Serious accident to be reported and investigated
of Gas Supply Regulations 2023
For the purpose of section 68 of the Enactment, the authorized officer or other officer shall, as soon as practicable, upon being notified of an accident or a fire —
(a)
visit the place where the accident or fire occurred;
(b)
make a preliminary investigation of the circumstances;
(c)
record in writing his findings which may be supported by relevant photographs;

(d)
direct that the person or authority provides him with photographs, medical reports or other relevant documents on the accident or fire;
(e)
forward his report to the Commission; and
(f)
if there has been a loss of life or there is a reason to believe that a person has been fatally injured, send a copy of his findings to the nearest police station.
(2)
In the event of the loss of life or grievous hurt is suffered by a person due to an accident or a fire in connection with a gas pipeline or gas installation, no alteration or addition shall be made to the gas pipeline or gas installation or any part of it which may have contributed to the accident or fire without the consent of the Commission and until the Commission or the authorized officer has completed his investigation:
Provided that this subregulation shall not operate to interfere with the rescue work or work necessary for the general safety of life or property.
(3)
If upon a preliminary investigation under subregulation (2) it appears to the authorized officer or other officer making the investigation that there is a reason to believe that —
(a)
the accident or fire was due to failure to comply with the Enactment or these Regulations or an order duly made by the Commission; or
(b)
the accident or fire could have been prevented if proper precautions had been taken in carrying out work on a gas pipeline or gas installation or any part of it, the Commission or authorized officer may further investigate the circumstances of the accident or fire.
(4)
If the Commission is of the opinion that any offence under the Enactment or these Regulations has been committed, the Commission shall immediately forward to the police a copy of the report of the authorized officer’s report referred to in subregulation (2) together with his opinion on the circumstances and findings.
(5)
A person involved in the investigation made under this regulation may be entitled to receive a copy of the summary of the evidence and the decision made upon payment of a fee of fifty ringgit.
