Substitution of section 235
The principal Act is amended by substituting for section 235
the following section:
235.
“Damage to network facilities, etc.
(1)  A person who by any willful, dishonest or negligent act or omission, extends, tampers with, adjusts, alters, removes, destroys or damages any network facilities or any part of them commits an offence.
(2)  A person who has in his possession any network facilities or any part of them, whether in its original state or altered form, knowing or having reason to believe the same to be removed in the circumstances described in subsection (1)
commits an offence.
(3)  A person who commits an offence under subsection (1)
or (2) shall, on conviction, be liable to a fine not exceeding five hundred thousand ringgit or to imprisonment for a term not exceeding five years or to both.
(4)  In any prosecution for an offence under subsection (2), any person who has in his possession any network facilities or any part of them, whether in its original state or altered form is presumed to know or has a reason to believe that the same has been removed in the circumstances described in subsection (1), unless the contrary is proven.”.
