BIRTHS AND DEATHS REGISTRATION (COMPOUNDING OF OFFENCES) RULES 2019

IN exercise of the powers conferred by subsection 38(1)

of the

Births and Deaths Registration Act 1990 [Act 299], the Minister makes the following rules:

Citation 1.

These rules may be cited as the Births and Deaths Registration (Compounding of Offences) Rules 2019.

Compoundable offences 2.

(1)

The offences specified in the First Schedule are prescribed to be compoundable offences.

(2)

The offences referred to in subrule (1) may be compounded with the consent in writing of the Public Prosecutor in Form 1 of the Second Schedule.

Offer and acceptance of compound 3.

(1)

An offer to compound an offence referred to in subrule 2(1) shall be made in Form 2 of the Second Schedule.

(2)

A person who accepts an offer to compound an offence referred to in subrule 2(1) shall accept the offer in Form 3 of the Second Schedule.

Method of compounding 4.

(1)

After an investigation has been conducted and it is found that a compoundable offence has been committed as referred to in subrule 2(1), the Registrar-General or Superintendent-Registrar may issue an offer to compound the offence in Form 2 of the Second Schedule to the person who has committed the offence.

(2)

An offer to compound an offence under subrule (1) shall be valid for a period of fourteen days, and if full payment of the sum offered is made within the period of fourteen days, no further proceedings shall be taken against the person referred to in subrule (1).

(3)

If no payment of the compound offered is made within the period stated in subrule (2), prosecution may be instituted against the person referred to in subrule (1)

without further notice.

Payment of compound 5.

(1)

If an offer to compound an offence under subrule 4(1) is accepted by the person to whom the offer is made, he may pay the compound ̶

(a)

by cash and delivered personally to the National Registration

Department or any branch as determined by the Registrar-General;

(b)

by money order, postal order, cashier’s order, banker’s order or bank draft payable to the Registrar-General or Superintendent

Registrar and crossed with the words “Account Payee Only”; or

(c)

through credit card or an electronic fund transfer.

(2)

If the payment is made in accordance with paragraph (1)(b), the money order, postal order, cashier’s order, banker’s order or bank draft shall be delivered personally to the Registrar-General or Superintendent Registrar or sent by registered post to the address specified in Form 2 of the Second Schedule.

(3)

Upon receipt of the payment made in accordance with subrule (1), the

Registrar-General or Superintendent Registrar shall issue an official receipt for such payment to the person to whom the offer to compound an offence is made.

(4)

An official receipt issued under subrule (3) shall include any electronic receipt if the payment is made through credit card or an electronic fund transfer specified in paragraph (1)(c).
