Pindaan peraturan 2

Peraturan-Peraturan Kawalan Hasil Tembakau 2004 [P.U. (A) 324/2004], yang disebut “Peraturan-Peraturan ibu” dalam Peraturan-Peraturan ini, dipinda dalam peraturan 2 dengan menggantikan takrif “tempat makan berhawa dingin” dengan takrif yang berikut:

‘ “tempat makan” ertinya mana-mana premis, sama ada di dalam atau di luar sesuatu bangunan, di mana makanan disediakan, dihidang atau dijual dan termasuklah —

(a)

mana-mana bilik atau kawasan di dalam sesuatu kapal atau kereta api di mana makanan disediakan, dihidang atau dijual;

(b)

mana-mana kawasan di dalam sesuatu kenderaan di mana makanan disediakan, dihidang atau dijual, dan mana-mana kawasan sekitar dalam lingkungan jarak tiga meter dari kenderaan itu; dan

(c)

mana-mana kawasan dalam lingkungan jarak tiga meter dari mana-mana meja atau kerusi yang diletakkan bagi tujuan untuk menyediakan, menghidangkan atau menjual makanan;’.

Pindaan peraturan 11

Subperaturan 11(1) Peraturan-Peraturan ibu dipinda dengan menggantikan perenggan (d) dengan perenggan yang berikut:

“(d)

dalam mana-mana tempat makan atau kedai berhawa dingin;”.

FOOD ACT 1983

CONTROL OF TOBACCO PRODUCT (AMENDMENT) REGULATIONS 2018

  1. IN exercise of the powers conferred by section 36 of the Food Act 1983 [Act 281], the Minister makes the following regulations: Citation and commencement 1.

(1)

These regulations may be cited as the Control of Tobacco Product

(Amendment) Regulations 2018.

These Regulations come into operation on 1 January 2019.

Amendment of regulation 2 2.

The Control of Tobacco Product Regulations 2004 [P.U. (A) 324/2004], which are referred to as the “principal Regulations” in these Regulations, are amended in regulation 2 by substituting for the definition of “air-conditioned eating place” with the following definition:

‘ “eating place” means any premises whether inside or outside building, where food is prepared, served or sold and includes —

(a)

any room or area on a ship or train where food is prepared, served or sold;

any area on a vehicle where food is prepared, served or sold, and any surrounding area within a radius of three meters from the vehicle; and

(c)

any area within a radius of three meters from any table or chair which is placed for the purposes of preparing, serving or selling food;’.

Amendment of regulation 11 3.

Subregulation 11(1) of the principal Regulations is amended by substituting for paragraph (d) the following paragraph:

“(d)

in any eating place or air-conditined shop;”.
