Preamble

PADA menjalankan kuasa yang diberikan oleh subseksyen 2A(2) Akta Pemberi Pinjam Wang 1951 [Akta 400], Menteri mengecualikan syarikat yang dinamakan dalam Jadual daripada kuat kuasa seksyen 16 Akta bagi tempoh lima belas tahun berkuat kuasa mulai tarikh penyiaran pemberitahuan ini dalam Warta dengan syarat bahawa—

(a)

pengecualian ini hanya terpakai bagi transaksi pemberian pinjaman wang secara dalam talian;

(b)

pengecualian ini hanya terpakai jika pemegang lesen memegang lesen yang sah;

(c)

suatu salinan perjanjian pemberian pinjaman wang yang tidak disetemkan yang telah ditandatangani dengan sewajarnya oleh semua pihak kepada perjanjian itu hendaklah diserahkan kepada peminjam dengan cara elektronik sebelum wang itu dipinjamkan; dan

(d)

suatu salinan perjanjian pemberian pinjaman wang yang telah disetemkan yang telah ditandatangani dengan sewajarnya oleh semua pihak kepada perjanjian itu hendaklah diserahkan kepada peminjam dengan cara elektronik dalam tempoh tiga puluh hari selepas tarikh perjanjian itu ditandatangani.

EXEMPTION UNDER SUBSECTION 2A(2)

Preamble

IN exercise of the powers conferred by subsection 2A(2) of the Moneylenders Act 1951 [Act 400], the Minister exempts the companies named in the Schedule from the operation of section 16 of the Act for a period of fifteen years with effect from the date of publication of this notification in the Gazette provided that—

(a)

the exemption is only applicable to online moneylending transactions;

(b)

this exemption is applicable only if the licensee holds a valid licence;

(c)

an unstamped copy of the moneylending agreement duly signed by all parties to the agreement shall be delivered to the borrower via electronic means before the money is lent; and

(d)

a stamped copy of the moneylending agreement duly signed by all parties to the agreement shall be delivered to the borrower via electronic means within a period of thirty days after the date of signing of the agreement.
