Preamble
- PADA menjalankan kuasa yang diberikan oleh seksyen 66 Akta Pengangkutan Jalan 1987 [Akta 333], Menteri membuat kaedah-kaedah yang berikut: Nama dan permulaan kuat kuasa
Seksyen 2
Kaedah-Kaedah Kenderaan Motor (Lesen Memandu) 1992 [P.U. (A) 409/1992], yang disebut “Kaedah-Kaedah ibu” dalam Kaedah-Kaedah ini, dipinda dengan menggantikan kaedah 3 dengan kaedah yang berikut:
“Permohonan bagi lesen belajar memandu, lesen memandu percubaan dan lesen.
Seksyen 3
(2)
Seseorang pemohon bagi lesen belajar memandu dan lesen memandu percubaan hendaklah memohon dalam tempoh satu tahun dari tarikh pemohon lulus ujian kekompetenan.
(3)
Seseorang pemegang lesen memandu percubaan yang memohon bagi lesen hendaklah memohon dalam tempoh satu tahun selepas tarikh habis tempoh lesen memandu percubaan.

Apabila permohonan dibuat bagi lesen, tarikh habis tempoh lesen hendaklah mengikut tarikh lahir pemegang lesen itu.
(5)
Seseorang pemohon bagi lesen Kelas E, E1 atau E2
yang disebut dalam subkaedah 5(4) hendaklah, sebelum sesuatu permohonan dibuat, memegang lesen Kelas D selain lesen belajar memandu bagi tempoh tidak kurang daripada satu tahun atau memegang lesen memandu percubaan bagi tempoh dua tahun.”.
Kaedah baru 3A dan 3B
Seksyen 3
Kaedah-Kaedah ibu dipinda dengan memasukkan selepas kaedah 3 kaedah yang berikut:
“Pembaharuan lesen.
Seksyen 3A
(2)
Apabila permohonan dibuat bagi pembaharuan lesen, tarikh habis tempoh lesen hendaklah mengikut tarikh lahir pemegang lesen itu.
(3)
Jika permohonan bagi pembaharuan lesen telah dibuat, lesen yang ada itu bersama-sama dengan bukti pembayaran dan pembaharuan lesen itu adalah bukti yang mencukupi bahawa orang itu pemegang lesen yang sah.

Penyelarasan bagi tarikh habis tempoh lesen yang

disebut dalam subkaedah (1) hendaklah terpakai bagi―
(b)
pemegang lesen yang memohon bagi pembaharuan lesen apabila habis tempoh lesen itu.
(3)
Jika seseorang pemegang lesen memandu percubaan atau pemegang lesen yang disebut dalam subkaedah (2) yang tarikh lahirnya jatuh pada 29 Februari, tarikh habis tempoh lesennya ialah sama ada―
(a)
28
Februari, jika permohonan yang berikutnya bagi pembaharuan lesen itu dibuat dalam tahun yang bukan merupakan tahun lompat; atau
(b)
29
Februari, jika permohonan yang berikutnya bagi pembaharuan lesen itu dibuat dalam tahun yang merupakan tahun lompat, mengikut mana-mana yang berkenaan.
(4)
Fee yang kena dibayar bagi maksud penyelarasan tarikh habis tempoh lesen hendaklah sebagaimana yang dinyatakan dalam butiran 1B dan 1C Jadual Kedua.”.

bagi lesen Kelas A, B dan C

Fee bagi penyelarasan tarikh habis tempoh lesen bagi warganegara jika perbezaan antara tarikh habis tempoh lesen dengan tarikh lahir lebih daripada dua puluh empat bulan tetapi kurang daripada enam puluh bulan hendaklah ditentukan mengikut formula yang berikut:

MOTOR VEHICLES (DRIVING LICENCE) (AMENDMENT) RULES 2012
Opening note
Preamble
- IN exercise of the powers conferred by section 66 of the Road Transport Act 1987 [Act 333], the Minister makes the following rules: Citation and commencement 1.
(1)
These rules may be cited as the Motor Vehicles (Driving Licence)
(Amendment) Rules 2012.
(2)
These
Rules are deemed to have come into operation on 20 November 2011.
Substitution of rule 3 2.
The Motor Vehicles (Driving Licence) Rules 1992 [P.U. (A) 409/1992], which are referred to as the “principal Rules” in these Rules, are amended by substituting for rule 3 the following rule:
“Application for a learner’s driving licence, probationary driving licence and licence.

(2)
An applicant for a learner’s driving licence and probationary driving licence shall apply within one year from the date the applicant passes the test of competence.
(3)
A holder of a probationary driving licence who applies for a licence shall apply within one year after the date of expiry of the probationary driving licence.
(4)
Upon the application made for a licence, the date of expiry of the licence shall be in accordance with the date of

birth of the holder of such licence.
(5)
An applicant for a Class E, E1 or E2 licence referred to in subrule 5(4) shall, before an application is made, hold a
Class D licence other than a learner’s driving licence for a period not less than one year or hold a probationary driving licence for a period of two years.”.
New rules 3A and 3B
Seksyen 3
The principal Rules are amended by inserting after rule 3 the following rules:
“Renewal of a licence.
Seksyen 3A
(2)
Upon the application made for renewal of a licence, the date of expiry of the licence shall be in accordance with the date of birth of the holder of such licence.
(3)
Where the application for renewal of a licence has been made, the existing licence together with proof of payment and renewal of such licence shall be sufficient evidence that such person is the holder of a valid licence.
Adjustment for the date of expiry of a licence.
Seksyen 3B
(2)
The adjustment for the date of expiry of a licence referred to in subrule (1) shall apply to―
(a)
a holder of a probationary driving licence who

applies for a licence; and
(b)
a holder of a licence who applies for renewal of a licence upon the expiry of such licence.
(3)
Where a holder of a probationary driving licence or holder of a licence referred to in subrule (2) whose date of birth falls on 29 February, the date of expiry of his licence is either―
(a)
28 February, if the following application for renewal of the licence is made in a year which is not a leap year; or
(b)
29 February, if the following application for renewal of the licence is made in a year which is a leap year, as the case may be.
(4)
The fees to be charged for the purpose of the adjustment of the date of expiry of a licence shall be as set out in items 1B and 1C of the Second Schedule.”.
Amendment of rule 4 4.
Rule 4 of the principal Rules is amended in subrule (1) by inserting after the words “items 1,” the words “1A, 1B, 1C,”.
Amendment of the Second Schedule 5.
The principal Rules are amended in the Second Schedule―
(a)
under the heading of “SECOND SCHEDULE”, by inserting after the word
“Rules” the words “3B,”;

by substituting for item 1 the following item:
