IMMIGRATION ACT 1959/63

IMMIGRATION (AMENDMENT) REGULATIONS 2018

IN exercise of the powers conferred by section 54

of the

Immigration Act 1959/63 [Act 155], the Minister, with the concurrence of the

Chief Ministers of Sabah and of Sarawak, makes the following regulations:

Citation and commencement 1.

(1)

These regulations may be cited as the Immigration (Amendment)

Regulations 2018.

(2)

These Regulations come into operation on 23 February 2018.

Amendment of regulation 9 2.

The Immigration Regulations 1963 [L.N. 228/1963], which are referred to as

“the principal Regulations” in these Regulations, are amended in regulation 9

by substituting for subregulation (8) the following subregulation:

“(8)

An Employment Pass shall be—

(a)

in the form of an endorsement as specified in Form 9 of the Second Schedule on the passport of the holder of the Employment Pass; and

(b)

in the form of a card as specified in Form 9A for Peninsular

Malaysia, Form 9B for Sabah and Form 9C for Sarawak.”.

Amendment of regulation 10 3.

Regulation 10 of the principal Regulations is amended by substituting for subregulation (8) the following subregulation:

“(8)

A Dependant’s Pass shall be—

(a)

in the form of an endorsement as specified in Form 11 of the

Second Schedule on the passport of the holder of the

Dependant’s Pass; and

(b)

in the form of a card as specified in Form 11A for

Peninsular Malaysia, Form 11B for Sabah and Form 11C for

Sarawak.”.

Amendment of regulation 11 4.

Regulation 11 of the principal Regulations is amended by substituting for subregulation (10) the following subregulation:

“(10) A Visit Pass shall be—

(a)

in the form of an endorsement as specified in Form 13 of the

Second Schedule on the passport of the holder of the Visit Pass; and

(b)

in the form of a card as specified in Form 13A for Peninsular

Malaysia, Form 13B for Sabah and Form 13C for Sarawak.”.

Amendment of regulation 13 5.

Regulation 13 of the principal Regulations is amended—

(a)

by substituting for subregulation (3) the following subregulation:

“(3)

A Student’s Pass shall be—

(a)

in the form of an endorsement as specified in

Form 15 of the Second Schedule on the passport of the holder of the Student’s Pass; and

(b)

in the form of a card as specified in Form 15A for

Peninsular Malaysia, Form 15B for Sabah and

Form 15C for Sarawak.”; and

(b)

by inserting after subregulation (3) the following subregulation:

“(3A) A holder of the Student’s Pass shall be entitled to enter

Peninsular Malaysia, Sabah and Sarawak and remain there for such period subject to the conditions as specified in the Student’s Pass.”.

Amendment of regulation 16 6.

Regulation 16 of the principal Regulations is amended by substituting for subregulation (7) the following subregulation:

“(7)

A Work Pass shall be—

(a)

in the form of an endorsement as specified in Form 18 of the Second Schedule on the passport of the holder of the

Work Pass; and

(b)

in the form of a card as specified in Form 18A of the

Second Schedule.”.

Amendment of regulation 16A

7.

Regulation 16A of the principal Regulations is amended by substituting for subregulation (8) the following subregulation:

“(8)

A Residence Pass shall be—

(a)

in the form of an endorsement as specified in Form 16B of the

Second Schedule on the passport of the holder of the Residence

Pass; and
