B.V., suatu penanggung insurans yang diperbadankan dan dikawal selia di Netherlands, dikecualikan daripada pemakaian subseksyen 8(1) Akta semata-mata bagi maksud menjalankan perniagaan insurans perlindungan dan indemniti bagi tempoh tiga tahun dari tarikh Perintah ini mula berkuat kuasa.

Bagi maksud subperenggan (1), “insurans perlindungan dan indemniti”
ertinya insurans perlindungan dan indemniti yang ditawarkan oleh RaetsMarine
Insurance B.V. secara usaha sama dengan Perlindungan dan Indemniti Malaysia

kepada kapal
Malaysia sebagaimana yang dinyatakan dalam subseksyen 11(1)

Opening note
Preamble
- IN exercise of the powers conferred by section 263 of the Financial Services Act 2013 [Act 758], the Minister, upon the recommendation of the Bank, makes the following order: Citation 1. This order may be cited as the Financial Services (Exemption) Order 2016. Exemption from subsection 8(1)
Seksyen 2
(1)
RaetsMarine Insurance B.V., an insurer incorporated and regulated in the
Netherlands, is exempted from the application of subsection 8(1) of the Act solely for the purposes of carrying on the business of protection and indemnity insurance for a period of three years from the date this Order comes into operation.
(2)
For the purposes of subparagraph (1), “protection and indemnity insurance” means the protection and indemnity insurance offered by RaetsMarine
Insurance B.V. in collaboration with Perlindungan dan Indemniti Malaysia Sdn. Bhd.
to a Malaysian ship as specified in subsection 11(1) of the Merchant Shipping
Ordinance 1952 [Ord. 70/1952], of 300 gross tonnage or less, or intended for navigation on inland waterways, for the purpose of complying with the compulsory insurance requirements under Part IX of the Merchant Shipping Ordinance 1952.
