Pada menjalankan kuasa-kuasa yang diberikan oleh seksyen 62 Kanun Tanah Negara (Akta 56 Tahun 1965), Pihak Berkuasa Negeri Pulau Pinang dengan ini telah merizabkan yang yang diperihakan dalam Jadual di bawah ini menjadi tanah rizab bagi maksud awam iyah sebagai tapak pasar awam dan telah menetapkan bahawa Setiausaha Kerajaan Negeri Pulau Pinang sebagai Pegawai Pengawal dan diselenggarakan oleh Majlis Perbandaran Seberang Perai seperti ditunjukkan dalam Pelan No. PW 712 yang disimpan di Pejabat Pengarah Ukur, Pulau Pinang mulai24 Julai 2002

In exercise of the powers conferred by section 62 of the National Land Code (Act 56 of 1965), the State Authority of Penang hereby reserves the land described in the Schedule below hereto to be a reserved land for public purposes i.e. public market and designated State Secretariat of Penang to be Controlling Officer and to be managed by Majlis Perbandaran Seberang Perai as shown in Plan No. PW 712 deposited in the office of Director of Survey, Penang with effect from 24th July 2002. ORDER FOR SALE AT INSTANCE OF THE CHARGEE

I, Haji Mohd. Saad bin Haji Sulaiman, Land Administrator in exercise of the powers conferred by section 263 of the National Land Code, hereby order the sale of the land/undivided state in the land/lease/sub-lease described in the Schedule below:

And I further order—

(a)

that the sale shall be by public auction, to be held on the 8th day of October 2002 at 10.00 a.m. at Pejabat Daerah and Tanah Seberang Perai Tengah, Jalan Betek, Sungai Rambai, Bukit Mertajam; and

(b)

that the reserve price for the purpose of the sale shall be RM90,000.00.

2. I find that the amount due to the chargee/chargees at this date is RM92,422.

44. Name of chargee—Standard Chartered Bank Bhd. (25-2-2002).

3. The sale shall be subject to the following conditions:

(a)

the bidder possesses, the sum equivalent to ten per centum of the reserve price specified under paragraph 1(b) above RM9,000.00;

(b)

the full amount of the purchase price may be paid immediately after the fall of the hammer by the successful bidder to the chargee;

(c)

where the full amount of the purchase price is not paid after the fall of the hammer by the successful bidder—

(i)

then the sum specified in paragraph (a) shall be paid to the chargee and it shall be retained as a deposit until the full purchase price has been paid; and

(ii)

pending the settlement of the balance of the purchase price, the sum specified in sub-paragraph (i) shall be credited into the account of the chargee for the purpose of reducing the amount due to the chargee;

(d)

the balance of the purchase price shall be settled within a date not later one hundred and twenty days from the date of the sale, that is, not later than the 6th day of February 2003 and there shall be no extension of the period so specified; and

(e)

where the full purchase price is not settled on or by the date specified in paragraph (d), the sum paid as deposit under paragraph (c) to the charge shall be forfeited and disposed of in the manner specified under section 267.
