  1. WHEREAS by section 7 of the Christian Marriage Ordinance [Cap. 24.] the Governor is empowered to appoint one or more Christians either by name or as holding any office for the time being to be the Marriage Registrar or Marriage Registrars of the Colony or for any districts therein; AND WHEREAS the Governor pursuant to such power appointed the District Officers for the time being having jurisdiction over the districts of Beaufort, Tenom, Tuaran, Keningau, Papar, Labuan, Jesselton, Kota Belud, Kudat, Sandakan, Lahad Datu and Tawau and the Resident Tawau to be Marriage Registrars; AND WHEREAS certain persons holding such office but not being of the Christian faith have exercised the function of Marriage Registrars and, inter alia, solemnized marriages; AND WHEREAS doubts have arisen as to the validity of such marriages; FOR REFERENCE ONLY (July 2010) 2 NOW THEREFORE it is hereby enacted by the Governor of the Colony of North Borneo with the advice and consent of the Legislature Council as follows:- Short title.

Notwithstanding any provision to the contrary in the Christian Marriage Ordinance or any other written law all marriage ceremonies solemnized prior to the commencement of this Ordinance by and before a District Officer not of the Christian faith between persons believing such District Officer to be a duly appointed Marriage Registrar shall be deemed always to have been as valid as if they had been solemnized by and before a

Marriage Registrar of the Christian faith duly appointed under the Christian Marriage

Ordinance and all things done, certificates given and registrations made by any such

District Officer, not of the Christian faith, relating to such marriages shall be and shall be deemed always to have been as valid as if the same had been done, given and made by a Marriage Registrar of the Christian faith duly appointed under the said Ordinance.
