DELEGATION OF POWERS UNDER SECTION 6

Opening note

Preamble

Pada menjalankan kuasa yang diberikan oleh seksyen 6 Akta Perhutanan Negara 1984 [Akta 313], yang diterima pakai oleh Enakmen Akta Perhutanan Negara 1984 (Pemakaian) 1985 [Enakmen Bil. 3 tahun 1985], Pihak Berkuasa Negeri mewakilkan penjalanan atau pelaksanaan apa-apa kuasa atau kewajipan di bawah Enakmen Akta Perhutanan Negara 1984 (Pemakaian) 1985 kepada Pengarah Perhutanan Negeri Perak berkenaan dengan perkara-perkara yang berikut:

(a)

membenarkan pengambilan hasil hutan dengan lesen kecil di bawah seksyen 28 bagi rotan (tidak melebihi tujuh puluh meter padu), buluh, buah-buahan dan hasil kecil hutan lain dari mana-mana—

(i)

hutan simpanan kekal; atau

(ii)

tanah Kerajaan yang berkeluasan kurang daripada 500 hektar; dan

(b)

membenarkan penjalanan aktiviti-aktiviti yang berikut dalam hutan simpanan kekal melalui permit penggunaan di bawah seksyen 33:

(i)

penyelidikan;

(ii)

pelajaran atau latihan;

(iii)

rekreasi;

(iv)

penggunaan sumber air kecuali pembinaan atau pengendalian empangan hidroelektrik;

(v)

penanaman sayur-sayuran dan tanaman foder;

(vi)

penubuhan loji penukaran; dan

(vii)

penubuhan infrastruktur pembalakan.

Opening note

Preamble

In exercise of the powers conferred by section 6 of the National Forestry Act 1984 [Act 313], as adopted by the National Forestry Act 1984 (Adoption Enactment 1985 [Enactment No. 3 of 1985], the State Authority delegates the exercise or performance of any power or duty National Forestry Act 1984 (Adoption) Enactment 1985 to the Perak State Director of Forestry in respect of the following matters:

(a)

to permit the taking of forest produce by minor licence under section 28 for rattan (not exceeding seventy cubic metres), bamboo, fruits and other minor forest produce from any—

(i)

permanent reserved forest; or

(ii)

State land with an area of less than 500 hectares: and

(b)

to permit the carrying out of the following activities in a permanent reserved forest by use permit under section 33:

(i)

research;

(ii)

education or training;

(iii)

recreation;

(iv)

use of water resources except for construction or operation of hydroelectric dams;

(v)

cultivation of vegetables and fodder crops;

(vi)

establishment of conversion plants; and

(vii)

establishment of logging infrastructures.
