PADA menjalankan kuasa yang diberikan oleh subseksyen 3(1) dan perenggan 3(2)(dd), (e) dan (f) Akta Penerbangan Awam 1969 [Akta 3], Menteri membuat peraturan-peraturan yang berikut: Nama dan permulaan kuat kuasa

Peraturan-peraturan ini bolehlah dinamakan Peraturan-Peraturan

Penerbangan Awam (Pengendalian Aerodrom) (Pindaan) 2018.

Apa-apa notis, surat pekeliling, arahan, maklumat atau kehendak yang dikeluarkan atau dibuat oleh Ketua Pengarah di bawah Peraturan-Peraturan ibu sebelum tarikh permulaan kuat kuasa Peraturan-Peraturan ini hendaklah, pada tarikh permulaan kuat kuasa Peraturan-Peraturan ini, terus sah dan berkuat kuasa seolah-olah

Peraturan-Peraturan ibu tidak dipinda oleh Peraturan-Peraturan ini.

Apa-apa penggantungan atau perubahan, sementara atau tidak, atau pembatalan suatu kebenaran, perakuan atau kelulusan oleh Ketua Pengarah di bawah

Peraturan-Peraturan ibu sebelum tarikh permulaan kuat kuasa Peraturan-Peraturan ini hendaklah, pada tarikh permulaan kuat kuasa Peraturan-Peraturan ini, terus sah dan berkuat kuasa seolah-olah

Peraturan-Peraturan ibu tidak dipinda oleh

Peraturan-Peraturan ini.

Apa-apa permohonan kepada Ketua Pengarah yang belum selesai pada tarikh permulaan kuat kuasa Peraturan-Peraturan ini hendaklah, pada tarikh permulaan kuat kuasa

Peraturan-Peraturan ini, diuruskan di bawah

Peraturan-Peraturan ibu sebagaimana yang dipinda oleh Peraturan-Peraturan ini.

CIVIL AVIATION (AERODROME OPERATIONS) (AMENDMENT) REGULATIONS 2018

Opening note

Preamble

IN exercise of the powers conferred by subsection 3(1) and paragraphs 3(2)(dd), (e) and (f) of the Civil Aviation Act 1969 [Act 3], the Minister makes the following regulations: Citation and commencement 1.

(1)

These regulations may be cited as the

Civil

Aviation

(Aerodrome Operations) (Amendment) Regulations 2018.

(2)

These Regulations come into operation on 19 February 2018.

General amendment 2.

The Civil Aviation (Aerodrome Operations) Regulations 2016 [P.U. (A) 98/2016], which are referred to as the “principal Regulations” in these Regulations, are amended—

(a)

by substituting for the words “Director General” wherever appearing the word “Authority” except in regulations 6, 7, 12, 20, 21, 23, 24, 25, 28, 29,

30, 31, 32, 33, 34, 35, 36, 37, 38, 40, 45, 46, 47, 48, 49, 50, 51, 52, 54, 55,

60, 63, 64, 65 and 66; and

(b)

in regulations 12, 23, 25, 29, 30, 31, 32, 33, 35, 36, 37, 40,

45, 46, 47, 48, 49, 50, 51, 52, 63, 65 and 66, by substituting for the words

“Director

General”

wherever appearing the words

“Chief Executive Officer”.

Amendment of regulation 6 3.

Regulation 6 of the principal Regulations is amended—

(a)

in subregulations (1), (4) and (6), by substituting for the words

“Director General” the word “Authority”;

by substituting for paragraph (a) the following paragraph:

Amendment of regulation 20 5.

Subregulation 20(1) of the principal Regulations is amended—

in paragraphs (d) and (h), by substituting for the words “Director General”

the word “Authority”; and

“(i) submit to the Authority the reports on the conditions of an aerodrome in accordance with any requirements as may be determined by the Chief Executive Officer.”.

Amendment of regulation 21 6.

Regulation 21 of the principal Regulations is amended by substituting for subregulation (2) the following subregulation:

An aerodrome operator shall report to the Authority of any inspection carried out under subregulation (1) within the specified time limits in the form and manner as may be determined by the

Chief Executive Officer.”.

Amendment of regulation 24 7.

Regulation 24 of the principal Regulations is amended—

(a)

in subregulation (2), by substituting for the words “Director General”

the words “Chief Executive Officer”; and

(b)

in subregulation (5), by substituting for the words “Director General”

the word “Authority”.

Amendment of regulation 28 8.

