dalam takrif “Setiausaha”, dengan menggantikan noktah di hujung takrif itu dengan koma bernoktah; dan
dengan memasukkan selepas takrif “Setiausaha” takrif yang berikut:
‘
“tauliah mengajar agama Islam” ertinya suatu kebenaran yang dikeluarkan oleh Jawatankuasa di bawah kaedah 25;
“tauliah mengajar agama Islam (khas)” ertinya suatu tauliah mengajar agama Islam yang membenarkan seorang warganegara
Malaysia atau bukan warganegara yang dijemput khas oleh mana-mana orang untuk mengajar agama Islam dalam suatu program yang berhubungan dengan agama Islam.’.

Penggantian kaedah 4
“Kaedah-Kaedah ibu” dalam Kaedah-Kaedah ini, dipinda dalam kaedah 2—
Kaedah-Kaedah ibu dipinda dengan menggantikan kaedah 4 dengan kaedah yang berikut:
“Borang
Majlis hendaklah menyebabkan supaya apa-apa borang yang berhubungan dengan tauliah mengajar agama Islam disiarkan di dalam laman sesawang rasminya.”.

Kaedah 5 Kaedah-Kaedah ibu dipinda dengan memasukkan selepas perkataan
“tauliah” di mana-mana jua terdapat perkataan “mengajar agama Islam”.

“Kelayakan 22.
Seseorang boleh memohon bagi mana-mana kategori tauliah mengajar agama Islam sebagaimana yang dinyatakan dalam kaedah 22A jika—
memegang suatu kelayakan dalam pengajian tinggi Islam daripada mana-mana universiti tempatan atau luar negeri yang diiktiraf oleh
Kerajaan Malaysia;
memegang suatu kelayakan dalam pengajian
Islam daripada mana-mana institusi pendidikan tempatan atau luar negeri yang diiktiraf oleh Kerajaan Malaysia;
mempunyai kemahiran dan kepakaran dalam suatu bidang khusus yang berhubungan dengan agama Islam; dan
Bagi maksud subperenggan (1)(b)(iii), seseorang yang mempunyai pengetahuan dalam Hukum Syarak ialah seseorang yang memperoleh pengetahuan untuk mengajar agama Islam daripada mana-mana institusi pendidikan selain subperenggan (1)(b)(i) dan (ii).”.

Kaedah baharu 22A dan 22B
Kaedah-Kaedah ibu dipinda dengan memasukkan selepas kaedah 22 kaedah yang berikut:
“Kategori tauliah mengajar agama Islam 22A.
Kategori tauliah mengajar agama Islam adalah seperti yang berikut:
Bagi maksud tauliah mengajar agama Islam (bidang khusus)
yang disebut dalam perenggan (1)(b), jenis bidang itu adalah sebagaimana yang dinyatakan dalam Jadual Ketiga.
Permohonan bagi tauliah mengajar agama Islam (khas)
Seseorang pemohon bagi suatu tauliah mengajar agama
Islam (khas) hendaklah mengemukakan suatu borang permohonan, secara elektronik atau selainnya, kepada Jawatankuasa tidak kurang daripada tujuh hari bekerja dari tarikh suatu program untuk mengajar agama Islam akan diadakan melainkan jika Pengerusi membenarkan selainnya.
Permohonan yang disebut dalam subkaedah (1) hendaklah disertakan dengan apa-apa dokumen yang berhubungan dengan program itu.

Bagi maksud permohonan di bawah kaedah ini, pemohon itu dikecualikan daripada—
menduduki apa-apa ujian kelayakan sama ada secara bertulis atau lisan di bawah subkaedah 23(2); dan
Apabila permohonan bagi suatu tauliah mengajar agama Islam (khas) diterima, Jawatankuasa boleh meluluskan atau menolak permohonan bagi tauliah mengajar agama Islam (khas) itu.
Jawatankuasa hendaklah memberitahu secara bertulis kepada pemohon itu keputusannya tentang permohonan bagi tauliah mengajar agama Islam (khas) itu.
Apabila permohonan bagi tauliah mengajar agama Islam
(khas) di bawah subkaedah (5) diluluskan, pemohon itu hendaklah membayar fi yang ditetapkan.
Jawatankuasa hendaklah mengeluarkan suatu tauliah mengajar agama Islam (khas) kepada pemohon itu apabila fi yang ditetapkan dibayar.
Tauliah mengajar agama Islam (khas) yang dikeluarkan oleh
Jawatankuasa kepada pemohon itu hendaklah sah hanya bagi tempoh program itu diadakan dan tauliah mengajar agama Islam (khas) itu tidak boleh dibaharui.”.

