⎯(1) If it is necessary to remove or destroy any trees, fences, crops or other property of value in order to clear any line, the
Surveyor or Settlement Officer shall assess the value of the same, and shall pay or tender the amount so assessed to the proprietor thereof:
Provided that the assessment shall be made before the property is removed or destroyed.
(2)
Any dispute regarding the sufficiency of the amount so paid or tendered shall, unless the proprietor requires that it be referred to arbitration, be determined by the Superintendent whose decision shall be final.
