NATIONAL FORESTRY ACT 1984
NATIONAL FORESTRY (FEDERAL TERRITORIES) RULES 2019

IN exercise of the powers conferred by section 111 of the National Forestry Act 1984
[Act 313] as modified by the Fifth Schedule of the Act, the Federal Territory of Putrajaya
(Modification of National Forestry Act 1984) Order 2017 [P.U. (A) 450/2017] and the Federal Territory of Labuan (Modification of National Forestry Act 1984) Order 2017
[P.U. (A) 451/2017], the Minister makes the following rules:
PART I
PRELIMINARY
Citation and commencement 1.
(1)
These rules may be cited as the National Forestry (Federal Territories)
Rules 2019.
(2)
These Rules come into operation on 1 September 2019.
Interpretation 2.
In these Rules, unless the context otherwise requires—
“Director of Lands and Mines” means the State Director of Lands and Mines appointed under section 12 of the National Land Code;
“Director of Survey and Mapping” means the State Director of Survey and Mapping appointed under section 12 of the under National Land Code;
“forest clearance certificate” means a certificate granted by the Director to confirm that the area specified in the application of forest clearance certificate does not contain any more timber which can be economically harvested;

“classification mark” means a mark placed on the forest produce or the receptacle, package or conveyance in which containing forest produce to indicate from where the forest produce was taken or removed;
“Federal

PART II
POWERS OF DIRECTOR
Permission in writing 3.
Subject to the control of the Minister on matters affecting the administration and management of the forest in the Federal Territories, the Director may grant permission in writing to any person to do any act as referred to in subsection 81(1) of the Act in a permanent reserved forest for the purposes of—
(a)
study or research; or
(b)
carrying out any activity in the management, conservation and development of forests.
Forest clearance certificate 4.
(1)
The Director may grant a forest clearance certificate before an area of land in the Federal land is being disposed of.
(2)
For the purpose of subrule (1), the Director of Lands and Mines shall submit an application of forest clearance certificate to the Director together with a plan of area to indicate the external boundaries of area of land in the Federal land which to be disposed of.
(3)
Upon receipt the application under subrule (2), the Director shall make an assessment on the area of land in the Federal land which to be disposed of.

(4)
After the assessment under subrule (3) is made, and the Director is satisfied that—
(a)
the area of land in the Federal land does not contain any timber which can be economically harvested, the Director may grant the forest clearance certificate; or
(b)
the area of land in the Federal land contains any timber which can be economically harvested, the Director shall apply permission from the Minister to take the forest produce as specified in paragraph 16(a) of the Act, and—
(i)
where the application is allowed by the Minister, a forest clearance certificate will be granted by the Director after the taking of forest produce is completed; or
(ii)
where the application is not allowed by the Minister, a forest clearance certificate will not be granted.
(5)
An area of land in the Federal land cannot be disposed of to any person before a forest clearance certificate is granted by the Director.
Boundaries of administration and management of forest 5.
For the purpose of the Act and the administration and management of the forest, the Director may divide the extent of the divisions of the Federal Territories to forest administrative area and sub-area as he thinks fit.
PART III
PERMANENT RESERVED FOREST
Constitution of permanent reserved forest 6.
(1)
Any area of land may be constituted as a permanent reserved forest under section 7 of the Act.

(2)
For the purpose of subrule (1), any written proposal to constitute any area of land as a permanent reserved forest from any party, shall be referred to the Director.
(3)
When received the proposal to constitute any area of land as a permanent reserved forest, the Director shall—
(a)
refer the proposal to constitute any area of land as a permanent reserved forest to the relevant Ministry, departments, agencies and other party for comments;
(b)
prepare a written report on the proposal to constitute a permanent reserved forest based on comments under paragraph (a); and
(c)
submit a written report under paragraph (b) to the Minister for approval.
(4)
Where the approval is granted by the Minister, the Director shall—
(a)
submit a copy of the approval together with a plan of area to indicate the external boundaries of the area to the
Director of Survey and Mapping for the purpose of preparing the Gazette plan; and
(b)
prepare a notification to constitute the land as a permanent reserved forest for the purpose of publication in the Gazzette.
(5)
Where the approval is not granted by the Minister, the Director shall notify such rejection in writing to the party who proposed to constitute any area of land as a permanent reserved forest.

