NOTIS PEMULAAN KAJIAN SEMULA DIPERCEPAT DUTI ANTI-LAMBAKAN MENGENAI IMPORT ELECTROLYTIC TINPLATE YANG BERASAL ATAU DIEKSPORT DARI NOVOWELL ETP LIMITED DARI REPUBLIK RAKYAT CHINA

Duti yang berkuat kuasa pada masa ini ke atas dagangan subjek ialah duti anti-lambakan definitif yang dikenakan oleh Perintah Kastam (Duti Anti-Lambakan)

(No. 3) 2013 [P.U. (A) 339/2013].

Tiada duti anti-lambakan boleh dikenakan ke atas dagangan subjek yang berasal atau dieksport dari Novowell ETP Limited dari Republik Rakyat China semasa kajian semula sedang dijalankan.

Alasan bagi Kajian Semula

Permintaan adalah berdasarkan alasan bahawa pengeluar tidak mengeksportkan dagangan subjek ke Malaysia sepanjang tempoh penyiasatan dan pengeluar itu tidak ada kaitan dengan mana-mana pengeksport atau pengeluar di negara pengeksport yang tertakluk kepada duti anti-lambakan atas dagangan subjek.

Kerajaan berpuas hati bahawa permintaan itu mengandungi alasan yang mencukupi bagi memulakan suatu kajian semula.

Dalam membuat keputusan ini, Kerajaan juga telah meneliti syarat-syarat bagi memulakan kajian semula menurut subseksyen 28B(1) Akta.

Tatacara

Setelah menentukan bahawa keterangan yang mencukupi wujud untuk mewajarkan suatu kajian semula dipercepat mengenai import electrolytic tinplate yang berasal atau dieksport dari Novowell ETP Limited dari Republik Rakyat China, Kerajaan memulakan kajian semula dipercepat menurut subseksyen 28B(1) Akta.

Penyiasatan akan menentukan kadar duti anti-lambakan individu bagi

Novowell ETP Limited dari Republik Rakyat China.

Senarai Soalan

Bagi mendapatkan maklumat yang disifatkan perlu bagi kajian semulanya,

Kerajaan akan menghantar senarai soalan kepada industri Malaysia dan mana-mana persatuan pengeluar di Malaysia dan kepada pengimport.

Dalam apa-apa keadaan pun, semua pihak berkepentingan yang tidak dihubungi oleh Kementerian Perdagangan Antarabangsa dan Industri (MITI) diminta untuk menghubungi MITI secara bertulis bagi mengetahui sama ada mereka disenaraikan dalam permintaan. Jika perlu, pihak berkepentingan itu boleh memohon satu salinan senarai soalan dengan memberitahu sifat aktiviti perniagaan mereka yang berkaitan dengan kajian semula ini.

Pengumpulan Maklumat

Mana-mana pihak berkepentingan yang memohon senarai soalan hendaklah berbuat demikian tidak lewat daripada 15 hari selepas penyiaran notis ini dalam Warta.

Semua pihak berkepentingan mestilah mengemukakan pandangan mereka secara bertulis dan mengemukakan jawapan kepada senarai soalan dalam masa 30 hari dari tarikh penyiaran notis ini jika pandangan dan maklumat itu hendak diambil kira semasa penyiasatan, kecuali dinyatakan sebaliknya.

NOTICE OF INITIATION OF EXPEDITED REVIEW OF THE ANTI-DUMPING DUTIES WITH

RESPECT TO THE IMPORTS OF ELECTROLYTIC TINPLATE ORIGINATING IN OR

EXPORTED FROM NOVOWELL ETP LIMITED FROM THE PEOPLE’S REPUBLIC OF CHINA

FOLLOWING the publication of a Notice of Affirmative Final Determination of An

Anti-Dumping Duty Investigation with respect to the Imports of Electrolytic Tinplate which is classified under the Harmonised System Code (H.S. Code) Number 7210.12.200

originating in or exported from the People’s Republic of China and the Republic of Korea on 15 November 2013 [P.U. (B) 466/2013], the Government of Malaysia has received a request for expedited review pursuant to subsection 28B(1) of the Countervailing and

Anti-Dumping Duties Act 1993 [Act 504].

Request for Review 1.

The request was lodged by—

Novowell ETP Limited

Xinyuan Light Industry Science and Technology Zone

Daduo Town, Xinghua City

Jiangsu Province China, the producer of electrolytic tinplate from the People’s Republic of China.

Product 2.

The subject merchandise under review is the electrolytic tinplate which is classified under Harmonized System Code (H. S. Code) Number 7210.12.

Code Number is given only for information but have no binding effect on the classification of the subject merchandise.

Existing Anti-Dumping Duties 3.

The duties currently in force on the subject merchandise are definitive anti-dumping duties imposed by Customs (Anti-Dumping Duties) (No. 3) Order 2013

[P.U. (A) 339/2013].

No anti-dumping duty shall be imposed on the subject merchandise originating in or exported from Novowell ETP Limited from the People’s Republic of China while the review is being carried out.

Grounds for the Review 4.

The request is based on the grounds that the producer has not exported the subject merchandise to Malaysia during the period of investigation and that the producer is not related to any of the exporters or producers in the exporting country who are subject to the anti-dumping duties on the subject matter merchandise.

The Government is satisfied that the request carries sufficient grounds to initiate a review.

In coming to this decision, the Government has also examined the conditions to initiate the review pursuant to subsection 28B(1) of the Act.

Procedure 5.

Having determined that sufficient evidence exists to warrant an expedited review with regard to imports of electrolytic tinplate originating in or exported from

Novowell ETP Limited from the People’s Republic of China, the Government initiates an expedited review pursuant to subsection 28B(1) of the Act.

The investigation will establish an individual anti-dumping duty rate for

Novowell ETP Limited from the People’s Republic of China.

Questionnaires 6.

In order to obtain information deemed necessary for its review, the Government will send questionnaires to the Malaysian industry and to any association of producers in Malaysia and to the importers.

In any event, all interested parties not contacted by the Ministry of

International Trade and Industry (MITI) are invited to contact MITI in writing in order to find out whether they are listed in the request. If necessary, such interested parties may request for a copy of the questionnaire by identifying the nature of their business activities in relation to this review.

Collection of Information 7.

All interested parties are invited to make their views known in writing, in particular by replying to the questionnaires addressed to them and by providing supporting evidence.

Time Limit 8.

Any interested party requesting for a questionnaire shall do so not later than 15 days after the publication of this notice in the Gazette.

All interested parties must present their views in writing and submit questionnaire responses within 30 days of the date of publication of this notice if such views and submissions are to be taken into consideration during the investigation, unless otherwise specified.

If the interested parties do not provide the necessary information or the information and views are not received in adequate form within the specified time limit, the Government may make determination on the basis of the facts available in accordance with section 41 of the Act.
