Opening note

Preamble

PADA menjalankan kuasa yang diberikan oleh subseksyen 2A(2) Akta Pemberi Pinjam Wang 1951 [Akta 400], Menteri mengecualikan Actius Terra Global Holdings Sdn. Bhd. daripada semua peruntukan Akta bagi tempoh dua puluh tahun berkuat kuasa mulai 15 Disember 2017 dengan syarat bahawa—

(a)

faedah bagi pinjaman bercagarnya tidak boleh melebihi dua belas peratus setahun dan faedah bagi pinjaman tanpa cagarannya tidak boleh melebihi lapan belas peratus setahun; dan

(b)

Actius Terra Global Holdings Sdn. Bhd. hendaklah, tidak lewat dari 1 Februari setiap tahun, mengemukakan kepada Menteri suatu penyata rekod mengenai transaksi pemberian pinjaman wangnya dalam apa-apa bentuk dan mengandungi apa-apa maklumat sebagaimana yang ditentukan oleh Pendaftar.

EXEMPTION UNDER SUBSECTION 2A(2)

Opening note

Preamble

IN exercise of the powers conferred by subsection 2A(2) of the Moneylenders Act 1951 [Act 400], the Minister exempts Actius Terra Global Holdings Sdn. Bhd. from all of the provisions of the Act for a period of twenty years with effect from 15 December 2017 provided that—

(a)

the interest for its secured loan shall not exceed twelve per centum per annum and the interest for its unsecured loan shall not exceed eighteen per centum per annum; and

(b)

Actius Terra Global Holdings Sdn. Bhd. shall, not later than 1 February of each year, submit to the Minister a statement of records of its moneylending transactions in such form and containing such information as determined by the Registrar.
