Preamble

Pada menjalankan kuasa yang diberikan oleh Seksyen 6 Akta Perhutanan Negara 1984 [Akta 313], yang diterima pakai oleh Enakmen Akta Perhutanan Negara 1984 (Pemakaian) 1985 [Enakmen Bil. 3 Tahun 1985], Pihak Berkuasa Negeri mewakilkan perjalanan atau perlaksanaan apa-apa kuasa atau kewajipan di bawah Seksyen 41 Enakmen Akta Perhutanan Negara 1984 (Pemakaian) 1985 kepada Pengarah Perhutanan Negeri Perak untuk membenarkan pemindahan apa-apa hasil hutan dari mana-mana tanah berimilik bagi keluasan kurang daripada 100 hektar berkuat kuasa mulai 1 Januari 2018.

REVOCATION OF RESERVATION OF LAND

Preamble

Bahawasanya, melalui Pemberitahuan No. 1681 yang disiarkan dalam Warta Kerajaan Negeri Perak pada 3 Disember 2009, Pihak Berkuasa Negeri pada menjalankan kuasa yang diberikan kepadanya oleh Subseksyen 62(1) Kanun Tanah Negera [Akta 56 tahun 1965], telah mengisytiharkan bahagian tanah yang terletak di Wilayah Bukit Serdang, Mukim Pengkalan Hulu, Daerah Hulu Perak yang diperihalkan dalam Jadual dan terlukis di atas Pelan Hasil Ukur No. P.A. 106097 yang disimpan di Pejabat Pengarah Ukur dan Pemetaan Negeri Perak sebagai satu maksud awam iaitu suatu tapak untuk Projek Pembangunan Lembaga Air Perak yang akan diselenggara oleh Lembaga Air Perak; Dan bahawasanya, kini didapati suai manfaat oleh Pihak Berkuasa Negeri bahawa perizaban tersebut terdahulu dibatalkan sebagaimana yang diperihalkan dalam Jadual. Maka, oleh yang demikian, pada menjalankan kuasa yang diberikan kepada Pihak Berkuasa Negeri di bawah Subseksyen 64(1) Kanun Tanah Negara, Pihak 4hb Jan. 2018] 3 Berkuasa Negeri dengan ini memberi notis di bawah subseksyen 64(2) Kanun itu, mengenai cadangan untuk membatalkan keseluruhan perizaban tersebut sebagaimana yang diperihalkan dalam Jadual dan sesiapa jua yang ingin membantah pembatalan itu akan didengar oleh Pengarah Tanah dan Galian Negeri Perak dalam suatu siasatan yang akan diadakan di Bilik Mesyuarat, Pejabat Daerah dan Tanah Pengkalan Hulu pada 29 Januari 2018 jam 8.00 pagi hingga 1.00 tengahari.

Whereas, by Notification No. 1681 published in the Perak Government

Gazette on 3 December 2009, the State Authority, in exercise of the powers conferred by subsection 62(1) of the National Land Code [Act 56 of 1965]

proclaimed that the parcel of land situated at Wilayah Bukit Serdang, Mukim of Pengkalan Hulu, District of Hulu Perak described in the Schedule hereto and delineated upon revenue survey Plan No. P.A. 106097 deposited in the

Office of Director of Survey and Mapping Perak to be reserved for the public purpose, to wit, a site for Perak Water Board Development Project to be maintained by the Perak Water Board;

And whereas, it now appears expedient to the State Authority that the aforesaid reservation should be revoked as described in the Schedule.

Now therefore, in exercise of the powers conferred upon the State Authority under Subsections 64(1) of the National Land Code, the State Authority hereby gives notice under subsection 64(2) of the Code of the proposal to revoke the wholly reservation as described in the Schedule and those who wish to object to such revocation will be heard by the Director of Lands and Mines, Perak which an inquiry to be held at the Meeting Room, Land and District Office of Pengkalan Hulu on 29 January 2018 at 8.00 a.m. to 1.00 p.m.