Demarcation of external boundaries of the land constituted as permanent reserved forest 7.
Upon the notification to constitute any area of land as a permanent reserved forest is published in the Gazette, the Director shall commence the demarcation of the external boundaries of the land which constituted as a permanent reserved forest within the reasonable time.
Classification of permanent reserved forest 8.
(1)
The permanent reserved forest or part thereof may be classified according to the classification as specified in the subsection 10(1) of the Act.
(2)
For the purpose of subrule (1), the Director shall submit a written proposal to classify the permanent reserved forest or part thereof together with the a plan of area to indicate the boundaries of the area to the Minister for an approval.
(3)
Where the approval is granted b the Minister, the Director shall—
(a)
submit a copy of the approval together with a plan of area to indicate the boundaries of the area to the
Director of Survey and Mapping for the purpose of preparing the
Gazette plan; and
(b)
prepare a notification of classification of permanent reserved forest or part thereof for the purpose of publication in the Gazette.
(4)
Where the approval is not granted by the Minister, a permanent reserved forest shall be deemed to have been classified as timber production forest under sustained yield under paragraph 10(1)(a) of the Act.
Exchange of classification of permanent reserved forest 9.
(1)
Notwithstanding subrule 8(1), the classification of a permanent reserved forest or part thereof may be exchanged at any time.

(2)
For the purpose of subrule (1), the Director shall submit a written proposal to exchange the classification of a permanent reserved forest or part thereof together with a plan of area to indicate the boundaries of the area to the Minister for an approval.
(3)
Where the approval is granted by the Minister, the Director shall—
(a)
submit a copy of the approval together with a plan of area to indicate the boundaries of the area to the
Director of Survey and Mapping for the purpose of preparing the
Gazette plan; and
(b)
prepare a notification to change the classification of a permanent reserved forest or part thereof for the purpose of publication in the Gazette.
(4)
Where the approval is not granted by the Minister, the existing classification will be maintained.
Excision of area of land from permanent reserved forest 10.
(1)
Any area of land from a permanent reserved forest may be excised from the permanent reserved forest as specified in section 11 of the Act.
(2)
For the purpose of subrule (1), any written proposal to excise any area of land from a permanent reserved forest from any party shall be referred to the Director.
(3)
When received the proposal to excise any area of land from a permanent reserved forest, the Director shall—
(a)
refer the proposal to the relevant departments, agencies and other party for comment;
(b)
prepare a written report on the proposal together with a plan of area; and

(c)
submit the written report to the Minister for an approval.
(4)
Where the approval is granted by the Minister, the Director shall—
(a)
submit a copy of the approval together with a plan of area to indicate the external boundaries to to the
Director of Survey and Mapping for the purpose of preparing the
Gazette plan; and
(b)
prepare a notification to excise any area of land from the permanent reserved forest for the purpose of publication in the Gazette.
(5)
For the purpose of subrule (4), the Minister may grant an approval to the
Director to take forest produce in accordance with paragraph 16(a) of the Act before the excision of the land from the permanent reserved forest.
(6)
Where the approval is not granted by the Minister, the area of land will maintain as a permanent reserved forest.
Demarcation of new external boundaries for area of land excised from permanent reserved forest 11.
Upon the notification to excise any land from a permanent reserved forest is published in the Gazette, the Director shall commence the demarcation of the new external boundaries of the permanent reserved forest within the reasonable time.
Replacement of area of land excised from permanent reserved forest 12.
(1)
Any area of land which is excised from the permanent reserved forest shall be replaced as specified in section 12 of the Act.
(2)
The procedure specified in subrules 6(2), 6(3) and 6(4) shall apply for the replacement of any area of land which is excised from permanent reserved forest.

Demarcation of new external boundaries for area of land replaced as permanent reserved forest 13.
Upon the notification to replace any area of land as a permanent reserved forest is published in the Gazette, the Director shall commence the demarcation of the new external boundaries of the permanent reserved forest within the reasonable time.
Declaration of permanent reserved forest as open forest or closed forest 14.
(1)
A permanent reserved forest or part thereof may be declared as an open forest or a closed forest under section 45 of the Act.
(2)
For the purpose of subrule (1), the Director shall submit a written proposal to declare the permanent reserved forest or part thereof as an open forest or a closed forest together with a plan of area to indicate the boundaries of the area to the Minister for an approval.
(3)
Where the approval is granted by the Minister, the Director shall—
(a)
submit a copy of the approval together with a plan of area to indicate the boundaries of the area to the
Director of Survey and Mapping for the purpose of preparing the
Gazette plan; and
(b)
prepare a notification to declare a permanent reserved forest or part thereof as an open forest or a closed forest for the purpose of publication in the Gazette.
(4)
Where the approval is not granted by the Minister, a permanent reserved forest or part thereof shall be deemed as a closed forest.
Kindle any fire or commence open burning 15.
(1)
Any person who desires to kindle any fire or commence open burning for any purpose on State land or alienated land adjacent to any permanent reserved forest

