“pasar dalam talian” ertinya tapak web di mana barang atau perkhidmatan dipasarkan oleh pihak ketiga bagi maksud perdagangan;

“pengendali pasar dalam talian” ertinya seseorang yang menyediakan pasar dalam talian.

Pendedahan maklumat

1.

Nama orang yang menjalankan perniagaan bagi maksud membekalkan barang atau perkhidmatan melalui tapak web atau dalam pasar dalam talian, atau nama perniagaan, atau nama syarikat.

2.

Nombor pendaftaran perniagaan atau syarikat, jika terpakai.

3.

Alamat e-mel dan nombor telefon, atau alamat orang yang menjalankan perniagaan bagi maksud membekalkan barang atau perkhidmatan melalui tapak web atau dalam pasar dalam talian.

4.

Perihalan tentang ciri utama barang atau perkhidmatan itu.

5.

Harga penuh barang atau perkhidmatan termasuklah kos pengangkutan, cukai dan apa-apa kos lain.

6.

Kaedah pembayaran.

7.

Terma-terma dan syarat-syarat.

8.

Anggaran masa penghantaran barang atau perkhidmatan kepada pembeli.

CONSUMER PROTECTION ACT 1999

CONSUMER PROTECTION (ELECTRONIC TRADE TRANSACTIONS) REGULATIONS 2012

IN exercise of the powers conferred by paragraph 150(2)(a) of the Consumer Protection

Act 1999 [Act 599], the Minister makes the following regulations:

Citation and commencement 1.

(1)

These regulations may be cited as the Consumer Protection (Electronic

Trade Transactions) Regulations 2012.

(2)

These Regulations come into operation on 1 July 2013.

Interpretation 2.

In these Regulations—

“online marketplace” means a website where goods or services are marketed by third parties for the purpose of trade;

“online marketplace operator” means a person who provides an online marketplace.

Disclosure of information 3.

(1)

Any person who operates a business for the purpose of supply of goods or services through a website or in an online marketplace shall disclose on the website where the business is conducted the information specified in the Schedule.

(2)

Any person who contravenes subregulation (1) commits an offence.

(3)

Any person who discloses or provides any information as specified in the

Schedule that he knows or has reason to believe is false or misleading, commits an offence.

Rectification of errors and acknowledgement of receipt 4.

(1)

Any person who operates a business for the purpose of supply of goods or services through a website or in an online marketplace—

(a)

shall provide the appropriate means to enable the buyer to rectify any errors prior to the confirmation of the order made by the buyer; and

(b)

shall acknowledge receipt of the order to the buyer without undue delay.

(2)

The order and the acknowledgement of receipt shall be deemed to have been received by the person who operates a business for the purpose of supply of goods or services through a website or in an online marketplace and the buyer, respectively, when the person and the buyer are able to access to such order and the acknowledgement of receipt.

Maintenance of record 5.

(1)

Any online marketplace operator shall take reasonable steps to keep and maintain a record of the names, telephone numbers and the address of the person who supplies goods or services in the online marketplace, for a period of two years.

(2)

Any online marketplace operator who contravenes subregulation (1)

commits an offence.

(Regulation 3)

Disclosure of information

1.

The name of the person who operates a business for the purpose of supply of goods or services through a website or in an online marketplace, or the name of the business, or the name of the company.

2.

The registration number of the business or company, if applicable.

3.

The e-mail address and telephone number, or address of the person who operates a business for the purpose of supply of goods or services through a website or in an online marketplace.

4.

A description of the main characteristics of the goods or services.

5.

The full price of the goods or services including transportation costs, taxes and any other costs.

6.

The method of payment.

7.

The terms and conditions.

8.

The estimated time of delivery of the goods or services to the buyer.
