PEMBATALAN PERIZABAN TANAH BAGI MAKSUD AWAM

Opening note

Preamble

BAHAWASANYA, melalui Pemberitahuan No. 136/1908 yang disiarkan dalam Warta Kerajaan Selangor pada 28 Februari 1908, Residen British pada menjalankan kuasa yang terletakhak padanya oleh seksyen 8 Enakmen Tanah 1903 telah mengisytiharkan bahawa petak tanah iaitu No. Lot 12, seksyen 60 yang terletak dalam Bandar Kuala Lumpur, seluas 54 ekar dan ditandakan di atas pelan ukur hasil No. G. 22 yang disimpan di Pejabat Penguasa Ukur Hasil Wilayah Persekutuan Kuala Lumpur, menjadi suatu rizab bagi maksud simpanan bekalan air yang disenggarakan oleh pegawai yang dilantik pada masa itu untuk menjalankan tugas Jurutera Negeri, Selangor: DAN BAHAWASANYA, melalui P.U. (B) 108/2003 yang disiarkan dalam Warta Kerajaan Persekutuan pada 3 Mac 2003, Kerajaan Persekutuan telah mewakilkan penjalanan kuasanya di bawah seksyen 64 Kanun Tanah Negara [Akta 56/1965] kepada Jawatankuasa Kerja Tanah Wilayah Persekutuan Kuala Lumpur: DAN BAHAWASANYA, adalah didapati suai manfaat sekarang oleh Jawatankuasa Kerja Tanah Wilayah Persekutuan Kuala Lumpur bahawa perizaban yang disebut terdahulu itu dibatalkan setakat keluasan yang diperihalkan dalam Jadual: DAN BAHAWASANYA, notis mengenai cadangan untuk membatalkan sebahagian perizaban yang disebut terdahulu itu setakat keluasan yang diperihalkan dalam Jadual berserta dengan butir-butir mengenai masa dan tempat di mana suatu siasatan akan diadakan oleh Pentadbir Tanah Wilayah Persekutuan Kuala Lumpur di Pejabat Pengarah Tanah dan Galian Wilayah Persekutuan Kuala Lumpur, untuk mendengar mana-mana orang yang berhasrat untuk membantah terhadap pembatalan itu telah ditampalkan mengikut peruntukan seksyen 433 Kanun Tanah Negara dan juga telah disiarkan dalam Warta Kerajaan Persekutuan sebagai P.U. (B) 498/2010 pada 11 November 2010: P.U. (B) 267 3 DAN BAHAWASANYA, tiada apa-apa bantahan diterima terhadap cadangan untuk membatalkan sebahagian perizaban yang disebut terdahulu itu setakat keluasan yang diperihalkan dalam Jadual: MAKA OLEH YANG DEMIKIAN, Jawatankuasa Kerja Tanah Wilayah Persekutuan Kuala Lumpur pada menjalankan kuasa di bawah seksyen 64 Kanun Tanah Negara yang diberikan kepada Kerajaan Persekutuan dan yang diwakilkan kepadanya sebagaimana yang disebut terdahulu membatalkan perizaban tanah yang disebut terdahulu itu setakat keluasan yang diperihalkan dalam Jadual.

NATIONAL LAND CODE

REVOCATION OF RESERVATION OF LAND FOR PUBLIC PURPOSE

WHEREAS, by

Notification No.

136/1908 published in the Selangor Government

Gazette on 28 February 1908, the British Resident, in exercise of the powers vested in him by section 8 of the Land Enactment 1903, has proclaimed that the parcel of land, to wit being Lot No. 12, section 60 situated in the Town of Kuala Lumpur, having an area of 54 acres and delineated upon revenue survey plan No. G. 22 which is now deposited in the office of the Superintendent of Revenue Surveys of the Federal Territory of Kuala

Lumpur, to be a reserve for the purpose of a public waterworks reservoir to be maintained by the officer for the time being holding the appointment of State Engineer, Selangor:

AND WHEREAS, by P.U. (B) 108/2003 published in the Gazette of the Government of the Federation on 3 March 2003, the Government of the Federation has delegated the exercise of its powers under section 64 of the National Land Code [Act 56/1965] to the

Land Executive Committee of the Federal Territory of Kuala Lumpur:

AND WHEREAS, it now appears expedient to the Land Executive Committee of the

Federal Territory of Kuala Lumpur that the part of the aforesaid reservation be revoked to the extent of the area described in the Schedule:

AND WHEREAS, notice of the proposal to revoke the part of the aforesaid reservation to the extent of the area described in the Schedule together with details of the time and place at which an enquiry would be held by the Land Administrator of the Federal

Territory of Kuala Lumpur at the Office of Director of Lands and Mines of the Federal

Territory of Kuala Lumpur, to hear any person desiring to object to such revocation was affixed in accordance with provisions of section 433 of the National Land Code and was also published in the Gazette of the Government of the Federation as P.U. (B) 498/2010 on 11 November 2010:

AND WHEREAS, no objection to the proposal to revoke the part of the aforesaid reservation to the extent of the area described in the Schedule was received:

NOW THEREFORE, the Land Executive Committee of the Federal Territory of Kuala

Lumpur, in exercise of the powers under section 64 of the National Land Code conferred upon the Government of the Federation and delegated to it as aforesaid, revokes part of the reservation of the land described in the Schedule.
