Peguam Cara (Penguatkuasaan) (Pindaan) 2024.

Kaedah-Kaedah Saraan Peguam Cara (Penguatkuasaan) 2016 [P.U. (A) 340/2016], yang disebut “Kaedah-Kaedah ibu” dalam Kaedah-Kaedah ini, dipinda—

dengan subkaedah yang berikut:

“(2)

Tanda

“tiada diskaun”

hendaklah mengandungi perkataan yang berikut:

“Tiada diskaun ke atas fi yang dinyatakan dalam Susunan B

Jadual Pertama, Jadual Kedua, Susunan B Jadual Ketiga,

Jadual Keempat, Jadual Kelima dan Jadual Keenam kepada

Perintah Saraan Peguam Cara 2023 [P.U. (A) 207/2023]”.”.

Pindaan Jadual 5.

Kaedah-Kaedah ibu dipinda dalam Jadual—

dalam tajuk, dengan menggantikan perkataan

“PERINTAH SARAAN PEGUAM CARA 2005” dengan perkataan

SOLICITORS’ REMUNERATION (ENFORCEMENT) (AMENDMENT) RULES 2024

IN exercise of the powers conferred by section 77 of the Legal Profession Act 1976

[Act 166], the Bar Council, with the approval of the Attorney General, makes the following rules:

Citation 1.

These rules may be cited as the Solicitors’ Remuneration (Enforcement)

(Amendment) Rules 2024.

General amendment 2.

The Solicitors’ Remuneration (Enforcement) Rules 2016 [P.U. (A) 340/2016], which are referred to as the “principal Rules” in these Rules, are amended—

(a)

in the national language text, by substituting for the words “Bar Malaysia”

wherever appearing the words “Badan Peguam Malaysia”; and

(b)

by substituting for the words

“Bar

Council

Malaysia,

No. 15 Leboh Pasar Besar, 50050 Kuala Lumpur” wherever appearing the words

“Bar

Council,

Wisma

Badan

Peguam

Malaysia,

Amendment of rule 2 3.

Rule 2 of the principal Rules is amended—

(a)

in the definition of “non-contentious business”, by substituting for the words “Solicitors’ Remuneration Order 2005 [P.U. (A) 520/2005]”

the words “Solicitors’ Remuneration Order 2023 [P.U. (A) 207/2023]”; and

(b)

in the definition of

“scale or fixed fee”, by substituting for the words “Solicitors’ Remuneration Order 2005” the words

“Solicitors’ Remuneration Order 2023”.

Amendment of rule 3 4.

Rule 3 of the principal Rules is amended by substituting for subrule (2)

the following subrule:

“(2)

The “no discount” signage shall contain the following words:

“There shall be no discount on the fee specified in Table B of the First Schedule, the Second Schedule, Table B of the Third Schedule, the Fourth Schedule, the Fifth Schedule and the Sixth Schedule to the Solicitors’ Remuneration

Order 2023 [P.U. (A) 207/2023]”.”.

Amendment of Schedule 5.

The pricipal Rules are amended in the Schedule—

(a)

in Form A—

(i)

in the title, by substituting for the words

“SOLICITORS’

REMUNERATION

ORDER

2005”

the words

“SOLICITORS’ REMUNERATION ORDER 2023”; and

(ii)

by substituting for the words

“Bar

the words “Bar Council”;

(b)

in Form B, in paragraph 1, by substituting for the words “Form B”

(c)

in Form C—

(i)

by substituting for the words “Form A” wherever appearing the words “Form B”; and

OF THE RETURN AND TYPE OF DOCUMENTS TO BE ENCLOSED

WITH THE RETURN, in the fourth item, by substituting for the words “Form 34” the words “registration of charges under sections 352, 354 and 356 of the Companies Act 2016 [Act 777]”.
