Keluaran yang disiasat ialah batang penulangan konkrit keluli, iaitu batang keluli gulungan panas yang mengandungi lekuk, tetulang, alur atau canggaan lain, yang dikelaskan di bawah Kod Sistem yang Diharmonikan (Kod H.S.) dan Tatanama Tarif Berharmonis ASEAN

Keluaran serupa atau keluaran yang bersaing secara langsung
Keluaran serupa atau keluaran yang bersaing secara langsung ialah keluaran yang dikeluarkan oleh industri dalam negeri dan mempunyai perihalan yang sama dengan keluaran yang dinyatakan dalam perenggan 1.

Sebab bagi penentuan muktamad afirmatif
Berdasarkan penyiasatan, pihak berkuasa penyiasat telah mendapati bahawa—
terdapat peningkatan import keluaran, secara mutlak dan relatif kepada pengeluaran dalam negeri semasa tempoh penentuan kemudaratan, iaitu mulai 1 Oktober 2012 hingga 30 September 2015; dan
dalam keadaan itu, ia telah menyebabkan kemudaratan yang serius kepada industri dalam negeri yang mengeluarkan keluaran serupa atau keluaran yang bersaing secara langsung berkenaan dengan penurunan bahagian pasaran, jualan dalam negeri dari segi nilai, keberuntungan, aliran tunai negatif, dan pengurangan dalam penggajian dan gaji pekerjanya.
Langkah pelindungan muktamad yang terpakai
Langkah pelindungan muktamad yang terpakai berhubung dengan keluaran hendaklah dalam bentuk duti pelindung muktamad dan dikenakan terhadap negara yang dinyatakan dalam Jadual.
Duti pelindung muktamad hendaklah dikenakan bagi tempoh tiga tahun mulai 14 April 2017 hingga 13 April 2020 pada kadar yang berikut:

NOTICE OF AFFIRMATIVE FINAL DETERMINATION OF AN INVESTIGATION WITH REGARD
TO STEEL CONCRETE REINFORCING BAR PRODUCTS IMPORTED INTO MALAYSIA

IN exercise of the powers conferred by subsection 23(3)
of the
Safeguards Act 2006 [Act 657] and regulation 14 of the Safeguards Regulations 2007
[P.U. (A) 386/2007], the Government has made an affirmative final determination in relation to the investigation with regard to the steel concrete reinforcing bar products imported into
Malaysia as described in paragraph 1 (“products”).
Products under investigation and tariff classification 1.
The products under investigation are steel concrete reinforcing bars that are hot rolled steel bars containing indentations, ribs, grooves or other deformation, classified under the
Harmonised System Code (H.S. Code) and ASEAN Harmonised Tariff Nomenclature (AHTN)
7214.10.11 00, 7214.10.19 00, 7214.10.21 00, 7214.10.29 00, 7214.20.31 00, 7214.20.39 00,
7214.20.41 00, 7214.20.49 00, 7214.20.51 00, 7214.20.59 00, 7214.20.61 00, 7214.20.69 00,

Like products or directly competitive products 2.
The like products or directly competitive products are products which are produced by the domestic industry and have the same description as the products specified in paragraph 1.

Reasons for affirmative final determination 3.
Based on the investigation, the investigating authority has found that—
(a)
there was an increase in imports of the products, absolute and relative to the domestic production during the period of injury determination that is from 1 October 2012 to 30 September 2015; and
(b)
under such conditions, it has caused serious injury to the domestic industry that produces like products or directly competitive products in respect of the decline in market share, domestic sales in terms of value, profitability, negative cash flow, and reduction in employment and wages.
Definitive safeguard measures applicable 4.
(1)
The definitive safeguard measures applicable in relation to the products shall take the form of definitive safeguard duties and shall be imposed on the countries specified in the Schedule.
(2)
Definitive safeguard duties shall be imposed for a period of three years from 14 April 2017 to 13 April 2020 at the following rates:
