PADA menjalankan kuasa yang diberikan oleh subseksyen 3(1) dan 4(1) dan seksyen 11 Akta Organisasi Antarabangsa (Keistimewaan dan Kekebalan) 1992 [Akta 485], Menteri, dengan persetujuan Menteri Kewangan, membuat peraturan-peraturan yang berikut: Nama

Seksyen 2

Tafsiran

“BWF” ertinya Persekutuan Badminton Dunia;

“Pegawai” ertinya pegawai, yang dinyatakan dalam Jadual, bagi Persekutuan

Badminton Dunia, bagi tujuan Pejabat;

“Pejabat” ertinya Ibu Pejabat BWF di Kuala Lumpur, Malaysia, untuk melaksanakan fungsinya.

Seksyen 3

Ketidakpakaian

Peraturan-Peraturan ini tidak terpakai bagi seseorang Pegawai yang merupakan warganegara dan penduduk tetap Malaysia termasuk pegawai tempatan dan ditugaskan mengikut kadar jam.

Seksyen 4

Pengisytiharan BWF sebagai organisasi antarabangsa

BWF diisytiharkan menjadi suatu organisasi antarabangsa yang baginya seksyen 4 Akta terpakai.

Keperibadian juridikal

(a)

untuk membuat kontrak;

(b)

untuk memperoleh dan melupuskan harta alih dan harta tak alih; dan

(c)

untuk memulakan dan menjadi pihak kepada prosiding undang-undang.

Keistimewaan BWF

Seksyen 6

(1)

BWF hendaklah mempunyai keistimewaan yang dinyatakan dalam perenggan 5, 6 dan 7 Jadual Pertama kepada Akta.

(2)

BWF hendaklah bekerjasama pada setiap masa dan hendaklah memastikan Pegawainya bekerjasama pada setiap masa dengan pihak berkuasa

Kerajaan Malaysia bagi melaksanakan pentadbiran keadilan sewajarnya, menjamin pematuhan undang-undang domestik dan mencegah berlakunya apa-apa salah guna keistimewaan yang diperuntukkan di bawah peraturan 6 dan 7.

Seksyen 7

Seorang Pegawai hendaklah mempunyai keistimewaan yang dinyatakan dalam perenggan 2 dan 7 Bahagian I Jadual Keempat kepada Akta.

INTERNATIONAL ORGANIZATIONS (PRIVILEGES AND IMMUNITIES) ACT 1992

INTERNATIONAL ORGANIZATIONS (PRIVILEGES AND IMMUNITIES)

(THE BADMINTON WORLD FEDERATION) REGULATIONS 2018

IN exercise of the powers conferred by subsections 3(1) and 4(1) and section 11 of the

International Organizations (Privileges and Immunities) Act 1992 [Act 485], the Minister, with the concurrence of the Minister of Finance, makes the following regulations:

Citation 1.

These regulations may be cited as the International Organizations (Privileges and Immunities) (The Badminton World Federation) Regulations 2018.

Interpretation 2.

In these Regulations, unless the context otherwise requires—

“BWF” means Badminton World Federation;

"Officer" means the officer, as specified in the Schedule, of the Badminton World

Federation, for the purpose of the Office;

“Office” means the BWF Headquarters in Kuala Lumpur, Malaysia, to perform its functions.

Non-application 3.

These regulations shall not apply to an Officer who is a citizen and a permanent resident of Malaysia including an officer who is engaged locally and assigned to an hourly rate.

Declaration of BWF to be an international organization 4.

BWF is declared to be an international organization to which section 4 of the

Act applies.

Juridical personality 5.

BWF shall have juridical personality and shall have the capacity—

(a)

to enter into contracts;

(b)

to acquire and dispose of movable and immovable property; and

(c)

to institute and be a party to legal proceedings.

Privileges of BWF

(1)

BWF shall have the privileges specified in paragraphs 5, 6 and 7 of the First

Schedule to the Act.

(2)

BWF shall co-operate at all times and shall procure that its Officer co-operate at all times with the appropriate authority of the Government of Malaysia to facilitate the proper administration of justice, to secure the observance of domestic legislation and to prevent the occurrence of any abuses in connection with the privileges accorded under regulations 6 and 7.

Privileges of Officer 7.

An Officer shall have the privileges specified in paragraphs 2 and 7 of Part I of the

Fourth Schedule to the Act.
