This order may be cited as the Environmental Fees Order 2002 and shall come into force on the date of its publication in the Gazette. [13 February 2003]

Preamble
- In exercise of the powers conferred by Section 2 of the Fees Enactment 1981, the Yang di-Pertua Negeri hereby makes the following order: Citation and commencement
Section 2
It shall be charged or levied by the Director of the State Environmental Conservation
Department:
a.
for the registration and annual fee of the individual consultant or consultant firm mentioned in the First Column in Part I of the Schedule to undertake the environmental impacts assessment studies, the fees specified in the Second Column in the same Part of the Schedule; and b.
for processing the terms of the reference of the environmental impact assessment studies and environmental impact assessment report for those activities listed under the First Schedule of
Conservation of Environment (Prescribed Activities) Order 1999 or any amendment made in the future mentioned in the First Column in Part II of the Schedule, the fees specified in the
Second Column in the same Part of the Schedule; and c.
for selling of environment handbooks and guidelines mentioned in the First Column in Part III of the Schedule the fees, specified in the Second Column in the same Part of the Schedule.
Fees to be paid for registration, submission of terms of reference and environmental impact assessment reports 3.
(1)
Any individual or consultant firm who intends to submit to the Director any terms of reference of the environmental impact assessment study or environmental impact assessment report, shall register their name or firm by paying to the Director the registration and annual fee as specified in the Second Column in Part I of the Schedule.

(2)
No terms of reference of the environmental impact assessment study or environmental impact assessment report shall be processed or approved by the Director until such fees as mentioned in the Second Column in Part II of the Schedule are fully paid by the consultants or the project proponent.
Mode of payment 4.
(1)
All payments shall be made in cash, or by money order, postal order, cashier’s order, banker’s order or bank draft made payable to the Director of the State Department of
Environmental Conservation and crosses “Account Payee Only”.
(2)
Every payment received shall be accounted as money belonging to the State Government and an official receipt shall be issued for the payment as in Form A in the Schedule.
