Opening note

Preamble

BAHAWASANYA, melalui Pemberitahuan No. 500/1955 yang disiarkan dalam Warta Kerajaan Selangor pada 22 September 1955, pada menjalankan kuasa yang diberikan kepada Raja dalam Mesyuarat oleh seksyen 24(i) Kanun Tanah 1926 [No. 24/1926] dan diwakilkan kepadanya, melalui Warta Kerajaan Negeri Selangor P.W. Sel. 188/1952, Menteri Besar, Selangor, telah mengisytiharkan bahawa petak tanah iaitu No. Lot 172 yang terletak di dalam Seksyen 95 Bandar Kuala Lumpur, seluas 6 ekar 2 rud 8 pol dan ditandakan di atas pelan ukur hasil No. 21518 yang sekarang disimpan di Pejabat Pengarah Ukur dan Pemetaan, Selangor, menjadi suatu rizab bagi maksud awam, iaitu suatu tapak untuk kawasan lapang hendaklah disenggarakan oleh Presiden, Majlis Perbandaran Kuala Lumpur (sekarang digelar Dato’ Bandar Kuala Lumpur): DAN BAHAWASANYA, melalui P.U. (B) 108/2003 yang disiarkan dalam Warta Kerajaan Persekutuan pada 3 Mac 2003, Kerajaan Persekutuan telah mewakilkan penjalanan kuasanya di bawah seksyen 64 Kanun Tanah Negara [Akta 56/1965] kepada Jawatankuasa Kerja Tanah Wilayah Persekutuan Kuala Lumpur: DAN BAHAWASANYA, adalah didapati suai manfaat sekarang oleh Jawatankuasa Kerja Tanah Wilayah Persekutuan Kuala Lumpur supaya sebahagian perizaban yang disebut terdahulu itu dibatalkan: DAN BAHAWASANYA, notis mengenai cadangan untuk membatalkan sebahagian perizaban yang disebut terdahulu itu yang diperihalkan dalam Jadual berserta dengan butir-butir mengenai masa dan tempat di mana suatu siasatan akan diadakan oleh Pentadbir Tanah Wilayah Persekutuan Kuala Lumpur di Pejabat Pengarah Tanah dan Galian Wilayah Persekutuan Kuala Lumpur, untuk mendengar mana-mana orang yang berhasrat untuk membantah terhadap pembatalan itu telah ditampalkan mengikut P.U. (B) 268 3 peruntukan seksyen 433 Kanun Tanah Negara dan juga telah disiarkan dalam Warta Kerajaan Persekutuan sebagai P.U. (B) 502/2010 pada 18 November 2010: DAN BAHAWASANYA, tiada apa-apa bantahan diterima terhadap cadangan untuk membatalkan sebahagian perizaban yang disebut terdahulu itu yang diperihalkan dalam Jadual: MAKA OLEH YANG DEMIKIAN, Jawatankuasa Kerja Tanah Wilayah Persekutuan Kuala Lumpur pada menjalankan kuasa di bawah seksyen 64 Kanun Tanah Negara yang diberikan kepada Kerajaan Persekutuan dan yang diwakilkan kepadanya sebagaimana yang disebut terdahulu membatalkan perizaban tanah yang diperihalkan dalam Jadual.

NATIONAL LAND CODE

REVOCATION OF RESERVATION OF LAND FOR PUBLIC PURPOSE

WHEREAS, by

Notification No. 500/1955

published in the Selangor Government

Gazette on 22 September 1955, in exercise of the powers conferred upon the

Ruler in Council by section 24(i) of the Land Code 1926 [No. 24/1962], and delegated to him vide Selangor Government Gazette, P.W. Sel. 188/1952, the Menteri Besar,

Selangor, has proclaimed that the parcel of land being Lot No. 172 situated in the

Section 95 Town of Kuala Lumpur, having an area of 6 acres 2 roods 8 poles and delineated upon revenue survey plan No. 21518 which is now deposited in the office of the Director of

Survey and Mapping, Selangor, to be a reserve for public purpose, to wit, a site for open space to be maintained by the President, Municipal Council Kuala Lumpur (now known as the Dato’ Bandar Kuala Lumpur):

AND WHEREAS, by P.U. (B) 108/2003 published in the Gazette of the Government of the Federation on 3 March 2003, the Government of the Federation has delegated the exercise of its powers under section 64 of the National Land Code [Act 56/1965] to the

Land Executive Committee of the Federal Territory of Kuala Lumpur:

AND WHEREAS, it now appears expedient to the Land Executive Committee of the

Federal Territory of Kuala Lumpur that the part of the aforesaid reservation be revoked:

AND WHEREAS, notice of the proposal to revoke the part of the aforesaid reservation as described in the Schedule together with details of the time and place at which an enquiry would be held by the Land Administrator of the Federal Territory of

Kuala Lumpur at the Office of Director of Lands and Mines of the Federal Territory of Kuala

Lumpur, to hear any person desiring to object to such revocation was affixed in accordance with provisions of section 433 of the National Land Code and was also published in the

Gazette of the Government of the Federation as P.U. (B) 502/2010 on 18 November 2010:

AND WHEREAS, no objection to the proposal to revoke the part of the aforesaid reservation as described in the Schedule was received:

NOW THEREFORE, the Land Executive Committee of the Federal Territory of Kuala

Lumpur, in exercise of the powers under section 64 of the National Land Code conferred upon the Government of the Federation and delegated to it as aforesaid, revokes the reservation of the land described in the Schedule.
