Antarabangsa (Keistimewaan dan Kekebalan) (Pertubuhan Gerakan Pengakap

Sedunia) 2018.

“Pegawai” ertinya pegawai Pertubuhan Gerakan Pengakap Sedunia yang dinyatakan dalam Jadual;

“Setiausaha Agung” ertinya orang yang dilantik oleh Ahli Jawatankuasa Pengakap

Sedunia dan merupakan ketua pegawai tadbir Pertubuhan Gerakan Pengakap Sedunia; dan

“WOSM” ertinya “Pertubuhan Gerakan Pengakap Sedunia” yang ditadbir oleh perlembagaannya dan wakil-wakil yang diiktiraf oleh Anggota Pertubuhan yang telah mengamalkan dan mempraktikkan Pergerakan Pengakap yang diasaskan pada 1907, yang telah berhimpun di Paris, Perancis, pada Julai 1992 dan telah menubuhkan

Persidangan Pengakap Antarabangsa bagi menyelaraskan Pergerakan Pengakap di seluruh dunia bersama-sama dengan Jawatankuasa Eksekutif dan Sekretariat.

WOSM diisytiharkan menjadi suatu organisasi antarabangsa yang baginya seksyen 4 Akta terpakai.

Seseorang Pegawai, selain warganegara atau penduduk tetap Malaysia, hendaklah mempunyai keistimewaan yang dinyatakan dalam perenggan 2 dan 7 Bahagian I Jadual

Keempat Akta.

INTERNATIONAL ORGANIZATIONS (PRIVILEGES AND IMMUNITIES) ACT 1992

INTERNATIONAL ORGANIZATIONS (PRIVILEGES AND IMMUNITIES) (THE WORLD

ORGANIZATION OF THE SCOUT MOVEMENT) REGULATIONS 2018

IN exercise of the powers conferred by subsections 3(1) and 4(1) and section 11

of the International Organizations (Privileges and Immunities) Act 1992 [Act 485], the Minister, with the concurrence of the Minister of Finance, makes the following regulations:

Citation 1.

These regulations may be cited as International Organizations (Privileges and

Immunities)

(The

World

Organization of

The

Scout

Movement)

Regulations 2018.

Interpretation 2.

In these Regulations, unless the context otherwise requires—

"Officer" means the officer of the World Organization of the Scout Movement specified in the Schedule;

"Secretary General" means the person appointed by the World Scout Committee and is the chief administrative officer of the World Organization of the Scout Movement;

and

“WOSM” means the World Organization of the Scout Movement which is governed by its constitution and the accredited representatives of Member Organizations which had adopted and practiced the Scout Movement founded in 1907, assembled in Paris,

France, in July 1992 and established the International Scout Conference for the coordination of the Scout Movement throughout the world together with an Executive Committee and a Secretariat.

Declaration of WOSM to be an international organization 3.

WOSM is declared to be an international organization to which section 4 of the Act applies.

Juridical personality 4.

WOSM shall have juridical personality and shall have the capacity—

(a)

to contract;

(b)

to acquire and dispose immovable and movable property; and

(c)

to institute and be party to legal proceedings.

Privileges of WOSM

5.

(1)

WOSM shall have the privileges specified in paragraphs 5, 6 and 7 of the

First Schedule of the Act.

(2)

WOSM shall cooperate at all times and shall procure that the Officer co-operate at all times with appropriate authority of the Government of Malaysia to facilitate the proper administration of justice, to secure the observance of domestic legislation and to prevent the occurrence of any abuse in connection with the privileges accorded under Regulations 5 and 6.

Privileges of Officer 6.

An Officer, other than a citizen or permanent resident of Malaysia, shall have the privileges specified in paragraphs 2 and 7 of Part I of the Fourth Schedule of the Act.
