Section 2

Power to make rules

The Minister may, after consultation with the *Chief Judge, make rules to provide for the disposal by destruction or otherwise of such records, exhibits, books and papers belonging to or being in the custody of—

(a)

the High Court or of any subordinate court as a Registrar of the High Court or the Magistrate presiding over such subordinate court may consider unworthy of being permanently preserved; and

(b)

a Probate Officer or the **Director General of Insolvency as the *Chief Judge may consider useless or unworthy of being permanently preserved.

*NOTE—Previously known as the “Chief Justice”—see section 46 of the Constitution (Amendment)

Act 1994 [Act A885] which comes into operation on 24 June 1994.

**NOTE—Previously known as the “Official Assignee”—see section 17 of the Bankruptcy

(Amendment) Act 2003 [Act A1197] which comes into operation on 1 October 2003.

Nothing in this Act shall—

(a)

affect the provisions of *Chapter XXX of the Criminal

Procedure Code or any written law relating to the disposal of property, the subject of or connected with the commission of an offence; and

be deemed to authorize the destruction of any document which under the provisions of any law for the time being in force is to be kept and maintained.

No suit to lie on account of destruction

No suit or other proceeding shall be instituted against any person for any disposal by destruction or otherwise of any records, exhibits, books or papers in accordance with any rules made under this Act.

*NOTE—The Criminal Procedure Code has since been repealed by the Criminal Procedure

Code (Amendment and Extension) Act, 1976 [Act A324] which comes into operation on 10 January 1976—see paragraph 4(c) of Act A324. Act A324 extended the application of the Criminal Procedure Code (F.M.S. Cap. 6) to throughout Malaysia—see subsection 2(2) of

Act A324. F.M.S. Cap. 6 has been revised and was named the Criminal Procedure Code

[Act 593] which comes into operation on 4 April 1999.
