Government hereby terminate the investigation commencing from the date of publication of this

Notice.