Penggantian kaedah 23
Kaedah-Kaedah ibu dipinda dengan menggantikan kaedah 23 dengan kaedah yang berikut:
“Permohonan bagi tauliah mengajar agama Islam 23.
Seseorang pemohon bagi mana-mana kategori tauliah mengajar agama Islam selain tauliah mengajar agama Islam (khas)
di bawah subkaedah 22A(1) hendaklah mengemukakan suatu borang permohonan, secara elektronik atau selainnya, kepada Jawatankuasa.
Apabila permohonan di bawah subkaedah (1) dibuat, pemohon itu hendaklah menduduki suatu ujian kelayakan sama ada secara bertulis atau lisan sebagaimana yang ditentukan oleh Jawatankuasa.
Jawatankuasa hendaklah memberitahu secara bertulis kepada pemohon yang telah lulus ujian kelayakan di bawah subkaedah (2)
dalam masa tiga puluh hari dari tarikh ujian kelayakan itu.
Apabila pemberitahuan yang disebut dalam subkaedah (3)
diterima, pemohon itu hendaklah menghadiri suatu seminar (muzakarah)
sebagaimana yang ditentukan oleh Jawatankuasa.
Walau apa pun subkaedah (4), pemohon itu boleh memohon bagi suatu pengecualian daripada menghadiri seminar (muzakarah)
itu dengan mengemukakan suatu borang, secara elektronik atau selainnya, kepada Jawatankuasa.”.

Kaedah 24 Kaedah-Kaedah ibu dipotong.

Pindaan kaedah 25
dalam nota bahu, dengan memasukkan selepas perkataan “mengajar”
perkataan “agama Islam”;
dengan menggantikan subkaedah (1) dengan subkaedah yang berikut:
“(1)
Jawatankuasa boleh meluluskan atau menolak permohonan yang disebut dalam kaedah 23.”;
dengan menggantikan subkaedah (2) dengan subkaedah yang berikut:
“(2)
Tertakluk kepada kehendak di bawah kaedah 23,
Jawatankuasa hendaklah mengeluarkan suatu tauliah mengajar agama Islam kepada pemohon itu apabila fi yang ditetapkan dibayar.”; dan
dalam subkaedah (3), dengan menggantikan perkataan “orang yang memiliki tauliah mengajar” dengan perkataan “pengajar”.
Kaedah baharu 25A, 25B, 25C dan 25D
Kaedah-Kaedah ibu dipinda dengan memasukkan selepas kaedah 25 kaedah yang berikut:
“Kesahan tauliah mengajar agama Islam 25A.
Kecuali tauliah mengajar agama Islam (khas) yang dikeluarkan di bawah subkaedah 22B(7), kategori lain tauliah mengajar agama Islam yang dikeluarkan oleh Jawatankuasa hendaklah sah bagi suatu tempoh yang tidak melebihi—
satu tahun bagi seorang bukan warganegara
Malaysia, dari tarikh pengeluaran tauliah mengajar agama Islam dan tauliah mengajar agama Islam itu boleh dibaharui.
Tertakluk kepada subkaedah (1), tempoh bagi tauliah mengajar agama Islam itu hendaklah ditentukan oleh Jawatankuasa.
Pembaharuan tauliah mengajar agama Islam 25B.
Seorang pengajar boleh memohon bagi pembaharuan tauliah mengajar agama Islamnya dengan mengemukakan suatu borang permohonan pembaharuan, secara elektronik atau selainnya, kepada Jawatankuasa—
dalam hal seorang warganegara
Malaysia, dalam masa tiga puluh hari dari tarikh habis tempoh tauliah mengajar agama Islam itu; dan
dalam hal seorang bukan warganegara Malaysia, dalam masa sembilan puluh hari dari tarikh habis tempoh tauliah mengajar agama Islam itu.
Apabila permohonan bagi pembaharuan yang disebut dalam subkaedah (1) diterima, Jawatankuasa boleh meluluskan atau menolak permohonan bagi pembaharuan itu.
Jawatankuasa hendaklah memberitahu secara bertulis kepada pengajar itu keputusannya tentang permohonan bagi pembaharuan itu.

Apabila permohonan bagi pembaharuan di bawah subkaedah (3) diluluskan, pengajar itu hendaklah membayar fi yang ditetapkan.
Pembatalan tauliah mengajar agama Islam 25C.
Jawatankuasa boleh, melalui suatu notis secara bertulis kepada pengajar, membatalkan suatu tauliah mengajar agama Islam yang dikeluarkan masing-masing di bawah subkaedah 22B(7) dan 25(2) jika
Jawatankuasa berpuas hati bahawa pengajar itu—
telah disabitkan atas apa-apa kesalahan di bawah mana-mana undang-undang bertulis di Malaysia;
atau
telah memperoleh tauliah mengajar agama Islam dengan membuat atau menyebabkan dibuat suatu perisytiharan, perakuan atau representasi palsu atau fraud.
Apabila suatu notis secara bertulis yang disebut dalam subkaedah (1) diterima, pengajar itu tidak boleh mengajar agama Islam di dalam Wilayah-Wilayah Persekutuan.
Rayuan 25D.
Mana-mana orang yang terkilan dengan keputusan
Jawatankuasa berhubung dengan pembatalan tauliah mengajar agama
Islam boleh merayu kepada Majlis.
Suatu rayuan hendaklah dibuat secara bertulis dengan menyatakan alasan rayuan kepada Majlis dalam masa dua puluh satu hari dari tarikh pengajar itu diberitahu mengenai pembatalan itu.

Majlis boleh mengesahkan, mengubah atau mengetepikan keputusan Jawatankuasa atau membuat apa-apa keputusan yang Majlis fikirkan patut.”.

Kaedah 26 Kaedah-Kaedah ibu dipinda—
dengan memasukkan selepas perkataan “tauliah mengajar” perkataan
“agama Islam”;
dengan menggantikan noktah di hujung perenggan (g) dengan perkataan

tidak bertindak atau berkelakuan dalam apa-apa cara yang boleh mencemarkan agama Islam.”.

Kecualian dan peralihan 18.
(1)
Mana-mana orang yang telah diberikan suatu tauliah mengajar agama
Islam, sebelum tarikh permulaan kuat kuasa Kaedah-Kaedah ini, hendaklah membuat permohonan bagi suatu tauliah mengajar agama Islam di bawah Kaedah-Kaedah ini dalam masa dua tahun dari tarikh permulaan kuat kuasa Kaedah-Kaedah ini.
(2)
Apa-apa permohonan bagi suatu tauliah mengajar agama Islam yang belum selesai sebaik sebelum tarikh permulaan kuat kuasa Kaedah-Kaedah ini hendaklah, selepas tarikh permulaan kuat kuasa Kaedah-Kaedah ini, diuruskan di bawah
Kaedah-Kaedah ibu seolah-olah Kaedah-Kaedah ibu tidak dipinda.
(3)
Apa-apa tindakan atau keputusan berhubung dengan suatu tauliah mengajar agama Islam yang dimulakan atau yang belum selesai sebaik sebelum tarikh permulaan kuat kuasa Kaedah-Kaedah ini hendaklah, selepas tarikh permulaan kuat kuasa Kaedah-Kaedah ini, diteruskan seolah-olah Kaedah-Kaedah ibu tidak dipinda.

ADMINISTRATION OF ISLAMIC LAW
(FEDERAL TERRITORIES) (TAULIAH TO TEACH THE RELIGION OF ISLAM)
(AMENDMENT) RULES 2021
IN exercise of the powers conferred by subsection 96(4)
of the
Administration of Islamic Law (Federal Territories) Act 1993 [Act 505], the Majlis, with the approval of the Minister, makes the following rules:
Citation 1.
These rules may be cited as the Administration of Islamic Law
(Federal Territories) (Tauliah to Teach the Religion of Islam) (Amendment)
Rules 2021.
Amendment of rule 2 2.
The Administration of Islamic Law (Federal Territories) (Tauliah to Teach the Religion of Islam) Rules 2006 [P.U. (A) 74/2006], which are referred to as the “principal Rules” in these Rules, are amended in rule 2—
(a)
in the definition of “Secretary”, by substituting for the full stop at the end of the definition a semicolon; and
(b)
by inserting after the definition of “Secretary” the following definitions:
‘
“tauliah to teach the religion of Islam” means an authorization issued by the Committee under rule 25;
“tauliah to teach the religion of Islam (special)” means a tauliah to teach the religion of Islam which allows a Malaysian citizen or non-citizen who specially invited by any person to teach the religion of Islam in a programme relating to the religion of Islam.’.

