FATWA UNDER SECTION 36

Fatwa yang dinyatakan dalam Jadual telah disediakan oleh Jawatankuasa

Fatwa di bawah seksyen 35 Enakmen Pentadbiran Agama Islam (Negeri Melaka)

2002 [En. No. 7 tahun 2002] dan telah dikemukakan kepada Majlis oleh Mufti, bagi pihak dan atas nama Jawatankuasa Fatwa, menurut subseksyen 36(3), dan telah mendapat perkenan Yang di-Pertuan Agong di bawah subseksyen 36(4) bagi penyiaran fatwa itu dalam Warta dan telah dimaklumkan kepada

Kerajaan Negeri menurut subseksyen 36(6) fatwa itu adalah disiarkan dalam

Warta di bawah subseksyen itu.

The Fatwa set out in the Schedule was prepared by the Fatwa Committee under section 35 of the Administration of the Religion of Islam (State of

Malacca) Enactment 2002 [En. No. 7 of 2002] and has been submitted to the Majlis by the Mufti, on behalf and in the name of the Fatwa Committee, pursuant to subsection 36(3), and the Yang di-Pertuan Agong has given his assent under subsection 36(4) for the publication of the fatwa in the Gazette and the State Government has been informed of the fatwa pursuant to subsection 36(6) and the fatwa is published the Gazette under that subsection.

JADUAL/SCHEDULE

Hukum melantik orang bukan Islam sebagai Peguam Syar’ie adalah haram. Keputusan ini dibuat bersandarkan kepada dalil-dalil daripada nas al-Quran dan Hadith, Kaedah Fiqhiyyah, Maslahah dan Siasah

Syar’iyyah.
