MODIFICATION OF LAWS (CENSUS) (MODIFICATION AND EXTENSION TO EAST MALAYSIA) ORDER 1969

This order may be cited as the Modification of Laws (Census) (Modification and Extension to East Malaysia) Order, 1969.

The Census Act, 1960 (hereinafter referred to as the Act), is hereby modified in the manner set out in the Schedule to this Order.

The Act as modified by Article 2 is hereby extended to Sabah and Sarawak.

The Census Ordinances of Sabah and Sarawak are hereby repealed.

(Article 2).

Section Modification

2, definition of "census officer"

1. For "section 4" substitute "this Act".

2. After "Assistant Commissioner," insert "District Superintendent,".

3, 4 (1), 15 (1)

For "the Federation" substitute "Malaysia".

3 ... ... Add the following at the end:

“, and may by that order or, if that is not practicable, by notification in the Gazette appoint a Commissioner to supervise the taking of the census”.

4 (1), 6 (1) ... For "Yang di-Pertuan Agong" substitute "Minister".

4 (1) ... ... 1. Omit "a Commissioner and".

2. For "and Assistant Commissioners" substitute ", Assistant Commissioners, District Superintendents and committees as he may deem expedient".

4 (2) ... ... After "Assistant Commissioner," insert "any District Superintendent,".

4 (3), (4) ... Omit sub-section (3) and re-number sub-section (4) as (3).

5 (1) ... ... After "Assistant Commissioner" insert ", District Superintendent".

6 (1) ... ... Re-number paragraphs (b), (c), (d) and (e) as (c), (d), (e) and (f) respectively and insert the following as paragraph (b):

“(b) the functions of any committee appointed under section 4 (1);”

9 (2), (4), 10, 12, 14 After "Assistant Commissioner" insert "or District Superintendent".

10 (1) (a) ... After "work-house" insert ", place of detention".

13 ... ... For "or by an Assistant Commissioner" substitute ", an Assistant Commissioner or by a District Superintendent".

16 (1) (a) ... For "or an Assistant Commissioner" substitute ", an Assistant Commissioner or a District Superintendent".

16 (2) ... ... For "Any census officer" substitute "Any member of committee appointed under section 4 (1), any census officer".