Substitution of rule 4 3.
The principal Rules are amended by substituting for rule 4 the following rule:
“Form 4.
The Majlis shall cause to be published any form relating to tauliah to teach the religion of Islam in its official website.”.
Amendment of rule 5 4.
Rule 5 of the principal Rules is amended by inserting after the word “tauliah”
wherever appearing the words “to teach the religion of Islam”.
Amendment of rule 12 5.
Paragraph 12(2)(a) of the principal Rules is amended by inserting after the word
“tauliah” the words “to teach the religion of Islam”.
Amendment of rule 21 6.
Rule 21 of the principal Rules is amended by substituting for the words
“tauliah to teach Islamic religious teaching” the words “tauliah to teach the religion of
Islam”.
Substitution of rule 22 7.
The principal Rules are amended by substituting for rule 22 the following rule:
“Qualification 22.
(1)
A person may apply for any category of tauliah to teach the religion of Islam as specified in rule 22A if—
(a)
the person adheres to the creed of Ahli Sunnah Wal
Jamaah;

(b)
the person—
(i)
holds a qualification in higher Islamic studies from any local or foreign university recognized by the Government of Malaysia;
(ii)
holds a qualification in Islamic studies from any local or foreign educational institutions recognized by the Government of Malaysia;
(iii)
has knowledge in Hukum Syarak; or
(iv)
has skill and expertise in a specific field relating to the religion of Islam; and
(c)
has an Islamic personality.
(2)
For the purposes of subparagraph (1)(b)(iii), a person who has knowledge in Hukum Syarak is a person who acquires knowledge to teach the religion of Islam from any educational institution other than subparagraphs (1)(b)(i) and (ii).”.
New rules 22A and 22B
8.
The principal Rules are amended by inserting after rule 22 the following rules:
“Category of tauliah to teach religion of Islam 22A.
(1)
The categories of tauliah to teach the religion of Islam are as follows:
(a)
tauliah to teach the religion of Islam (special);
(b)
tauliah to teach the religion of Islam (specific field);

(c)
tauliah to teach the religion of Islam (general);
(d)
tauliah to teach the religion of Islam (Al-Quran);
(e)
tauliah to teach the religion of Islam (with kitab).
(2)
For the purposes of the tauliah to teach the religion of Islam
(specific field) referred to in paragraph (1)(b), the types of fields are as specified in the Third Schedule.
Application for tauliah to teach religion of Islam (special)
22B.
(1)
An applicant for a tauliah to teach the religion of Islam
(special) shall submit an application form, electronically or otherwise, to the Committee not less than seven working days from the date of a programme to teach the religion of Islam to be held unless the Chairman otherwise permits.
(2)
The application referred to in subrule (1) shall be accompanied with any document relating to the programme.
(3)
For the purposes of the application under this rule, the applicant is exempted from—
(a)
sitting any qualifying test whether in writing or orally under subrule 23(2); and
(b)
attending any seminar
(muzakarah)
under subrule 23(4).
(4)
Upon receipt the application for a tauliah to teach the religion of Islam (special), the Committee may approve or reject the application for a tauliah to teach the religion of Islam (special).

(5)
The Committee shall notify in writing to the applicant its decision on the application for a tauliah to teach the religion of Islam (special).
(6)
Upon approval of the application for a tauliah to teach the religion of Islam (special) under subrule (5), the applicant shall pay the prescribed fee.
(7)
The Committee shall issue a tauliah to teach the religion of
Islam (special) to the applicant upon payment of the prescribed fee.
(8)
The tauliah to teach the religion of Islam (special) issued by the Committee to the applicant shall be valid only for a period of the programme is held and the tauliah to teach the religion of Islam (special) shall not be renewed.”.
Substitution of rule 23 9.
The principal Rules are amended by substituting for rule 23 the following rule:
“Application for tauliah to teach the religion of Islam 23.
(1)
An applicant for any category of tauliah of teach the religion of Islam other than a tauliah to teach the religion of Islam (special) under subrule 22A(1) shall submit an application form, electronically or otherwise, to the Committee.
(2)
Upon the application made under subrule (1), the applicant shall sit for a qualifying test whether in writing or orally as determined by the Committee.
(3)
The Committee shall notify in writing to the applicant who has passed the qualifying test under subrule (2) within thirty days from the date of the qualifying test.

