Preamble
- BAHAWASANYA, melalui Perintah Koperasi (Pengambilalihan Kawalan Koperasi Serbausaha Makmur Berhad) (Pelantikan) 2020 [P.U. (A) 317/2020] yang disiarkan dalam Warta pada 6 November 2020, Suruhanjaya Koperasi Malaysia telah melantik Zahari bin Abdul Aziz untuk mengambil alih kawalan semua harta, urusan, aktiviti dan hal ehwal Koperasi Serbausaha Makmur Berhad, dan menjalankan kesemua urusan, aktiviti dan hal ehwal Koperasi itu bagi tempoh mulai 11 November 2020 hingga 10 November 2022 atau sehingga suatu Lembaga baharu dipilih di bawah undang-undang kecil Koperasi itu, mengikut mana-mana yang terdahulu: DAN BAHAWASANYA, melalui Perintah Koperasi (Pengambilalihan Kawalan Koperasi Serbausaha Makmur Berhad) (Pembatalan Pelantikan) 2021 [P.U. (A) 58/2021] yang disiarkan dalam Warta pada 15 Februari 2021, Suruhanjaya Koperasi Malaysia telah membatalkan pelantikan Zahari bin Abdul Aziz berkuat kuasa pada 16 Februari 2021: DAN BAHAWASANYA, melalui Perintah Koperasi (Pengambilalihan Kawalan Koperasi Serbausaha Makmur Berhad) (Pelantikan) 2021 [P.U. (A) 136/2021] yang disiarkan dalam Warta pada 25 Mac 2021, Suruhanjaya Koperasi Malaysia telah melantik Zahari bin Abdul Aziz untuk mengambil alih kawalan semua harta, urusan, aktiviti dan hal ehwal Koperasi Serbausaha Makmur Berhad, dan menjalankan kesemua urusan, aktiviti dan hal ehwal Koperasi itu bagi tempoh mulai 26 Mac 2021 hingga 25 Mac 2023 atau sehingga suatu Lembaga baharu dipilih di bawah undang-undang kecil Koperasi itu, mengikut mana-mana yang terdahulu: DAN BAHAWASANYA, melalui Perintah Koperasi (Pengambilalihan Kawalan Koperasi Serbausaha Makmur Berhad) (Pelantikan) 2023 [P.U. (A) 107/2023] yang disiarkan dalam Warta pada 3 April 2023, Suruhanjaya Koperasi Malaysia telah melantik Dato’ Haji Zazali bin Haron untuk mengambil alih kawalan semua harta, urusan, aktiviti dan hal ehwal Koperasi Serbausaha Makmur Berhad, dan menjalankan kesemua urusan, P.U. (B) 570 3 aktiviti dan hal ehwal Koperasi itu bagi tempoh mulai 26 Mac 2023 hingga 25 Mac 2024 atau sehingga suatu Lembaga baharu dipilih di bawah undang-undang kecil Koperasi itu, mengikut mana-mana yang terdahulu: DAN BAHAWASANYA, Suruhanjaya Koperasi Malaysia telah mengadakan mesyuarat agung tahunan Koperasi Serbausaha Makmur Berhad pada 24 Jun 2023 dan sebelas anggota Lembaga baharu telah dipilih dengan sewajarnya pada mesyuarat agung tahunan itu: MAKA OLEH YANG DEMIKIAN, Suruhanjaya Koperasi Malaysia memberikan notis di bawah subseksyen 69D(4) Akta Koperasi 1993 [Akta 502] bahawa pengambilalihan kawalan semua harta, urusan, aktiviti dan hal ehwal Koperasi Serbausaha Makmur Berhad yang dibuat di bawah subseksyen 69(2) dan 69A(2) Akta telah ditamatkan pada 24 Jun 2023, dan Suruhanjaya Koperasi Malaysia menyerahkan semua harta, urusan, aktiviti dan hal ehwal Koperasi Serbausaha Makmur Berhad kepada Lembaga baharu yang dipilih. - WHEREAS, by the Co-operative Societies (Assumption of Control of Koperasi Serbausaha Makmur Berhad) (Appointment) Order 2020 [P.U. (A) 317/2020] published in the Gazette on 6 November 2020, the Malaysia Co-operative Societies Commission has appointed Zahari bin Abdul Aziz to assume control of the whole of the property, business, activities and affairs of the Koperasi Serbausaha Makmur Berhad, and carry on the whole of its business, activities and affairs for the period from 11 November 2020 until 10 November 2022 or until a new Board is elected under the by-laws of the Koperasi, whichever is earlier: AND WHEREAS, by the Co-operative Societies (Assumption of Control of Koperasi Serbausaha Makmur Berhad) (Revocation of Appointment) Order 2021 [P.U. (A) 58/2021] published in the Gazette on 15 February 2021, the Malaysia Co-operative Societies Commission has revoked the appointment of Zahari bin Abdul Aziz with effect on 16 February 2021: AND WHEREAS, by the Co-operative Societies (Assumption of Control of Koperasi Serbausaha Makmur Berhad) (Appointment) Order 2021 [P.U. (A) 136/2021] published in the Gazette on 25 March 2021, the Malaysia Co-operative Societies Commission has appointed Zahari bin Abdul Aziz to assume control of the whole of the property, business, activities and affairs of the Koperasi Serbausaha Makmur Berhad, and carry on the whole of its business, activities and affairs for the period from 26 March 2021 until 25 March 2023 or until a new Board is elected under the by-laws of the Koperasi, whichever is earlier: AND WHEREAS, by the Co-operative Societies (Assumption of Control of Koperasi Serbausaha Makmur Berhad) (Appointment) Order 2023 [P.U. (A) 107/2023] published in the Gazette on 3 April 2023, the Malaysia Co-operative Societies Commission has appointed Dato’ Haji Zazali bin Haron to assume control of the whole of the property, business, activities and affairs of the Koperasi Serbausaha Makmur Berhad, and P.U. (B) 570 5 carry on the whole of its business, activities and affairs for the period from 26 March 2023 to 25 March 2024 or until a new Board is elected under the by-laws of the Koperasi, whichever is earlier: AND WHEREAS, the Malaysia Co-operative Societies Commission has held an annual general meeting of the Koperasi Serbausaha Makmur Berhad on 24 June 2023 and eleven new Board members have been duly elected at the annual general meeting: NOW THEREFORE, the Malaysia Co-operative Societies Commission gives notice under subsection 69D(4) of the Co-operative Societies Act 1993 [Act 502] that the assumption of control of the whole of the property, business, activities and affairs of the Koperasi Serbausaha Makmur Berhad made under subsections 69(2) and 69A(2) of the Act has been terminated on 24 June 2023, and the Malaysia Co-operative Societies Commission submits the whole of the property, business, activities and affairs of the Koperasi Serbausaha Makmur Berhad to the newly elected Board.
