Section 8
Section 294 of the Code is amended by inserting after subsection (5) the following subsection:
"（6）This section shall not apply一
(a)
if the offender is charged with a serious offence; or
(b)
if the offender is charged with the commission of an act of domestic violence as defined under section 2 of the Domestic Violence Act 1994.".