(4)
Upon receipt the notification referred to in subrule (3), the applicant shall attend a seminar (muzakarah) as determined by the Committee.
(5)
Notwithstanding subrule (4), the applicant may apply for an exemption from attending the seminar (muzakarah) by submitting a form, electronically or otherwise, to the Committee.”.
Deletion of rule 24 10.
Rule 24 of the principal Rules is deleted.
Amendment of rule 25 11.
Rule 25 of the principal Rules is amended—
(a)
in the shoulder note, by inserting after the word “teach” the words
“the religion of Islam”;
(b)
by substituting for subrule (1) the following subrule:
“(1)
The Committee may approve or reject the application referred to in rule 23.”;
(c)
by substituting for subrule (2) the following subrule:
“(2)
Subject to the requirement under rule 23, the Committee shall issue a tauliah to teach the religion of Islam to the applicant upon payment of the prescribed fee.”; and
(d)
in subrule (3), by substituting for the words “person who possesses the tauliah to teach” the word “teacher”.

New rules 25A, 25B, 25C and 25D
12.
The principal Rules are amended by inserting after rule 25 the following rules:
“Validity of tauliah to teach religion of Islam 25A.
(1)
Except the tauliah to teach the religion of Islam (special)
issued under subrule 22B(7), other category of tauliah to teach the religion of Islam issued by the Committee shall be valid for a term not exceeding—
(a)
five years for a Malaysian citizen; and
(b)
one year for a non-Malaysian citizen, from the date of issuance of tauliah to teach the religion of Islam and the tauliah to teach the religion of Islam may be renewed.
(2)
Subject to subrule (1), the term for tauliah to teach the religion of Islam shall be determined by the Committee.
Renewal of tauliah to teach the religion of Islam 25B.
(1)
A teacher may apply for renewal of his tauliah to teach the religion of Islam by submitting a renewal application form, electronically or otherwise, to the Committee—
(a)
in the case of a Malaysian citizen, within thirty days from the date of expiry of the tauliah to teach the religion of Islam; and
(b)
in the case of a non-Malaysian citizen, within ninety days from the date of expiry of the tauliah to teach the religion of Islam.

(2)
Upon receipt the application for renewal referred to in subrule (1), the Committee may approve or reject the application for renewal.
(3)
The Committee shall notify in writing to the teacher its decision on the application for renewal.
(4)
Upon approval of the application for renewal under subrule (3), the teacher shall pay the prescribed fee.
Revocation of tauliah to teach religion of Islam 25C.
(1)
The Committee may, by a notice in writing to a teacher, revoke a tauliah to teach the religion of Islam issued under subrules 22B(7)
and 25(2) respectively if the Committee is satisfied that the teacher—
(a)
has breached any of the conditions under rule 26;
(b)
has been convicted of any offence under any written law in Malaysia; or
(c)
has obtained the tauliah to teach the religion of Islam by making or causing to be made a false or fraudulent declaration, certification or representation.
(2)
Upon receipt the notice in writing referred to in subrule (1), the teacher shall not teach the religion of Islam in the Federal Territories.
Appeal 25D.
(1)
Any person who is aggrieved by the decision of the
Committee in relation to the revocation of the tauliah to teach the religion of Islam may appeal to the Majlis.

(2)
An appeal shall be made in writing by stating the grounds of appeal to the Majlis within twenty-one days from the date the teacher has been notified of such revocation.
(3)
The Majlis may affirm, vary or set aside the decision of the
Committee or make any decision that the Majlis thinks fit.”.
Amendment of rule 26 13.
Rule 26 of the principal Rules is amended—
(a)
by inserting after the words “tauliah to teach” the words “the religion of Islam”;
(b)
by deleting the word “and” at the end of paragraph (f);
(c)
by substituting for the full stop at the end of paragraph (g) the words
“; and”; and
(d)
by inserting after paragraph (g) the following paragraph:
“(h)
not to act or behave in any manner which may defile the religion of Islam.”.
Amendment of rule 27 14.
Rule 27 of the principal Rules is amended—
(a)
in the shoulder note, by substituting for the words “to teach” the words
“to Teach the Religion of Islam”; and
(b)
by inserting after the words “tauliah to teach” and “Tauliah to Teach”
wherever appearing the words “the religion of Islam” and “the Religion of
Islam” respectively.

Saving and transitional 18.
(1)
Any person who has been conferred with a tauliah to teach the religion of
Islam, before the date of coming into operation of these Rules, shall make an application for a tauliah to teach the religion of Islam under these Rules within two years from the date of coming into operation of these Rules.
(2)
Any application for a tauliah to teach the religion of Islam pending immediately before the date of coming into operation of these Rules shall, after the date of coming into operation of these Rules, be dealt with under the principal Rules as if the principal Rules had not been amended.
(3)
Any action or decision in relation to a tauliah to teach the religion of Islam commenced or pending immediately before the date of coming into operation of these Rules shall, after the date of coming into operation of these Rules, be continued as if the principal Rules had not been amended.
