PENGECUALIAN DI BAWAH SUBSEKSYEN 2A(2)

PADA menjalankan kuasa yang diberikan oleh subseksyen 2A(2)

Akta Pemberi Pinjam Wang 1951 [Akta 400], Menteri mengecualikan syarikat yang dinamakan dalam Jadual daripada kuat kuasa Akta ini bagi tempoh empat tahun berkuat kuasa mulai tarikh penyiaran pemberitahuan ini dalam Warta dengan syarat bahawa—

syarikat itu ialah pemegang lesen pemberi pinjam wang yang sah;

faedah bagi pinjaman bercagar syarikat itu tidak boleh melebihi dua belas peratus setahun dan faedah bagi pinjaman tanpa cagaran syarikat itu tidak boleh melebihi lapan belas peratus setahun; dan

syarikat itu hendaklah, tidak lewat dari 1 Februari setiap tahun, mengemukakan kepada Menteri suatu penyata rekod mengenai transaksi pemberian pinjaman wangnya dalam apa-apa bentuk dan mengandungi apa-apa maklumat sebagaimana yang ditentukan oleh Pendaftar.

IN exercise of the powers conferred by subsection 2A(2)

of the

Moneylenders Act 1951 [Act 400], the Minister exempts the companies named in the

Schedule from the operation of the Act for a period of four years with effect from the date of publication of this notification in the Gazette provided that—

the companies are the holders of a valid moneylender licence;

the interest for a secured loan of the companies shall not exceed twelve per centum per annum and the interest for unsecured loan of the companies shall not exceed eighteen per centum per annum; and

the companies shall, not later than 1 February of each year, submit to the Minister a statement of records of its money lending transactions in such form and containing such information as determined by the Registrar.
