Opening note

Preamble

In exercise of the powers conferred by section 2 of the Fees Enactment 1981 [Enactment No. 27 of 1981], the Yang di-Pertua Negeri makes the following order: Citation and commencement

Section 1

(1)

This order maybe cited as the Fees (Forest Reserves) Order 2009.

(2)

This Order is deemed to have come into operation on 8 October 2007.

Fees

Section 2

There shall be charged by the Forestry Department -

(a)

The fees prescribed in column (2) of the First Schedule for entrance into any of the Forest Reserves in Sabah in respect of the category of visitors as stated in column (1) of the First Schedule;

(b)

The fees prescribed in column (2) of the Second Schedule for the use of apparatus in any of the Forest Reserves in Sabah as stated in column (1) of the Second Schedule;

(c)

The fees prescribed in column (2) of the Third Schedule for the use of the services provided in any of the Forest Reserves in Sabah as stated in column (1) of the Third Schedule;

(d)

the fees prescribed in column (2) of the Fourth Schedule for special fee for

Rainforest Discovery Centre (RDC) in respect of the category of visitors and for the use of the services provided in the Kabili-Sepilok Forest Reserve in

Sabah as stated in column (1) of the Fourth Schedule;

(e)

the fees prescribed in column (2) of the Fifth Schedule for special fee for

Sandakan Rainforest Park (SRP) in respect of category of visitors and for the services provided in the Kebun Cina Forest Reserve in Sabah as stated in column (1) of the Fifth Schedule; and

(f)

the fees prescribed in column (3) of the Sixth Schedule for special fee for

Rental of Rest House and Dormitory in respect of category of visitors and for the use of the services provided in the Forest Research Centre, Sepilok in

Sabah as stated in column (1) and (2) in the Sixth Schedule.

Payment of fees

Section 3

(1)

The fees prescribed under this Order shall be paid to the Forestry

Department by persons to whom the facilities referred to in paragraph 2 are made available.

(2)

All fees prescribed under this Order shall be paid in full

Exemption

Section 4

The Director of Forestry Department may exempt any person, statutory body or government agency from paying any or all of the fees prescribed under this Order.
