(2)

The members of the Commission shall be appointed by the

Yang di-Pertuan Agong on the recommendation of the Prime

Minister who shall, before tendering his advice, consult the committee referred to in section 11A.

(3)

The members of the Commission shall be appointed from amongst men and women of various religious, political and racial backgrounds who have knowledge of, or practical experience in, human rights matters.

*(4) A member of the Commission shall hold office for a period of three years and is eligible for reappointment once for another period of three years.

(5)

The Prime Minister may determine suitable mechanisms, including appropriate key performance indicators, to assess the

performance of the members of the Commission in carrying out their functions and duties under this Act.

(6)

Such assessment shall be taken into consideration—

(a)

by the Prime Minister before tendering his advice to the

Yang di-Pertuan Agong for the reappointment of any member of the Commission under subsection (4); and

(b)

for the removal of any member of the Commission under section 10.