which can endanger the permanent reserved forest, shall take any control measures to prevent the spreading of fires into a permanent reserved forest.
(2)
Any person who kindles fires or commence open burning under subrule (1) does not relieve him from compliance with other written law relating to the kindle a fire or open burning.
(3)
Any person who kindles fires on State land or alienated land adjacent to any permanent reserved forest and causing the fire spread into the permanent reserved forest commits an offence and shall, on conviction, be liable to a fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding five years or to both.
PART IV
CONTROL OF FOREST PRODUCE IN TRANSIT
Classification mark 16.
(1)
The following person shall register the classification mark with the Director:
(a)
the holder of the licence;
(b)
the holder of the minor licence;
(c)
the holder of the removal licence; or
(d)
the holder of the use permit which contains a provision permitting the taking of forest produce from the area specified in the permit.
(2)
The registration of a classification mark under subrule (1) shall be accompanied with the prescribed fee.

(3)
The registration of a classification mark shall valid for a term not exceeding twelve months from the date of registration and may be renewed within the period of three months before the expiry of the registration.
(4)
Notwithstanding subrule (3), the registration of the classification mark shall be revoked when the licence, minor licence, removal licence or use permit which contains a provision permitting the taking of forest produce from the area specified in the permit, for which the classification mark is registered, is expired or revoked by the Director.
(5)
Any holder of the licence, minor licence, removal licence or use permit which contains a provision permitting the taking of forest produce from the area specified in the permit, shall place the classification mark on timber which removed from the area of the licence, minor licence, removal licence or use permit which contains a provision permitting the taking of forest produce from the area specified in the permit.
(6)
Any person who contravenes subrule (1), commits an offence and shall, on conviction, be liable to a fine not exceeding twenty thousand ringgit.
Property mark 17.
(1)
The following person shall register the property mark with the Director:
(a)
the holder of the licence;
(b)
the holder of the minor licence;
(c)
the holder of the removal licence; or
(d)
the holder of the use permit which contains a provision permitting the taking of forest produce from the area specified in the permit.
(2)
The registration of a property mark under subrule (1) shall be accompanied with the prescribed fee.

(3)
The registration of a property mark shall valid for a period of not exceeding twelve months from the date of registration and may be renewed within the period of three months before the expiry of the registration.
(4)
Notwithstanding subrule (3), the registration of propterty mark shall be revoked when the licence, minor licence, removal licence or use permit which contains a provision permitting the taking of forest produce from the area specified in the permit, for which the property mark is registered, is expired or revoked by the Director.
(5)
Any holder of the licence, minor licence, removal licence or use permit which contains a provision permitting the taking of forest produce from the area specified in the permit, shall place the property mark on timber which removed from the area of the licence, minor licence, removal licence or use permit which contains a provision permitting the taking of forest produce from the area specified in the permit.
(6)
Any person who contravenes subrule (1), commits an offence and shall, on conviction, be liable to a fine not exceeding twenty thousand ringgit.
PART V
FOREST CHARGES AND FEES
Royalty 18.
(1)
All forest produce taken from the area of the licence, minor licence, removal licence or use permit which contains a provision permitting the taking of forest produce from the area specified in the permit, is subject to the payment of royalty.
(2)
The holder of the licence, minor licence, removal licence or use permit which contains a provision permitting the taking of forest produce from the area specified in the permit, shall pay the royalty to the Federal Government on any forest produce taken at the rate as prescribed in the Second Schedule.

