Preamble

  1. PADA menjalankan kuasa yang diberikan oleh perenggan 132(2)(d) Akta Pemuliharaan Hidupan Liar 2010 [Akta 716], Menteri membuat peraturan-peraturan yang berikut: Nama dan permulaan kuat kuasa

Tafsiran

Dalam Peraturan-Peraturan ini, “doktor veterinar” ertinya seseorang yang didaftarkan di bawah Akta Doktor Veterinar 1974 [Akta 147].

Pelupusan hidupan liar

Mana-mana pemegang suatu lesen, permit atau permit khas yang dikeluarkan di bawah Akta boleh melupuskan hidupan liar yang berada dalam milikan atau jagaannya dengan cara—

(a)

menyerahkan hidupan liar itu kepada pegawai pelesen; atau

(b)

hidupan liar itu dieutanasiakan oleh doktor veterinar atau mana-mana orang di bawah pengawasan doktor veterinar.

Keperluan bedah siasat

(1)

Kecuali bagi kelas amfibia, insekta dan araknida, pemegang lesen, permit atau permit khas hendaklah dengan serta-merta selepas kematian hidupan liar memberitahu seorang doktor veterinar bagi maksud menjalankan suatu bedah siasat.

(2)

Doktor veterinar itu hendaklah memutuskan sama ada suatu bedah siasat ke atas hidupan liar itu adalah perlu atau tidak.

(3)

Pemegang suatu lesen, permit atau permit khas hendaklah memaklumkan pegawai pelesen dengan seberapa segera yang praktik tentang dapatan doktor veterinar itu.

Kaedah pelupusan hidupan liar

(1)

Sekiranya hidupan liar itu mati disebabkan oleh suatu penyakit yang tidak berjangkit sebagaimana yang disahkan oleh doktor veterinar, ia bolehlah dilupuskan dengan kelulusan pegawai pelesen dengan cara ditanam atau dibakar dalam suatu tempat pembakaran.

(2)

Sekiranya hidupan liar itu mati disebabkan oleh suatu penyakit yang berjangkit sebagaimana yang disahkan oleh doktor veterinar, ia bolehlah dilupuskan dengan kelulusan pegawai pelesen dengan cara dibakar dalam suatu tempat pembakaran atau dengan apa-apa cara lain sebagaimana yang ditentukan oleh pihak berkuasa veterinar.

(3)

Pemegang suatu lesen, permit atau permit khas hendaklah menanggung sendiri apa-apa kos yang dibelanjakan dalam melupuskan hidupan liar itu.

Melapor kepada pihak berkuasa veterinar

Pemegang suatu lesen, permit atau permit khas hendaklah melaporkan kematian mana-mana hidupan liar yang dijangkiti penyakit berjangkit atau disyaki dijangkiti penyakit itu kepada pihak berkuasa veterinar mengikut kehendak di bawah seksyen 31

Akta Binatang 1953 [Akta 647].

Penalti

Mana-mana pemegang lesen, permit atau permit khas yang melanggar mana-mana peruntukan Peraturan-Peraturan ini adalah melakukan suatu kesalahan dan

boleh, apabila disabitkan, didenda tidak melebihi satu ratus ribu ringgit atau dipenjarakan selama tempoh tidak melebihi lima tahun atau kedua-duanya.

WILDLIFE CONSERVATION (DISPOSAL) REGULATIONS 2013

Opening note

Preamble

  1. IN exercise of the powers conferred by paragraph 132(2)(d) of the Wildlife Conservation Act 2010 [Act 716], the Minister makes the following regulations: Citation and commencement

Seksyen 1

(1)

These regulations may be cited as the Wildlife Conservation (Disposal)

Regulations 2013.

(2)

These Regulations comes into operation on 1 March 2013.

Interpretation 2.

In these Regulations, "veterinary surgeon" means a person registered under the

Veterinary Surgeons Act 1974 [Act 147].

Disposal of wildlife 3.

Any holder of a licence, permit or special permit issued under the Act may dispose of the wildlife in his possession or under his care by way of—

(a)

surrendering the said wildlife to the licensing officer; or

(b)

euthanizing the said wildlife by a veterinary surgeon or any person under the supervision of the veterinary surgeon.

Requirement for post–mortem 4.

(1)

Except for the amphibian, insecta and arachnid class, the holder of a licence, permit or special permit shall immediately upon the death of a wildlife inform a veterinary surgeon for the purpose conducting a post-mortem.

(2)

The veterinary surgeon shall decide whether a post-mortem on the wildlife is necessary or not.

(3)

The holder of a licence, permit or special permit shall notify the licensing officer as soon as practicable the findings of the veterinary surgeon.

Manner of disposal of wildlife 5.

(1)

If the wildlife dies due to a non-infectious disease as verified by the veterinary surgeon, it may be disposed of with the approval of the licensing officer by way of burying or burning in an incinerator.

(2)

If the wildlife dies due to an infectious disease as verified by the veterinary surgeon, it may be disposed of with the approval of the licensing officer by way of burning in an incinerator or by way of any other manner as may be determined by the veterinary authority.

(3)

The holder of a licence, permit or special permit shall bear any costs incurred in disposing the wildlife himself.

Report to the veterinary authority 6.

The holder of a licence, permit or special permit shall lodge a report of the death of any wildlife due to infectious disease or suspected to be infected by the disease to the veterinary authority in accordance with the requirements under section 31 of the

Animals Act 1953 [Act 647].

Penalty 7.

Any holder of a licence, permit or special permit who contravenes any provision of these Regulations commits an offence and shall, on conviction, be liable to a fine not exceeding one hundred thousand ringgit or imprisonment for a term not exceeding five years or to both.