Regulation 28 of the principal Regulations is amended—

(a)

in subregulations (1), (3) and (4), by substituting for the words

“Director General” wherever appearing the word “Authority”; and

(b)

in subregulation (2)—

(i)

by substituting for paragraph (a) the following paragraph:

“(a) made to the Authority in the form and manner and accompanied by the documents and information, as may be determined by the Chief Executive Officer;”; and

(ii)

in paragraph (c), by substituting for the words “Director General” the words “Chief Executive Officer”.

Amendment of regulation 34 9.

Regulation 34 of the principal Regulations is amended—

(a)

in subregulation (1), by substituting for the words “Director General”

the words “Chief Executive Officer”; and

(b)

in subregulations

“Director General” the word “Authority”.

Amendment of regulation 38 10.

Subregulation 38(1) of the principal Regulations is amended—

(a)

in paragraph (c), by substituting for the words “Director General” the word

“Authority”; and

(b)

in paragraph (d), by substituting for the words ““Director General”

the words “Chief Executive Officer”.

Amendment of regulation 54 11.

Regulation 54 of the principal Regulations is amended—

(a)

in subregulation (1)—

(i)

by substituting for the words “shall report to the Director General”

the words “shall report to the Authority”; and

(ii)

by substituting for the words “determined by the Director General”

the words “determined by the Chief Executive Officer”;

(b)

by renumbering the existing subregulation (3) in the English language text as subregulation (2); and

in subregulation (2), by substituting for the words “Director General”

wherever appearing the words “Chief Executive Officer”.

Amendment of regulation 55 12.

Regulation 55 of the principal Regulations is amended—

(a)

in subregulation (1)—

(i)

by substituting for the words “Director General” the word

“Authority”; and

(ii)

by substituting for the words “Department of Civil Aviation” the word “Authority”; and

(b)

in subregulation (2), by substituting for paragraph (b) the following paragraph:

“(b) in default of payment of the charges, the Authority, on behalf of the Government, shall be at liberty forthwith to remove the aircraft from any hangar or shed in which it may be housed or stored and to place it in the open place and the Authority shall further be at liberty, either in addition to or alternatively to such removal, after giving fourteen days’

notice in writing to the owner of the Authority’s intention to do so, to sell the aircraft or any part, component or accessory thereof by public auction or private contract without the

Authority or servants of the Authority being responsible for any loss in connection with the sale and to reimburse the

Authority out of proceeds of the sale an amount of the charges due to the Authority together with all costs, charges and expenses incurred in connection with the sale;”.

Amendment of regulation 60 13.

Subregulation 60(1) of the principal Regulations is amended—

(a)

in paragraph (b), by substituting for the words “Director General” the words “Chief Executive Officer”; and

(b)

in paragraph (g), by substituting for the words “Director General” the word “Authority”.

Amendment of regulation 64 14.

Regulation 64 of the principal Regulations is amended—

(a)

in subregulations (1), (2) and (4), by substituting for the words

“Director General” the word “Authority”; and

(b)

in subregulation (3)—

(i)

by substituting for the words “Director General” the word

“Authority”; and

(ii)

by substituting for the word “if he considers necessary” the words

“if the Minister or the Authority considers necessary”.

Savings and transitional 15.

(1)

Any authorization, certificate or approval issued or given by the

Director General under the principal Regulations before the date of coming into operation of these Regulations shall, on the date of coming into operation of these

Regulations, continue to be valid and have effect as if the principal Regulations had not been amended by these Regulations until suspended or varied, temporary or not, revoked or expired under or in accordance with the corresponding provisions of the principal Regulations as amended by these Regulations.

(2)

Nothing in these Regulations shall be construed to extend the duration of any authorization, certificate or approval specified in subregulation (1) beyond the date of its expiry.

(3)

Any notice, circular, directive, information or directions issued or made by the Director General under the principal Regulations before the date of coming into operation of these Regulations shall, on the date of coming into operation of these

Regulations, continue to be valid and have effect as if the principal Regulations had not been amended by these Regulations.

(4)

Any suspension or variation, temporary or not, or revocation of an authorization, certificate or approval by the Director General under the principal

Regulations before the date of coming into operation of these Regulations shall, on the date of coming into operation of these Regulations, continue to be valid and have effect as if the principal Regulations had not been amended by these Regulations.

(5)

Any application to the Director General which is pending on the date of coming into operation of these Regulations shall, on the date of coming into operation of these Regulations, be dealt with under the principal Regulations as amended by these Regulations.
