Opening note

Preamble

BAHAWASANYA, melalui P.U. (B) 344/2005 yang disiarkan dalam Warta Kerajaan Persekutuan pada 24 November 2005, pada menjalankan kuasa yang diberikan oleh subseksyen 62(1) Kanun Tanah Negara [Akta 56/1965] sebagaimana yang diubahsuaikan oleh Perintah Wilayah Persekutuan (Pengubahsuaian Kanun Tanah Negara) 1974 [P.U. (A) 56/1974], yang diberikan kepada Kerajaan Persekutuan dan yang diwakilkan kepadanya, Jawatankuasa Kerja Tanah Wilayah Persekutuan Kuala Lumpur telah merizabkan tanah yang diperihalkan dalam Jadual bagi maksud awam, iaitu suatu tapak untuk kawasan lapang dan padang bola dan telah menetapkan bahawa Ketua Setiausaha Negara hendaklah mempunyai kawalan terhadap tanah rizab itu: DAN BAHAWASANYA, melalui P.U. (B) 108/2003 yang disiarkan dalam Warta Kerajaan Persekutuan pada 3 Mac 2003, Kerajaan Persekutuan telah mewakilkan penjalanan kuasanya di bawah seksyen 64 Kanun Tanah Negara kepada Jawatankuasa Kerja Tanah Wilayah Persekutuan Kuala Lumpur: DAN BAHAWASANYA, didapati suai manfaat sekarang oleh Jawatankuasa Kerja Tanah Wilayah Persekutuan Kuala Lumpur supaya keseluruhan perizaban yang disebut terdahulu itu dibatalkan: DAN BAHAWASANYA, notis mengenai cadangan untuk membatalkan keseluruhan perizaban yang disebut terdahulu itu yang diperihalkan dalam Jadual bersama dengan butir-butir mengenai masa dan tempat di mana suatu siasatan akan diadakan oleh Pentadbir Tanah Wilayah Persekutuan Kuala Lumpur di Pejabat Pengarah Tanah dan Galian Wilayah Persekutuan Kuala Lumpur, untuk mendengar mana-mana orang yang berhasrat untuk membantah terhadap pembatalan itu telah ditampalkan mengikut seksyen 433 Kanun Tanah Negara dan juga telah disiarkan dalam Warta Kerajaan Persekutuan sebagai P.U. (B) 417/2016 pada 21 September 2016: P.U. (B) 10 3 DAN BAHAWASANYA, tiada apa-apa bantahan diterima terhadap cadangan untuk membatalkan keseluruhan perizaban yang disebut terdahulu itu yang diperihalkan dalam Jadual: MAKA OLEH YANG DEMIKIAN, Jawatankuasa Kerja Tanah Wilayah Persekutuan Kuala Lumpur, pada menjalankan kuasa di bawah seksyen 64 Kanun Tanah Negara yang diberikan kepada Kerajaan Persekutuan dan diwakilkan kepadanya sebagaimana yang disebut terdahulu, membatalkan perizaban tanah yang diperihalkan dalam Jadual:

NATIONAL LAND CODE

REVOCATION OF RESERVATION OF LAND FOR PUBLIC PURPOSE

WHEREAS, by P.U. (B) 344/2005 published in the Gazette of the Government of the

Federation on 24 November 2005, in exercise of the powers conferred by subsection 62(1)

of the National Land Code [Act 56/1965] as modified by the Federal Territory

(Modification of National Land Code) Order 1974 [P.U. (A) 56/1974], conferred upon the Government of the Federation and delegated to it, the Land Executive Committee of the

Federal Territory of Kuala Lumpur has reserved the land described in the Schedule for a public purpose, to wit a site for open space and football field and has designated that the

Chief Secretary to the Government of Malaysia shall have control of the reserved land:

AND WHEREAS, by P.U. (B) 108/2003 published in the Gazette of the Government of the Federation on 3 March 2003, the Government of the Federation has delegated the exercise of its powers under section 64 of the National Land Code to the Land Executive

Committee of the Federal Territory of Kuala Lumpur:

AND WHEREAS, it now appears expedient to the Land Executive Committee of the

Federal Territory of Kuala Lumpur that the whole of the aforesaid reservation be revoked:

AND WHEREAS, notice of the proposal to revoke the whole of the aforesaid reservation as described in the Schedule together with details of the time and place at which an enquiry would be held by the Land Administrator of the Federal Territory of

Kuala Lumpur at the Office of Director of Lands and Mines of the Federal Territory of Kuala

Lumpur, to hear any person desiring to object to such revocation was affixed in accordance with section 433 of the National Land Code and was also published in the Gazette of the

Government of the Federation as P.U. (B) 417/2016 on 21 September 2016:

AND WHEREAS, no objection to the proposal to revoke the whole of the aforesaid reservation as described in the Schedule was received:

NOW THEREFORE, the Land Executive Committee of the Federal Territory of Kuala

Lumpur, in exercise of the powers under section 64 of the National Land Code conferred upon the Government of the Federation and delegated to it as aforesaid, revokes the reservation of the land described in the Schedule:
