FOOD ACT 1983

FOOD HYGIENE (AMENDMENT) REGULATIONS 2026

IN exercise of the powers conferred by section 34 of the Food Act 1983 [Act 281], the Minister makes the following regulations:

Citation and commencement 1.

(1)

These regulations may be cited as the Food Hygiene (Amendment)

Regulations 2026.

(2)

These Regulations come into operation on 1 December 2026.

Amendment of regulation 2 2.

The Food Hygiene Regulations 2009 [P.U. (A) 95/2009], which are referred to as the “principal Regulations” in these Regulations, are amended in regulation 2

by inserting after the definition of “perishable food” the following definition:

“low acid canned food” means any food with a pH value greater than 4.6

and a water activity (aw) value greater than 0.85—

(a)

which is not an alcoholic beverage;

(b)

which is commercially sterile; and

(c)

which is packaged in a hermetically sealed container;’.

Amendment of regulation 11 3.

Subregulation 11(1) of the principal Regulations is amended—

(a)

in paragraph (b), by deleting the words “and has been medically examine”;

and

(b)

in paragraph (c), by deleting the words “, medical examination”.

Amendment of regulation 23 4.

Regulation 23 of the principal Regulations is amended by substituting for paragraph (b) the following paragraph:

“(b)

of smooth and non-absorbent surface.”.

Amendment of regulation 29 5.

Subregulation 29(2) of the principal Regulations is amended by substituting for the words “the main outlet drain” the words “the sewerage system”.

Amendment of heading of Chapter 1 of Part IV

The principal Regulations are amended in the heading of Chapter 1 of Part IV by deleting the words “medical examination and”.

Amendment of regulation 30 7.

Regulation 30 of the principal Regulations is amended by inserting after subregulation (2) the following subregulation:

“(2A)

Where a low-acid canned food is manufactured in food premises, at least one food handler in the food premises shall, in addition to complying with the requirements under subsection (1), have undergone a training on handling low-acid canned food and obtain a Certificate of Training in Handling Low Acid Canned Food from an institution approved by the Director.”.

New regulation 30A

The principal Regulations are amended by inserting after Regulation 30

the following regulation:

“Food service supervision training

30A. (1)

Any person who engages in or supervises mass catering of food shall undergo food service supervision training and obtain a Certificate of

Food Services Supervision Training from an institution established or recognised by the Ministry of Health.

(2)

Any person who fails to comply with subsection (1) commits an offence and shall, on conviction, be liable to a fine not exceeding ten thousand ringgit or to imprisonment for a term not exceeding two years.”.

Amendment of regulation 31 9.

Regulation 31 of the principal Regulations is amended—

(a)

by substituting for the shoulder note the following shoulder note:

“Health condition of food handler”; and

(b)

in subregulation (1) by deleting the words “medically examined and”.

Amendment of First Schedule 10.

The First Schedule to the principal Regulations is amended, in the national language text, in item 3, by substituting for the word “dan” the word “atau”.

Amendment of Forth Schedule 11.

The Forth Schedule to the principal Regulations is amended in item 7

by deleting the words “medical examination and”.