Premium 19.
(1)
The holder of the licence, minor licence, removal licence or use permit which contains a provision permitting the taking of forest produce from the area specified in the permit, shall pay the premium to the Federal Goverment in addition to the royalty under rule 18 during the application of licence, minor licence, removal licence or use permit which contains a provision permitting the taking of forest produce from the area specified in the permit.
(2)
The premium charged on the forest produce shall be paid by the holder of the licence, minor licence, removal licence or use permit which contains a provision permitting the taking of forest produce from the area specified in the permit, at the rate as prescribed in the Third Schedule.
Assessment of forest produce 20.
(1)
All forest produce cut, collected or removed under licence, minor licence, removal licence or use permit which contains a provision permitting the taking of forest produce from the area specified in the permit, shall be brought to the forest produce checking station for measurement and assessment of royalty, premium, cess or other forest charges payable to the Federal Government.
(2)
The removal pass shall be issued on the forest produce which has been assessed under subrule (1).
Fees 21.
(1)
The fees relating to the licence and permit, harvesting and forest development activities shall be as prescribed in the Fourth Schedule.
(2)
Any fee payable under these Rules shall be paid to the Federal Government for the services in relation to forestry at the rates as prescribed in the Fourth Schedule.

PART VI
COMPOUNDING OF OFFENCES
Compoundable offences 22.
The offences specified in these Rules are prescribed to be compoundable offences.
Offer and acceptance of compound 23.
(1) An offer to compound an offence shall be made in Form A1 of the
First Schedule.
(2) A person who accepts an offer to compound a compundable offence shall accept the offer in Form A2 of the First Schedule.
Payment of compound 24.
(1)
If an offer to compound an offence is accepted by the person to whom the offer is made, he may pay the compound―
(a)
in cash; or
(b)
by money order, postal order, cheque or bank draft and crossed with the words ”Account Payee Only” payable to the Director.
(2)
The payment of compound shall be delivered personally or sent by prepaid registered post to the address specified in the Offer to Compound Offence.
(3)
The Director shall issue an official receipt for every payment received under subrule (1) to the person to whom the offer to compound is made.

PART VII
MISCELLANEOUS
Chapter 1 – Machinery
Registration of machinery 25.
(1)
Any holder of the licence, minor licence or use permit which contains a provision permitting the taking of forest produce from the area specified in the permit, which issued under the Act shall register machinery used in the activity of taking of forest produce with the Director.
(2)
The registration of the machinery under subrule (1) shall be accompanied with the prescribed fee.
(3)
The registration of the machinery shall valid for a term not exceeding twelve months from the date of registration and may be renewed wihin the period of three months before the expiry of the registration.
(4)
Any person who contravenes subrule (1), commits an offence and shall, on conviction, be liable to a fine not exceeding twenty thousand ringgit or to imprisonment for a term not exceeding three years or to both.
Revocation of registration of machinery 26.
The registration of any machinery shall be revoked when the licence, minor licence or use permit which contains a provision permitting the taking of forest produce from the area specified in the permit, which the machinery is registered, is expired or revoked by the Director.
Limitation of usage of registered machinery 27.
(1)
The machinery used in the activity of taking of forest produce may be registered for a licence, a minor licence or an use permit which contains a provision permitting the taking of forest produce from the area specified in the permit only, by

holder of the licence, minor licence or use permit which contains a provision permitting the taking of forest produce from the area specified in the permit.
(2)
Any person who contravenes subrule (1), commits an offence and shall, on conviction, be liable to a fine not exceeding twenty thousand ringgit or to imprisonment for a term not exceeding three years or to both.
Chapter 2 – Sawyer
Registration as sawyer 28.
(1)
Any person who desires to work as a sawyer in any area of the licence, minor licence or use permit which contains a provision permitting the taking of forest produce from the area specified in the permit, shall be registered with the Director as a sawyer.
(2)
For the purpose of registration under subrule (1), a person shall have a certificate of competence in tree cutting technique issued by the training institution under the Forestry Department of Peninsular Malaysia or any other qualification recognized by the Forestry Department of Peninsular Malaysia.
(3)
The registration as a sawyer under subrule (1) shall be accompanied with the prescribed fee.
(4)
When a person is registered as a sawyer, the Director shall issue a certificate of registration in Form B of the First Schedule.
(5)
The registration as a sawyer shall valid for a term not exceeding twelve months and may be renewed within the period of three months before the expiry of the registration.
Revocation of certificate of registration as sawyer 29.
The
Director may, by written notice to the sawyer, revoke the certificate of registration as a sawyer if the Director is satisfied that the sawyer had

