PADA menjalankan kuasa yang diberikan oleh subseksyen 67(1) Akta Lembaga Pelabuhan Bintulu 1981 [Akta 243], Lembaga Pelabuhan Bintulu, dengan kelulusan Menteri, membuat undang-undang kecil yang berikut: Nama dan permulaan kuat kuasa

Undang-undang kecil ini bolehlah dinamakan Undang-Undang Kecil

Lembaga Pelabuhan Bintulu (Tender dan Kontrak) (Pembatalan) 2012.

(2)

Undang-Undang Kecil ini mula berkuat kuasa pada 15 Mei 2012.

Undang-Undang Kecil Lembaga Pelabuhan Bintulu (Tender dan Kontrak)

1982 [P.U. (A) 95/1982] dibatalkan (“Undang-Undang Kecil yang dibatalkan”).

Seksyen 3

Peruntukan kecualian

(1)

Semua tindakan, keputusan, kelulusan, tender atau kontrak yang dibuat, diberikan atau dilakukan di bawah Undang-Undang Kecil yang dibatalkan hendaklah terus berkuat kuasa dan mempunyai kesan sehingga dipinda atau dibatalkan.

(2)

Semua permohonan tender atau kelulusan yang belum diputuskan di bawah Undang-Undang Kecil yang dibatalkan hendaklah, pada tarikh Undang-Undang

Kecil ini berkuat kuasa, diuruskan oleh Lembaga Pelabuhan Bintulu seolah-olah permohonan atau kelulusan itu dibuat di bawah Undang-Undang Kecil yang dibatalkan.

BINTULU PORT AUTHORITY (TENDERS AND CONTRACTS)

(REVOCATION) BY-LAWS 2012

Opening note

Preamble

IN exercise of the powers conferred by subsection 67(1) of the Bintulu Port Authority Act 1981 [Act 243], the Bintulu Port Authority, with the approval of the Minister, makes the following by-laws: Citation and commencement 1.

(1)

These by-laws may be cited as the Bintulu Port Authority (Tenders and

Contracts) (Revocation) By-Laws 2012.

(2)

These By-Laws come into operation on 15 May 2012.

The

Contracts)

By-Laws 1982 [P.U. (A) 95/1982] are revoked (“the revoked By-Laws”).

Savings provision 3.

(1)

All actions, decisions, approvals, tenders or contracts made, given or done under the revoked By-Laws shall continue to be in force and have effect until amended or revoked.

(2)

All tender applications or approvals pending under the revoked By-Laws shall, on the date these By-Laws come into force, be dealt with by the Bintulu Port

Authority as if the applications or approvals have been made under the revoked

By-Laws.
