Opening note

Preamble

BAHAWASANYA, melalui P.U. (B) 560/1991 yang disiarkan dalam Warta Kerajaan Persekutuan pada 17 Oktober 1991, pada menjalankan kuasa di bawah subseksyen 62(1) Kanun Tanah Negara [Akta 56/1965] sebagaimana yang diubahsuaikan oleh Perintah Wilayah Persekutuan (Pengubahsuaian Kanun Tanah Negara) 1974 [P.U. (A) 56/1974], yang diberikan kepada Kerajaan Persekutuan dan diwakilkan kepadanya melalui Pemberitahuan yang disiarkan dalam P.U. (B) 108/2003 pada 3 Mac 2003, Jawatankuasa Kerja Tanah Wilayah Persekutuan Kuala Lumpur telah mengisytiharkan bahawa petak tanah iaitu No. Lot 39, yang terletak di dalam seksyen 60 Bandar Kuala Lumpur, seluas 1580 meter persegi yang ditandakan di atas No. Pelan P.A. 100078, menjadi suatu rizab bagi maksud awam, iaitu, suatu tapak untuk surau dan telah menetapkan bahawa Yang Di Pertua Majlis Agama Islam Wilayah Persekutuan hendaklah mempunyai kawalan terhadap tanah rizab itu: DAN BAHAWASANYA, melalui P.U. (B) 108/2003 yang disiarkan dalam Warta Kerajaan Persekutuan pada 3 Mac 2003, Kerajaan Persekutuan telah mewakilkan penjalanan kuasanya di bawah seksyen 64 Kanun Tanah Negara kepada Jawatankuasa Kerja Tanah Wilayah Persekutuan Kuala Lumpur: DAN BAHAWASANYA, adalah didapati suai manfaat sekarang oleh Jawatankuasa Kerja Tanah Wilayah Persekutuan Kuala Lumpur supaya keseluruhan perizaban yang disebut terdahulu itu dibatalkan: MAKA OLEH YANG DEMIKIAN, Jawatankuasa Kerja Tanah Wilayah Persekutuan Kuala Lumpur, pada menjalankan kuasa di bawah subseksyen 64(1) Kanun Tanah Negara yang diberikan kepada Kerajaan Persekutuan dan diwakilkan kepadanya, memberikan notis di bawah subseksyen 64(2) Kanun Tanah Negara mengenai cadangan untuk membatalkan keseluruhan perizaban yang disebut terdahulu itu sebagaimana yang diperihalkan dalam Jadual dan bahawa mana-mana orang yang P.U. (B) 98 3 berhasrat untuk membantah terhadap pembatalan itu akan didengar oleh Pentadbir Tanah Wilayah Persekutuan Kuala Lumpur dalam suatu siasatan yang akan diadakan di Pejabat Pengarah Tanah dan Galian Wilayah Persekutuan Kuala Lumpur, Tingkat 2, 3 dan 4, Rumah Persekutuan, Jalan Sultan Hishamuddin, Kuala Lumpur pada pukul 10.00 pagi pada 16 April 2012.

NATIONAL LAND CODE

NOTICE OF PROPOSED REVOCATION OF RESERVATION OF LAND FOR PUBLIC

PURPOSE

WHEREAS, by P.U. (B) 560/1991 published in the Gazette of the Government of the

Federation on 17 October 1991, in exercise of the powers under subsection 62(1) of the

National Land Code [Act 56/1965] as modified by the Federal Territory (Modification of

National Land Code) Order 1974 [P.U. (A) 56/1974], conferred upon the Government of the Federation and delegated to it by Notification published in P.U. (B) 108/2003 on 3 March 2003, the Land Executive Committee of the Federal Territory of Kuala Lumpur has proclaimed that the parcel of land being Lot No. 39, situated in section 60 Town of

Kuala Lumpur, having an area of 1580 square metres delineated upon Plan No.

P.A. 100078, to be a reserve for a public purpose, to wit, a site for a surau and has designated that the Yang di Pertua Majlis Agama Islam Wilayah Persekutuan shall have control of the reserved land:

AND WHEREAS, by P.U. (B) 108/2003 published in the Gazette of the Government of the Federation on 3 March 2003, the Government of the Federation has delegated the exercise of its powers under section 64 of the National Land Code to the Land Executive

Committee of the Federal Territory of Kuala Lumpur:

AND WHEREAS, it now appears expedient to the Land Executive Committee of the

Federal Territory of Kuala Lumpur that the whole of the aforesaid reservation be revoked:

NOW THEREFORE, the Land Executive Committee of the Federal Territory of

Kuala Lumpur, in exercise of the powers under subsection 64(1) of the National Land

Code conferred upon the Government of the Federation and delegated to it, gives notice under subsection 64(2) of the National Land Code of the proposal to revoke the whole of the aforesaid reservation as described in the Schedule and that any person who desires to object against such revocation will be heard by the Land

Administrator of the Federal Territory of Kuala Lumpur at an enquiry to be held at

the Office of Director of Lands and Mines of the Federal Territory of Kuala Lumpur,

2nd, 3rd and 4th Floor, Federal House, Jalan Sultan Hishamuddin, Kuala Lumpur at 10.00 a.m on 16 April 2012.