contravened any condition imposed on the licence, minor licence or use permit which contains a provision permitting the taking of forest produce from the area specified in the permit, provisions of the Act or provisions of these Rules.
Chapter 3 – Contractor to take forest produce
Registration as contractor to take forest produce 30.
(1)
Any person who desires to acquire forest area for the purpose of taking of forest produce shall register with the Director as a contractor to take forest produce.
(2)
The registration as a contractor to take forest produce under subrule (1)
shall be accompanied with the prescribed fee.
(3)
When a person is registered as a a contractor to take forest produce, the Director shall issue a certificate of registration in Form C of the
First Schedule.
(4)
The registration as a contractor to take forest produce shall valid for a term not exceeding twelve months and may be renewed within the period of three months before the expiry of the registration.
Revocation of certificate of registration as contractor to take forest produce 31.
The Director may, by written notice to a contractor to take forest produce, revoke the certificate of registration as a contractor to take forest produce if the Director is satisfied that the contractor had contravened any condition imposed on the licence, minor licence or use permit which contains a provision permitting the taking of forest produce from the area specified in the permit, provisions of the Act or provisions of these Rules.

Chapter 4 –Contractor to take poles, firewood, rattan and any minor forest produce
Registration as contractor to take poles, firewood, rattan and any minor forest produce 32.
(1)
Any person who desires to acquire forest area for the purpose of taking the poles, firewood, rattan and any minor forest produce or to carry out the work of taking poles, firewood, rattan and any minor forest produce shall register with the Director as a contractor to take poles, firewood, rattan and any minor forest produce.
(2)
The registration as a contractor to take poles, firewood, rattan and any minor forest produce under subrule (1) shall be accompanied with the prescribed fee.
(3)
When a person is registered as a contractor to take poles, firewood, rattan and any minor forest produce, the Director shall issue a certificate of registration in
Form D of the First Schedule.
(4)
The registration as a contractor to take poles, firewood, rattan and any minor forest produce shall valid for a term not exceeding twelve months and may be renewed within the period of three months before the expiry of the registration.

The Director may, by written notice to a contractor to take poles, firewood, rattan and any minor forest produce, revoke the certificate of registration of any contractor to take poles, firewood, rattan and any minor forest produce if the Director is satisfied that the contractor had contravened any condition imposed on the licence, minor licence or use permit which contains a provision permitting the taking of forest produce from the area specified in the permit, provisions of the Act or provisions of these Rules.

Chapter 5– Sub-licence
Issuance of sub-licence 34.
(1)
The holder of a licence, minor licence or use permit which contains a provision permitting the taking of forest produce from the area specified in the permit which employs servants for the purpose of his licence, minor licence or use permit which contains a provision permitting the taking of forest produce from the area specified in the permit, shall apply to the Director to issue a sub-licence for each servant so employed according to the manner as determined by the Director.
(2)
Every application for sub-licence under subrule (1) shall be accompanied by the prescribed fee.
(3)
When the application for sub-licence is approved, the Director shall issue a sub-licence in Form E of the First Schedule.
(4)
The sub-licence issued under subrule (1) shall valid for a term not exceeding six months and may be renewed within the period of forteen days before the expiry of the validity of the sub-licence.
(5)
The Director may reject to renew a sub-licence if the Director satisfied that the holder of the sub-licence has contravened any condition imposed on the licence, minor licence or use permit which contains a provision permitting the taking of forest produce from the area specified in the permit, provisions of the Act or provisions of these Rules.
(6)
Any person who contravenes subrule (1), commits an offence and shall, on conviction, be liable to a fine not exceeding twenty thousand ringgit or to imprisonment for a term not exceeding three years or to both.
Inspection of sub-licence 35.
(1)
Any holder of the sub-licence issued under subrule 34(1) shall present the sub-licence to any forest officer at any time for an inspection.

Any person who contravenes subrule (1), commits an offence and shall, on conviction, be liable to a fine not exceeding ten thousand ringgit
Revocation of sub-licence 36.
(1)
The Director may, by written notice to the holder of the sub-licence and the holder of the licence, minor licence or use permit which contains a provision permitting the taking of forest produce from the area specified in the permit, revoke the sub-licence if the Director is satisfied that the holder of the sub-licence has contravened any condition imposed in the licence, minor licence or use permit which contains a provision permitting the taking of forest produce from the area specified in the permit, provisions of the Act or provisions of these Rules.
(2)
A sub-licence shall be revoked when the licence, minor licence or use permit which contains a provision permitting the taking of forest produce from the area specified in the permit which the sub-licence is issued, is expired or revoked by the Director.
(3)
Where the sub-licence is revoked, the Director shall order any work permitted under the licence, minor licence or use permit which contains a provision permitting the taking of forest produce from the area specified in the permit, to be discontinued fortwith.
